implementing certain provisions of the Act on Agricultural Cooperatives on Vacation and Physical Responsibility of Members of Single Agricultural Cooperatives
The Federal Ministry of Agriculture and Nutrition provides in agreement with the Ministry of Agriculture and Nutrition of the Czech Socialist Republic and the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic according to § 57 (2) (a) and § 73 (5) of Act No. 122 / 1975 Coll., on Agricultural Cooperatives:
Preliminary provisions
This Order
(a) it shall:
1. closer conditions for granting further leave to members of the single agricultural cooperative (hereinafter referred to as "cooperative"), 1)
2. The method of calculating compensation for the remuneration for the work of the members of the cooperative who have working hours unevenly distributed over the whole calendar year,
(b) determine the functions of the cooperative which require the conclusion of a written agreement on liability.
Next Holidays
The entitlement to further leave shall be:
(a) members of a cooperative whose work depends substantially on weather effects;
(b) members of a cooperative who have working hours unevenly distributed over the whole calendar year, either:
1. both in terms of the length of shifts and in terms of the number of working days per week; or
2. in terms of the length of shifts, if the difference in the length of shifts is at least two hours in the period of higher and lower work needs (§ 3).
Less-need periods
(1) For the members of the cooperative whose work depends substantially on weather effects, the period from 1 December to 31 March of the following year shall be lower in time.
(2) The period referred to in paragraph 1 may be shortened by a resolution of the member meeting (the College of Representatives) according to the operational conditions and needs of the cooperative.
(3) For members of a cooperative who have working time unevenly distributed over the entire calendar year, the period with lower working needs shall be from 1 December to 31 March of the following year, unless the member meeting (the representative assembly) provides for a different period for important reasons.
Determination of the amount of compensation for the vacation allowance
Compensation for work on leave to members of a cooperative who have working time unevenly distributed over the entire calendar year shall be determined by reference to the number of shifts attributable to the period in which the member of the cooperative draws leave. In those days, he has the average reward for work.
Functions for the execution of which a written agreement on material liability is necessary
(1) The conclusion of a written agreement on material liability for the entrusted cash, prizes, goods, supplies of material or other value which a member of the cooperative is required to account for is necessary for the performance of the following functions:
(a) the teller and other functions connected with the execution of treasury operations with funds or prizes;
(b) a storekeeper and other functions, including the taking-over, storage, treatment, administration and supply of raw materials, materials, semi-finished products, goods and other materials or devices,
(c) the head of the store, its representative and other staff of the store, whose work includes the handling of funds, prices and goods; and
(d) dispatch and other dispatch and delivery personnel.
(2) Further functions for which a written agreement on substantive liability is necessary, taking into account the type of work, the content of the work and the local conditions, shall be determined by the members' meeting (assembly of representatives).
(3) The functions for which a written agreement on material liability is necessary for the performance of the duties must be laid down in the Staff Regulations of the Cooperative Group.
The cooperative shall be obliged to create conditions for its members so that they can properly fulfil their obligations under the substantive liability agreement.
Transitional and final provisions
The cooperative must ensure, by 29 February 1980, that only members of the cooperative with which a written agreement on material liability has been concluded perform the functions referred to in paragraphs 1 and 2 of Section 5 of this Order.
This Decree shall take effect on 1 January 1980.
