DECLARATION
State Arbitration of the Czechoslovak Socialist Republic
of 26 November 1976
on the transitional arrangements for certain economic obligations for the supply and collection of electricity, heating gases and solid fuels
On the basis of the Order of the Bureau of the Government of the Czechoslovak Socialist Republic of 21 October 1976 No 283 V / 7 The State Arbitration of the Czechoslovak Socialist Republic pursuant to § 395 (b) of the Economic Code No. 109 / 1964 Coll., as published under No. 37 / 1971 Coll. provides:
In the case of electricity supply and collection, a tolerance of + 1% and - 2% is permitted in the contract period. 1)
Property penalties for not withdrawing the agreed amount of electricity (2) may not be charged or enforced, even if in an individual case they exceed 1000 CZK.
Property penalties for non-recovery of heating gases (3) in the period 1 October to 31 March need not be charged or enforced, even if in individual cases they exceed 1000 CZK.
(1) The right to property penalties for delays in the supply of solid fuels, (4) which were or are to be implemented under economic contracts in the second half of 1976, shall cease to exist or shall not arise.
(2) The supply of solid fuels in 1977 is first taken into account for the performance of economic contracts concluded for 1977.
This Decree shall take effect on the day of its publication, except for Article 1, which shall take effect on 1 January 1977; the decree is valid until 31 December 1977.

1) Paragraph 2 (2) of Act No 175 / 1973 Coll., which issues the basic conditions for the supply of electricity and heat, shall not apply.
2) Articles 15 (1) (b) and 7 (1) (b), No 175 / 1973 Coll.
3) Sections 34 (2) and 39 (2) of the Act No. 176 / 1973 Coll., which issue basic conditions for the supply of heating gases, oil and gazoline.
4) Paragraph 204 (1) of the Economic Code.
