on the issue of basic conditions for the delivery of motor vehicle repairs
The Ministry of General Engineering, in agreement with the participating central authorities and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides, pursuant to Section 392 of Economic Code No. 109 / 1964 Coll. ("the Act '):
§ 1
Scope
(1) This Decree regulates the supply of repair and maintenance of two-track and one-track road vehicles for motor vehicles (hereinafter referred to as "vehicles') as well as separate main groups, sub-groups, components and components of such vehicles (hereinafter referred to as" groups').
(2) The purpose of the supply is:
(a) overhauls of motor vehicles;
(b) routine repairs and overall repairs of separate groups and sub-groups;
(c) renovation of components;
(d) maintenance of motor vehicles.
(3) The provisions of this Decree do not apply to trolleybuses, trailers, dumpers, dumping trucks, unpackaged cement tanks, mixers, bulldozers and vehicles individually imported.
§ 16
Liability for defects (complaints)
(1) The warranty period shall be 6 months, unless otherwise modified in the technical standard, or the vehicle does not exceed 12000 km.
(2) The collector shall advertise defects with the supplier or the repairer repairing the same mark and vehicle type. The supplier shall forward to the customer, at the latest on completion of the delivery, a list of the repairers making the warranty repairs.
(3) The collector shall be entitled to remove the defects himself and to request reimbursement of the costs of the removal of the defect only if agreed with the supplier.
(4) The rights of liability for defects which are evident when the vehicle is taken over must be claimed at the latest when the vehicle is taken over; if the vehicle is transported by means of means of transport, such defects shall be recovered no later than 3 days after the vehicle reaches its destination, otherwise the right of liability for defects shall cease.
(5) The collector is obliged to build a vehicle, group or part where he claims to the supplier or to the nearest designated repair plant.
(6) The guarantee is terminated if the vehicle has been crashed (except for accidents caused by defective repair). However, it does not cease to exist for groups and parts which were not affected by the accident.
(7) The time limit for the removal of the defect shall be agreed by the customer with the supplier, taking into account the time-limit for the removal of the defect, where appropriate, the time needed to procure the material. that period shall not exceed 10 working days. In order to remove the defect rapidly, the supplier or the authorised repairer may replace the defective group or part with another, but which must be technically identical, i.e. the same mark and type.
(8) The customer is obliged to bring the vehicle as a whole into the warranty repair when the claim is made unless the supplier agrees otherwise with the customer.
§ 19
Efficacy
This Decree shall take effect on 1 July 1964.
