Constitutional Decree of the President of the Republic
of 27 October 1945
on the provision of persons who were considered to be State-of-the-art unreliable at a revolutionary time.
On the proposal of the Government,
The provision of persons who have been considered to be State-of-the-art unreliable, the authorities or authorities of the Republic, even in cases of statutory leave or extension of provisional detention (ties) over a period permitted under the law, shall be declared lawful. These persons are not entitled to compensation because of this provision or the extension of the provisional security over the period permitted under the law.
By means of the provision (provisional security) within the meaning of this Decree and other legal provisions, the concentration of foreign nationals, carried out by the competent authority at certain places for the purpose of their subsequent postponement, cannot be understood. Such concentration can be carried out without restriction.
This decree applies only to cases of collateral or extension of provisional collateral (bond) over a period permitted under the law prior to the entry into force of this decree.
During the term of validity of the decree of the President of the Republic of 19 June 1945, No 16 Coll., on the punishment of Nazi criminals, traitors and their helpers and on extraordinary folk courts, the period laid down in § 3 of the Constitutional Law of 9 April 1920, No 293 Coll., on the protection of the freedom of persons, home and secrets of letters (pursuant to § § 107, 112 and 116 of the Constitutional Charter) shall be extended to eight days.
This decree takes effect on the 30th day following its publication and is valid in the Czech and Moravian-Silesian countries; It shall be carried out by the Ministers for Justice and Home Affairs.
