DECLARATION
of 19 March 2004
laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the breeding law
The Ministry of Agriculture provides, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll., ("the Act '), for the implementation of Sections 22 (13), 23 (5), 23a (4), 23b (8), 23c (4) and 24 (11):
General provisions
Subject matter
(1) This decree implements the relevant European Union26), following up on the directly applicable European Union27) and provides for
(a) the marking and registration of tubers, (2) equidae, pigs, sheep, goats, runners, deer and camels;
(b) the registration of poultry and aquaculture animals;
(c) the registration of holdings with the animals referred to in (a) and (b) and the registration of persons provided for by law (hereinafter referred to as "designated persons");
(d) details of checks on compliance with the labelling and registration obligations referred to in (a) to (c).
(2) This Decree also provides for the following:
(a) the marking and registration of farmed game;
(b) the registration of rabbits, breeding fish and bees;
(c) the registration of holdings with the animals referred to in (a) and (b) and the registration of designated persons;
(d) details of checks on compliance with the labelling and registration obligations referred to in (a) to (c).
Basic concepts
For the purposes of this decree:
(a) the identification number of the animal, with the exception of equine - not more than 14-digit alphanumeric code, which allows identification of the particular animal and which contains:
1. in the first two places alphabetical designation of the country of origin - letters "CZ" for the Czech Republic,
2. in the following 12 places, the number line,
(b) the identification number of the equine animal - a maximum of 15-digit alphanumeric code allowing identification of a particular animal and containing:
1. in the first three places the country code of registration - number "203" for the Czech Republic,
2. at the following three places, the alphanumeric code of the recognised breeding association or authorised person, (4) which has registered the animal in the register of equidae,
3. at the last nine places, the registration number of the animal in the database of a recognised breeding association or authorised person, (4) which has registered the animal in the register of equidae,
(c) the registration number of a maximum of 14-digit alphanumeric code enabling the identification of a particular holding, bee-keeper, slaughterhouse, hatchery establishment, ungularplant (5) or poultry sewerage installation (5) (hereinafter referred to as "seductionfacility"), merchant (6), experimental animal user (7) (hereinafter referred to as "user establishment") or rendering plant (8), which contains:
1. in the first two places alphabetical designation of the country of origin - letters "CZ" for the Czech Republic; in the case of a transfer of the alphabetical indication of the country of origin to numerical expression, this code is translated in accordance with Annex I to Commission Regulation (EU) 2021 / 520;
2. in the following 12 places, the number line,
(d) the movement of the animal - the movement of the animal between different holdings of the same breeder, the movement to another breeder, the movement to the setups of the animals (9) and from the setups of the animals, the movement to the slaughterhouse operator, the movement to the seabed, the movement to the user establishment, the movement to the rendering establishment, the movement from another Member State of the European Union (Member State) and the import or export from a country which is not a Member State of the European Union (third country); the movement of the animal between different stables within the same holding (hereinafter referred to as the "movement of the animal between stables') is not considered to be a transfer;
(e) flock - a group of poultry of one species and one category which is kept in one holding hall and which is present in that hall at the same time,
(f) competent authority (10) - Ministry of Agriculture,
(g) temporary holding - holdings on which ovine, caprine or porcine animals have been moved for domestic slaughter and slaughtered within 7 days,
(h) the person carrying out the marking of equidae - the authorised person or recognised breeding association which carry out the marking of equidae pursuant to Article 22 (3) and (4) of the Act;
(i) hall - building of a holding where a flock of poultry is kept,
(j) stocking density - total live weight of chickens in the hall at the same time, per square metre of usable area,
(k) daily mortality rates - the number of chickens that died in one hall on the same day, including chickens slaughtered for disease or for other reasons, divided by the number of chickens found in that hall on that day, multiplied by 100,
(l) cumulative daily mortality rate - sum of daily mortality rates,
(m) non-breeding animals originating in aquaculture (37);
(n) the colony of bees, capable of overwintering, fully occupying at least seven coats of frame size 39 x 24 cm; different frame rates are recalculated.
Competent authority code
The model of the competent authority code for the purposes of this Order is set out in Annex 1.
Labelling of animals
(K § 22 (12) of the Act)
Common provisions
Types of means of identification
(1) Identification means are:
(a) means of identification listed in Annex III to Commission Regulation (EU) 2019 / 2035;
(b) marks for the marking of runners;
(c) the genetic type,
(d) fires, only for equidae, 11)
(e) word and graphic description.
(2) The use of electronic identifiers that contain the manufacturer's code in the structure of the code instead of the country code is possible provided that the European Union11b provisions are directly applicable. For electronic identifiers that contain the country code 203 for the Czech Republic, the number series assigned to the manufacturers of electronic identifiers by the person (4) shall be assigned.
General technical requirements for means of identification
(1) The means of identification must comply with Annex II to Commission Regulation (EU) 2021 / 520. The marking by hand-written alphanumeric characters shall be inadmissible except for optional particulars. The letters must not interfere with the printed text.
(2) The models of the ear tags and marks for the marking of runners listed in the Annexes to this Regulation are binding on the placing of alphanumeric characters on them and on the requirements laid down in this Regulation for their size.
(3) Application pliers are used to hang ear tags and mark runners.
General technical requirements for duplicates of eartags and marks for the marking of runners
Article 5 applies mutatis mutandis to duplicates of ear tags and duplicates of marks for the marking of runners.
Data to be provided on duplicates of eartags and marks for the marking of runners
(1) The duplicate ear tags used for the labelling of tubers, sheep and goats must contain:
(a) data identical to those shown on the original ear tag;
(b) the competent authority code;
(c) the serial number of the duplicate for the piece indicated by the Roman figure.
(2) The duplicate of a foreign ear tag used for the labelling of tubers, sheep and goats moved from another Member State or imported from a third country must contain:
(a) the identification number of the animal on the original ear tag;
(b) the competent authority code;
(c) the serial number of the duplicate issued in the Czech Republic for the piece indicated by the Roman figure.
(3) The duplicate ear tag used for the marking of pigs shall contain data identical to those shown on the original ear tag, including the alphanumeric code of the holding where the pigs were born.
(4) The duplicate of the mark for the marking of runners shall contain data identical to those shown on the original mark.
Removal and replacement of eartags and marks for the marking of runners by other means of identification
Remove the ear tag or mark for the marking of runners from the animal or replace it by another means of identification only
(a) in the case referred to in Paragraph 22 (8) (a) of the Act; only one ear tag may be identified on the basis of animal designation,
(b) if there are health complications of the animal; during this period, the breeder shall ensure the identity of the animal, after the health complications have been resolved, the animal shall be marked with a duplicate of the ear tags taken off or of the marks for the marking of runners;
(c) if the animal is not marked in accordance with the law and this decree; or
(d) in the case of movements from another Member State or imports from a third country which is not marked in accordance with the law and this decree and which remains in the territory of the Czech Republic.
Ensuring the means of identification or duplicates thereof, the manner in which they are recorded, issued and replaced, including dates
(1) The authorised person (4) shall ensure that means of identification or duplicates thereof are dispatched to the breeder within 8 working days of the date of receipt of his request for identification or duplicates thereof.
(2) The person responsible (4) shall record the date of receipt of the breeder's request for identification or duplicates.
(3) In the case of turkeys, sheep and goats authorised by person4), the allocated means of identification shall be recorded by the individual farmers for their holdings within a single region, indicating the date of the allocation and the number of the allocated means of identification, including the number series for the county and breeders.
(4) Only a number of ear tags shall be provided to the rearing of turkeys, sheep and goats authorised by the person (4) so that the stock of sets of such means of identification does not exceed within one region:
(a) the number of females over 12 months of age on the holdings of the turmerer with a registered number of such females over 5 head;
(b) twice the number of females over 12 months of age on the holdings of the turmerer with a registered number of such females up to and including 5 head;
(c) three times the number of females over 12 months of age on sheep and goat holdings;
(d) in the case of breeding breeds of ovine and caprine animals, four times the number of females over 12 months of age, provided that the breeder confirms in the application form that he has kept breeding breeds of ovine or caprine animals.
(5) The person responsible (4) shall register the duplicates of the means of identification issued directly in the database of the animal register of each animal, indicating the date of issue and the order of the duplicate.
(6) In the cases referred to in Articles 10 (6) and 10 (7) and 22 (5) and (6), the ear tags for that animal provided by the authorised person must be transmitted at each movement together with the animal.
(7) The authorised person shall approve the means of identification referred to in Articles 9 and 11 of Commission Regulation (EU) 2021 / 520. The authorised person shall include the technical specifications of the means of identification on his website.
Tur labelling
Method and term of the labelling of the fats
(1) Turkeys are identified by two conventional ear tags.
(2) Each calf must be permanently marked with two conventional ear tags within 20 days of birth, one in each ear, and until that time the breeder must ensure that its identity can be established. However, the animal may not leave the holding on which it was born before the indication referred to in paragraph 1.
(3) Ear tags are hung to the root of the earache (between the skin eyelashes of the bolus).
(4) The method of labelling the turds with eartags is set out in Annex 2.
(5) One conventional ear tag for the labelling of turmeric may be replaced by an electronic eartag or a bazaar bolus transponder.
(6) The two conventional ear tags for the labelling of turds may only be replaced if a derogation has been granted under Article 39 of Commission Regulation (EU) 2019 / 2035.
(7) If the tissues cannot be marked with an ear tag due to damage, inflammation or deformation of the hearing bolts, they shall be marked in a visible alternative manner so as to avoid confusion with other tissues. This alternative means of identification shall be recorded immediately by the breeder in the stables register.
(8) In the case of bazaar bolus transponder markings, the period for marking by this means of identification shall be 60 days from birth.
Ear tags used for the labelling of tubers and their models
(1) Conventional ear tags of type A or a combination of type A and type B. Conventional ear tags consist of two parts which are connected by a permanently lockable thorn which is part of one part; both parts of conventional ear tags A shall be at least 45 mm high, at least 55 mm wide and the height of the alphanumeric characters on them shall be at least 5 mm high.
(2) Both parts of the conventional ear tag shall contain:
(a) the animal identification number;
(b) the code of the competent authority.
(3) The conventional ear tag type A shall always be used to indicate one ear, which shall contain only the particulars referred to in paragraph 2; the marking by other or handwritten alphanumeric characters is inadmissible.
(4) The conventional ear tag type A or type B shall be used for marking the second ear.
(5) The ear tags used on the marking of the second ear may include, in addition to the particulars referred to in paragraph 2, the breeder's records on both the face and the reverse, provided that the legibility of the data referred to in paragraph 2 is not infringed.
(6) The ear tag used for the marking of tubers shall contain, in the animal identification number, the seventh digit for males, the number 0 for females, the number 9 for females and the following two digits for the first two digits of the registration number of the holding where the animal was born.
(7) The model of the part of the conventional ear tag type A and variant B and the model of the part of the duplicate of the conventional ear tag type A and variant B are given in Annex 2.
Means and dates for the labelling of tubers moved from other Member States or imported from third countries
(1) Turas moved from other Member States or imported from third countries directly to the slaughterhouse shall be left with the original indication if the animal is slaughtered within 20 days of the date of border veterinary inspection.
(2) Turkeys transferred from other Member States or imported from third countries which remain in the Czech Republic and which are not marked in accordance with European Union rules shall be identified as described in Sections 10 and 11 within 72 hours of their arrival at their destination.
(3) Turkeys moved from other Member States or imported from third countries which remain on the territory of the Czech Republic and which are identified in accordance with European Union rules shall be considered as having been identified in accordance with this Decree.
Labelling of equidae
Means and dates of identification of equidae
(1) Equidae shall be identified by the methods laid down in the various orders of equidae 'breeding books (12):
(a) word and graphic description and electronic identification11b); or
(b) a word and graphic description, an electronic identification11b) and a fire in the case where such a fire is given in the appropriate rules of the herd book of equidae (12).
(2) Equidae not registered in the herd book are identified by word and graphic description and by an electronic identifier in accordance with Commission Implementing Regulation (EU) 2021 / 96311b).
(3) Each horse foal shall be marked in such a way that the horse passport is issued before leaving the holding on which the foal was born, except where such movement takes place in accordance with Commission Implementing Regulation (EU) 2021 / 96311b, but not later than 12 months after the date of birth.
(4) The person carrying out the identification of equidae shall indicate the equine animal within 28 days of the date on which it was demonstrably requested by the owner. In the case of equidae registered in a breeding book kept in the Czech Republic, except for horses of breeds of the English purebred and glider, the fourth admission note shall be completed and sent, in the case of equidae registered in the Czech Republic, to the competent recognised breeders' association, to the fourth admission note or, where applicable, to the registration of the horse by the authorised person (4) within 10 days of the identification of the equine animal. In the case of horses of the breed English purebred and glider, the registration procedure and the dates for the transmission of the supporting documents for the issue of the horse's licence shall be governed by the applicable Order of the herd book.
Word and graphic description
(1) The verbal description shall contain a description of the basic colour and a description of the congenital badges characterising the head, neck, limb and body of the equine animal.
(2) The graphical description shall include a drawing of congenital and acquired badges and hair vortices characterising the body of the equine animal from the left and the right, head, neck and breast from the ventral point of view, head and nose from the oily point of view, thoracic and pelvic extremities.
(3) A verbal and graphic description of the equine animal shall be provided by the breeder to the person carrying out the identification of equidae.
(4) If there are changes on the equine animal which do not comply with his word and graphic description on the horse passport or in the equine registry, the animal breeder shall ensure repair of the person carrying out the identification of equidae. The person carrying out the identification of equidae shall make a change to the word and graphic description in the horse passport and in the registration report of the equine animal born in the Czech Republic, which shall be sent to the issuing authority within 7 days of the date of registration. 11b).
(5) The graphic description of the equine animal may be replaced in accordance with Article 16 of Commission Implementing Regulation (EU) 2021 / 963 of high quality photographs for equidae with unique colour badges.
Labelling of equidae by electronic identifier and embossing
(1) The identification of the equine animal by electronic identification11b) shall be recorded by the person carrying out the identification of equidae in the equine registration book and on the admission note or, where appropriate, on the equine registration and permanent import report. This is without prejudice to the obligation of the issuing authority to record the horse's licence in accordance with the directly applicable European Union Regulation (12a).
(2) Electronic identifiers referred to in Article 4 (2) are used to identify equidae. If the equine animal is identified by an electronic identifier that contains the country code 203 for the Czech Republic in the structure of the code but does not come from a number series assigned by the mandate4) or for other reasons does not comply with the directly applicable European Union11b Regulation, it shall be used as an alternative means of identifying the genetic type of the equine animal.
(3) The ignition and its location are part of the order of breeding books.
Labelling of pigs
Means and terms of labelling of pigs
(1) Pigs are marked with tattoos or ear tags.
(2) Any pig whose marking is required by Article 22 of the Act must be marked with a tattoo in the left ear or a tattoo on the left side of the body or an ear stamp in the left ear before weaning, but not later than the thirtieth day after his birth. In the case of transfer of sows, piglets shall be referred to as piglets before leaving the holding in which they were born.
Tattoo of pigs
(1) The tattoo of pigs must contain the indication of the country of origin - the letters "CZ" for the Czech Republic and the alphanumeric code, which must express the registration number of the holding where the pig was born. The tattoo height shall be at least 6 mm.
(2) Prior to the marking of the pig tattoo, parts of the tattoo pliers which come into contact with the tissues of the animal and the site of the tattoo must be disinfected.
(3) The methods of marking pigs with tattoos are set out in Annex 3.
Ear tags used for marking pigs and their model
(1) Conventional ear tags shall be used for marking pigs, which shall be at least 25 mm high, at least 25 mm wide and the height of the alphanumeric characters indicated therein shall be at least 5 mm high.
(2) The conventional ear tag used for marking pigs must contain:
(a) country of origin designation - letters "CZ" for the Czech Republic,
(b) an alphanumeric code expressing part of the registration number of the holding where the pig was born;
(c) the competent authority code.
(3) The model of the conventional ear tag used for marking pigs and the method of suspension thereof are set out in Annex 3.
Means and dates for the labelling of pigs moved from other Member States or imported from third countries
(1) Pigs moved from other Member States or imported from third countries directly to the slaughterhouse shall be kept the original mark if the animal is slaughtered within 20 days of the date of border veterinary inspection.
(2) Pigs moved from other Member States or imported from third countries which remain on the territory of the Czech Republic for more than 20 days from the date of border veterinary checks and which are marked in accordance with the provisions directly applicable to the European Union shall be considered as pigs marked in accordance with this Regulation. If they are not so marked, they shall be marked within 7 days of arrival at the place of destination in accordance with § 18 and 20.
(3) Pigs moved from other Member States or imported from third countries to participate in the diversion shall be left with the original marking. Where they are further moved, those pigs shall be marked as referred to in paragraph 2.
Labelling of ovine and caprine animals
Means and terms of labelling of ovine and caprine animals
(1) Each ovine or caprine animal must be identified by two means of identification in accordance with the directly applicable European Union legislation on the establishment of the system and register of ovine and caprine animals (28) no later than 9 months after birth but always before leaving the holding where it was born.
(2) Animals intended for trade within the European Union must be marked with an electronic identifier in the form of a bachor bolus transponder or an electronic ear tag in combination with a conventional ear tag or a worm mark, in accordance with the directly applicable European Union regulation on the establishment of a system and register of ovine and caprine animals (28).
(3) Animals not intended for trade within the European Union must be marked in accordance with the directly applicable European Union legislation establishing a system and registration of ovine and caprine animals (29)
(a) a conventional ear tag in combination with a second conventional ear tag or tag on a wrench or electronic identifier in the form of an electronic tag on a wrench; or
(b) the means of identification referred to in paragraph 2.
(4) Lambs or kids intended for slaughter up to 12 months of age which are not intended to be moved to another Member State or for export to third countries may, by way of derogation from paragraph 1, be marked with at least one conventional ear tag which has been provided for that method by the authorised person in accordance with the directly applicable European Union legislation on the establishment of a system and register of ovine and caprine animals (30).
(5) Sheep and goats without earlobes or with very short earlobes which are not intended for trade within the European Union are identified on the lower coat of the uncultivated part of the tail by a tattoo which contains the identification number of the animal without the alphabetical indication of the country of origin "CZ" and without the last three digits.
(6) Sheep and goats which cannot be marked with an ear tag due to damage, inflammation or deformation of the ear bolts and which are not intended for trade within the European Union shall be marked in such a way as to avoid confusion with other animals. This means of identification shall be recorded immediately in the stable register.
(7) Conventional ear tags are hung within one third of the root of the earache between the skin fold of the bolus.
Ear tags used for the labelling of ovine and caprine animals and their models
(1) The conventional ear tags of type A or type B are used for the marking of ovine and caprine animals. The conventional ear tag of type A consists of two parts connected with a permanently lockable thorn, both parts must be at least 25 mm high, at least 25 mm wide and the height of the alphanumeric characters mentioned therein must be at least 4 mm high. The conventional ear tag of type B shall be at least 35 mm long and at least 9 mm wide and the height of the alphanumeric characters indicated shall be at least 4 mm high.
(2) The conventional ear tag must contain:
(a) the animal identification number;
(b) the code of the competent authority.
(3) Where the ovine or caprine animal is marked with two ear tags, one ear tag shall contain only the particulars referred to in paragraph 2, the marking by other or manually written alphanumeric characters shall be inadmissible. The second ear tag may include the breeder's records, both on the face and on the reverse, provided that the legibility of the data referred to in paragraph 2 is not infringed.
(4) Duplicate conventional ear tag type And it shall be at least 25 mm high, at least 25 mm wide and the alphanumeric characters indicated therein shall be at least 4 mm high, the conventional ear tag type B duplicate shall be at least 35 mm long, at least 9 mm wide and the alphanumeric characters indicated therein shall be at least 4 mm high.
(5) The model of the conventional ear tag type A and type B and the model of the duplicate of the conventional ear tag type A and type B are given in Annex 4.
