concerning the Agreement on cooperation in the formation and use of etalons of the Council of mutual economic assistance
On 7 July 1983, the Agreement on cooperation in the creation and use of the etalons of the Council of Economic Assistance was signed in Prague.
The Agreement entered into force on 5 October 1983 on the basis of its Article XXIII and entered into force on that date for the Czechoslovak Socialist Republic.
The Czech translation of the Agreement is announced simultaneously.

AGREEMENT
on cooperation in the creation and use of the etalons of the Council of mutual economic assistance
Contracting Parties,
managing the principles of cooperation between the Member States of the RVHP and the tasks arising from the comprehensive programme for further deepening and improving cooperation and the development of the socialist economic integration of the RVHP Member States, as well as the long-term target cooperation programmes of the Member States of the RVHP,
building on the interests of further development and improvement of cooperation between Member States in the field of metrology,
in order to ensure consistency of measurements in economic and scientific and technical cooperation, as well as in the national economy of the Member States of the FMC, specialisation and co-operation of production, exchange of goods and scientific research,
recognising the need for development and improvement of RVHP etalons and ensuring the use of agreed values of physical quantities units reproduced by these etalons,
a controller with the RVHP Statute,
decide to combine their efforts and agree on the following:
The Parties shall cooperate in the development and use of RVHP etalones within the framework of this Agreement, taking into account the requirements of RVHP standards, RVHP normative documents for standardisation and other normative RVHP documents or international documents relating to the subject matter of the Agreement, unless the latter contravenes the RVHP standards and the interests of the Member States of the RVHP.
The Parties shall carry out work on the creation of RVHP etalons in accordance with the Work Programme "Production of RVHP etalones by 1990 'approved at the 49th meeting of the Standing Committee of the RVHP on Standardisation Cooperation and its specifications and additions adopted by the Standing Commission on Standardisation Cooperation and its work plans.
The Parties agree to coordinate all activities related to the implementation of this Agreement under the Metrology Section of the Standing Committee on Standardisation.
The creation of RVHP etalones shall take place:
1. On the basis of the existing national etalons of the Contracting Parties - on the basis of coordination.
2. By drawing up a new RVHP etalon - on the basis of cooperation in accordance with the contract for its creation.
The planning of works for the creation of the RVHP, its approval, registration, improvement and cancellation shall be carried out in accordance with the procedure laid down by the RVHP Statute.
A Contracting Party which has declared its non-participation in the formation of individual RVHP etalons may later participate in the production of those RVHP etalons by means of a written communication to the Parties sent and the accession to a contract concluded in accordance with point 2 of Article IV.
National etalon, approved as RVHP, is retained in the State of which it is a national etalon (hereinafter referred to as the State-retained).
The State-keeper ensures the preservation and improvement of the RVHP etalon and creates conditions for its use.
Each of the national etalones that are part of the group etalon of the RVHP shall be retained in the State of which it is the national etalon.
One of the States (s) of the National Etalon, which is part of the group Etalon of the RVHP, shall be designated by agreement between the Contracting Parties, which are the State (s) of the group Etalon of the RVHP, as the State coordinator for the use of this Etalon of the RVHP as the group Etalon of the RVHP.
The State-keeper of the national etalon, which is part of the group etalon of the RVHP, ensures its preservation and improvement and creates conditions for its use.
The State-keeper of the RVHP etalon created by co-operation shall be determined by a contract for its creation.
The State-keeper of this RVHP is ensuring its preservation and improvement and creating conditions for its use.
The approval of a Contracting Party's National Etalon as an RVHP or its inclusion in the group Etalon system of the RVHP shall not affect the right of ownership of that Etalon.
The repeal of the national etalon approved as RVHP does not give the State-retained the right to suspend its use as RVHP until a decision has been taken by the Standing Commission on Standardisation Cooperation.
The ownership right of the Contracting Parties to the Etalon of the RVHP established on the basis of cooperation shall be laid down in the contract on its creation.
The Contracting Parties shall use RVHP etalons to agree on the values of units of physical quantities reproduced by the national statistics of the Member States of the RVHP and to transfer the values of these units to the default primary etalons in the absence of national etalons.
To this end, the Contracting Parties shall:
1. Comparison of national etalons with RVHP.
2. Mutual comparison of national etalones, which are part of the group etalone RVHP.
3. Attestation of initial secondary etalones using RVHP if there is no national etalon.
These work shall be carried out on the basis of the plans for comparison drawn up by the State-maintained RVHP etalon or by the State-coordinator of the RVHP group etalon in accordance with the Work Plan of the Standing Commission on Standardisation Cooperation.
In the absence of an Etalon of RVHP, or in the case of a temporary interruption of the function of the Etalon of RVHP, the Contracting Parties shall carry out a comparison of national etalons to agree the values of units of physical quantities.
These comparisons, if multilateral, shall be carried out according to the work plans of the Standing Committee on Standardisation.
The work referred to in Article XI and Article XII of this Agreement shall be carried out free of charge.
1. The costs of travel and residence of specialists in the State-retained RVHP etalon associated with the performance of the work referred to in Articles XI and XII of this Agreement shall be borne by the Contracting Party which has seconded the specialists.
2. Where work is carried out which requires equivalent costs from each of the parties concerned, the stay of specialists may, in agreement between the parties, be effected on the basis of exchange-free.
The unplanned comparison of the national etalones of the Contracting Parties with the RVHP etalon, as well as the testing of secondary etalones using the RVHP etalon, shall take place at the request of the Contracting Parties concerned on the basis of an arrangement with the State-retained party of the RVHP etalon, including an agreement on the financing conditions of those works.
The costs associated with the conservation and improvement of RVHP etalons, as well as their comparison with those of the International Office of Weights and Measurements and national etalons of States not participating in this Agreement, shall be borne by the States-keepers of RVHP etalones.
This also applies to costs associated with the formation of RVHP etalons in accordance with point 2 of Article IV of this Agreement on the basis of co-operation, unless otherwise specified in the contract on its creation.
A Contracting Party may declare that it does not apply individual RVHP ethalons. In the event of subsequent use of these RVHP etalons, it shall inform the other Contracting Parties in writing.
1. The State-Maintainer (State-Coordinator) sends a report on the state of the RVHP to the Contracting Parties every 3 years.
2. The State-keeper of the RVHP etalon shall inform the Contracting Parties within a two-month period of time of defects in the work of the RVHP etalon reducing its accuracy and of the measures taken to restore it, as well as of the non-eligibility of the RVHP etalon function for technical reasons and the need for its abolition.
In order to carry out the work on basic and applied research and the management of scientific and technical tasks for the creation of RVHP etalones, as well as the work related to their preservation, use and improvement of the Parties other than those provided for in Article IV, they may use other forms of cooperation foreseen by the "Organisational, Economic and Legal Basis of Scientific and Technical Cooperation of the RVHP Member States and the activities of the RVHP bodies in this field ', approved by the RVHP Executive Committee.
The legal protection and use of inventions, industrial utility models and trade marks are governed by the Treaty of 12 April 1973 on the legal protection of inventions, industrial designs, utility models and trade marks when carrying out economic and scientific and technological cooperation.
In cases not covered by the above Treaty, legal protection matters shall be dealt with in agreement between the Contracting Parties.
This Agreement shall not affect the rights and obligations arising from other international agreements concluded by the Parties.
This Agreement shall be submitted to the Secretariat of the Mutual Economic Assistance Council, which shall act as depositary of this Agreement. The depositary shall send certified copies of this Agreement to all Contracting Parties and inform them of all notifications and declarations received.
This Agreement shall enter into force between the Contracting Parties signing it without reservation of approval, 90 days after its signature.
For Contracting Parties which sign this Agreement subject to additional approval, the Agreement shall enter into force 90 days after notification by the depositary of the Agreement's approval.
This Agreement may be supplemented or amended with the consent of all Contracting Parties. Applications for additions and amendments shall be sent to the depositary. The amendments and amendments shall be adapted by a Protocol which shall take effect in accordance with the provisions of Article XXIII of this Agreement.
Disputes which would arise in connection with the implementation of the Agreement shall be settled in agreement between the authorised representatives of the Contracting Parties.
This Agreement shall be concluded for an unlimited period.
Each Contracting Party may withdraw from this Agreement if it notifies the depositary.
Withdrawal from the Agreement shall take effect 12 months from the date of receipt by the depositary of such notification.
Withdrawal from the Agreement shall not affect the obligations of the Contracting Parties arising from agreements and contracts (contracts) concluded by them to implement this Agreement between the Contracting Parties or the competent authorities or organisations of their States.
This Agreement may be acceded to by other Parties, with the agreement of the Contracting Parties, by sending a written request to the depositary of the Agreement.
The accession shall take effect on the day on which the depositary has received its consent from all Contracting Parties.

Declaration by the GDR on Article X, paragraph 3
Cooperation agreements for the creation and use of etalons of the Council of Economic Assistance
The GDR declares that, when implementing Article X, paragraph 3, it will follow the principle that the Etalon of RVHP is the property of the Contracting Party which will cover all the costs of its creation. In this context, the necessary valuation financial settlement and payments arising between the parties involved in the operation shall be made in accordance with the applicable decisions of the Council institutions on this matter.

The RSR Party declares that the Agreement shall take effect 90 days after notification to the depositary of the Agreement's approval by the competent authorities of the RSR.
