Ministry of Agriculture, Forestry and Water Management
of 3 September 1960
on State Water Control
The Ministry of Agriculture, Forestry and Water Management, in agreement with the participating central authorities, provides, pursuant to § 38 (2) of Act No. 11 / 1955 Coll., on Water Management, as amended by Act No. 12 / 1959 Coll. and according to the Government Resolution of 10 August 1960 No. 740:
Purpose of the Order
The development of industrial and agricultural production requires strict efficiency in water use throughout the country. A State Water Inspection is hereby established to deepen water management and water protection.
Authorities of the State Water Inspection
(1) The national water inspection as a control body of the Central Water Management Agency is of national scope. It is headed by the Chief Inspector; its representative in Slovakia is the Regional Inspector.
(2) The Chief and Regional Inspector is appointed and dismissed by the Minister-General for Water Management; appoint a regional inspector on a proposal from the Commission President of the Slovak National Water Council.
(3) The State Water Inspection works with the Commission of the Slovak National Water Management Council. The President of the Commission may instruct the Regional Inspector in serious cases requiring urgent solutions in Slovakia. The Regional Inspector shall inform the Chief Inspector of these instructions and their fulfilment.
(4) The State Water Inspection Authority shall exercise its responsibility as inspectors. Its more detailed organisational arrangements, in particular the scope and scope of the inspectors, are governed by the status of state water inspection, *) approved by the Minister for Water Management.
Tasks of the State Water Inspection
(1) The authorities of the State Water Inspection shall check the compliance and protection against pollution of water users, with the exception of households, with the provisions and measures for the efficient use of water. check in particular:
(a) compliance with the authorised water collection and its economical use in the special-purpose technology;
(b) planning and implementing technical and organisational measures for the efficient and economical use of water, including the creation, strengthening and compliance with standards for water consumption per production unit;
(c) the quantity and quality of waste water;
(d) compliance with the plan for the construction of waste water treatment plants;
(e) the operation and maintenance of waste water treatment plants;
(f) the implementation and compliance with measures in the production technology to reduce and reduce the defect of waste water.
(2) In particular, the authorities of the State Water Inspection in the exercise of their control activities are assisting the management of the organisations and their personnel and cooperating in increasing their professional qualifications.
(3) The authorities of the State Water Inspection may impose the necessary measures on controlled organisations in order to address the deficiencies identified and set deadlines for their implementation.
Participation of workers
Authorities State water inspections are required to carry out control activities in close cooperation with workers and their organisations, in particular the authorities of the Revolutionary Trade Union Movement. In carrying out their activities, the authorities of the State Water Inspection shall rely on the initiative of the workers, make use of the knowledge of their comments and complaints, involve them in the control of the efficient use of water and in the protection against pollution, as well as in the control of the measures imposed to address the deficiencies identified, and shall create other conditions for the effective linking of bottom control to top control.
Cooperation with national committees
(1) The authorities of the State Water Control shall cooperate closely with the national committees, in particular on the basis of an efficient division of control activities and shall provide technical assistance to the national committees, their committees and other bodies.
(2) The authorities of the State Water Inspection Office, if they themselves are unable to take measures, pursuant to Paragraph 3 (3), to remedy the defects and deficiencies which they discover in the performance of their tasks, are obliged to notify them to the water authority of the National Committee, which is, where appropriate, competent to take the necessary measures. At the same time, depending on the nature of the case, they shall propose the measures necessary to remedy, amend or supplement the water management decisions and, where appropriate, impose property sanctions in accordance with the relevant provisions. The national committee authority shall communicate its decision to the State Water Inspection Authority.
(3) The coordination of the inspection activities of the State Water Inspection and the authorities of the National Committees is ensured in particular by the plans of the State Water Inspection Activities discussed with the authorities of the National Committees.
(4) The authorities of the State Water Inspection Authority are obliged to implement without delay the measures imposed on them by the Chairman of the Regional National Committee in serious cases requiring urgent solutions. These measures and their fulfilment must be promptly communicated to the Regional Inspector in Slovakia.
Cooperation with other authorities
In carrying out its tasks The State Water Inspection works closely with the sanitary and anti-epidemic services and with the competent authorities of the State Nature Protection. Where measures affecting hygiene and anti-epidemic care are taken, the authorities of the State Water Control are required to act in accordance with the measures ordered by the authorities of the sanitary and anti-epidemic services and to request a binding assessment of those authorities before their decision or measure.
Authorisation of control authorities
(1) Organisations subject to control are required to cooperate with the authorities of the State Water Control in the verification of their facilities and, on request, to provide them with all the assistance necessary for the performance of their tasks, in particular to communicate the data and to provide the documents they need to carry out their activities.
(2) At any time, the authorities of the State Water Inspection Authority have the right to access water meters, where appropriate other measuring and control equipment, water works and equipment, in particular waste water treatment facilities, as well as production technological equipment.
Confidentiality obligation
Authorities State water inspections are required to maintain the state, economic and professional secrets which they learn in the performance of their duties. This obligation to remain silent shall continue after termination of employment.
Investigation of special mission objects
In the buildings of military administration and armed forces of the Ministry of Interior, the authorities implement State water inspection inspection inspection according to special regulations issued by the Ministry of Agriculture, Forestry and Water in agreement with the Ministry of National Defence and Interior.
Efficacy
This decree shall take effect from the date of its publication.
