on certain measures in matters of confiscated patents.
The National Assembly of the Czechoslovak Republic decided on the following Act:
(1) Time limits for the payment of annual fees (Section 114 of the Patent Act) for patents confiscated by the President of the Republic of 21 June 1945, No 12 Coll., on the confiscation and accelerated distribution of the agricultural property of Germans, Hungarians, as well as traitors and enemies of the Czech and Slovak people, by Decree of the Slovak National Council of 23 August 1945, No 104 Coll. on the confiscation and accelerated distribution of the agricultural property of Germans, Hungarians, as well as traitors and enemies of the Slovak people, as amended by the regulations, or by the decree of the President of the Republic of 25 October 1945, No 108 Coll., on the confiscation of enemy assets and National Recovery Funds, as amended and supplemented by the regulations (hereinafter referred to as "the Confiscated patents") shall be extended until 6 months after the date,
(a) the patent has been allocated;
(b) a national enterprise has been established by virtue of the substance of the patent;
(c) the patent has been incorporated into a national undertaking; or
(d) the patent has been transferred to the property of an undertaking for foreign trade or international dispatch;
for patents dealt with by one of the methods referred to in points (a) to (d) before the entry into force of this Act, until 6 months after the date of its entry into force, but at most until the expiry of the patent protection period in accordance with the relevant provisions.
(2) If, with a confiscated patent for which annual fees due have not been paid, one of the methods referred to in paragraph 1 (a) to (d) is not dealt with by the date on which its protection period under the relevant provisions expires, it shall expire on the date of expiry.
This Law shall take effect on 28 February 1949; It shall be implemented by the Minister of Industry in agreement with the participating members of the Government.
