of 10 May 2023
on the adjustment of compensation for loss of earnings following the cessation of incapacity for work or invalidity resulting from an occupational accident or occupational disease of soldiers in the exercise of military essential or substitute service and military exercises, the adjustment of compensation for loss of salary after the cessation of incapacity for service or invalidity resulting from an occupational accident or illness and the adjustment of the reimbursement of maintenance costs of survivors (regulation on compensation to soldiers and survivors)
The Government orders pursuant to § 127 (3) of Act No. 221 / 1999 Coll., on Professional Soldiers, as amended by Act No. 272 / 2009 Coll. and Act No. 332 / 2014 Coll.:
§ 1
Compensation for loss of earnings following the cessation of incapacity for work or recognition of invalidity resulting from an accident or occupational disease, compensation for loss of salary after the cessation of incapacity for service or recognition of invalidity resulting from an accident or occupational disease and reimbursement of the cost of maintenance of survivors (hereinafter referred to as "compensation ') belonging to a soldier or survivors under another legislation, shall be adjusted to provide that the average earnings applicable to the calculation of compensation, possibly increased under the implementing legislation on compensation to soldiers and survivors issued for the implementation of Act No. 221 / 1999 Coll., on professional soldiers, and Act No. 220 / 1999 Coll., on the course of basic or alternate service and military exercises and on certain legal changes of soldiers in advance payments, shall be increased by 2,3% and 400 CZK.
§ 2
The adjustment of the compensation provided for in Article 1 shall be for soldiers or survivors from 1 June 2023, provided that a soldier or survivors has been entitled before 1 June 2023.
§ 3
The compensation to which a soldier or survivors are entitled after 1 June 2023 shall not be adjusted in accordance with Paragraph 1.
§ 4
The compensation shall be adjusted without the request of a soldier or survivors; it shall be made on request in cases where the reimbursement was not solely due to an increase in the invalidity pension under social security legislation or pension insurance.
§ 5
Efficacy
This Regulation shall enter into force on 1 June 2023.
