DECLARATION
of 20 April 2012
determining the extent of the price bill by type of service
Pursuant to Section 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and amending certain related laws (Act on Electronic Communications), as amended by Act No. 468 / 2011 Coll., the Czech Telecommunications Authority provides for the implementation of Section 64 (13) of the Electronic Communications Act:
Formats for charging price by type of service
The price accounting by type of service (hereinafter referred to as "billing ') submitted by an entrepreneur providing a publicly available electronic communications service (hereinafter referred to as" provider') to a participant shall include the particulars of:
(a) a telephone number, if allocated for the type of service concerned;
(b) an indication of the agreed price plan;
(c) the definition of the settlement period on the date of the first and last day of the settlement period;
(d) an indication of the time at which the status of the provider's recording equipment was taken over on the last day of the settlement period, unless the status was taken over at 24.00 hours;
(e) a breakdown of the different types of electronic communications services provided by each item of the price list in force with these particulars
1. the verbal description of the type of service provided,
2. number of specified measurement units;
3. the number of connections made in the case of a service where the unit of measurement is time,
4. total price for the type of service provided in Czech crowns,
5. the rate of value added tax,
(f) the number of available and used spare units, if provided, and the information on the transfer of the number of spare units from the previous or subsequent settlement period, if transferred;
(g) settlement of advances, overpayments or arrears;
(h) the total amount to be paid in Czech crowns, by indicating the total amount excluding value added tax, value added tax and the total amount with value added tax;
(i) the date of payment of the amount charged;
(j) information on the way in which the claim is applied, including an indication of where and within which time limits the claim can be applied.
(1) The bill must comply with the requirements of the tax document under the Value Added Tax Act.
(2) If the bill is issued to more than one connection or participant station, it shall include a breakdown of the items referred to in § 1 (a) to (f) for each of these connections or participating stations. Similarly, if multiple telephone numbers are used for one connection or a participating station, it shall be done.
Efficacy
This Decree shall take effect on 1 June 2012.
