Federal Ministry of the Interior
of 20 October 1983
on security of property in socialist social property
The Federal Ministry of Interior provides, pursuant to Section 50 of Act No. 40 / 1974 Coll., on the National Security Corps:
BACKGROUND PRINCIPLES
Preliminary provisions
(1) Institutions and organisations (hereinafter referred to as "organisations") carry out surveillance of assets in socialist social property (1) (hereinafter referred to as "assets")
(a) security personnel;
(b) by mechanical means;
(c) security equipment;
where appropriate, a combination of these types of surveillance.
(2) The organisations shall issue, in accordance with this Decree and the standard Directives for the surveillance of property issued by the central authorities of the federations and Republics, internal Directives for the surveillance of property in which they lay down, by type of surveillance, in particular:
(a) the scope of the security of the property;
(b) regime, technical or technical measures (2) for the protection of property;
(c) means of surveillance of property by security personnel, 3)
(d) the duties of security personnel;
(e) organisation, equipment and equipment of security personnel, 4)
(f) method of handling, transport and storage of cash and other values, 5)
(g) limits on cash and other values for the carriage of which motor vehicles, escorts and safety baggage are used, 6)
(h) cases where a member of the racing guard is entitled to inspect persons (Section 9 (1));
(ch) the place where persons will be shown [§ 8 (1) (e)].
(3) If the security of the building is involved by the Department of National Security (SNB) or the Czechoslovak People's Army, the method of security of the building shall be determined by these departments, the duties of the members of the SNB or the Czechoslovak People's Army and their equipment and equipment by the competent chief or commander in agreement with the head of the organisation.
Security personnel
Security officers are
(a) members of the racing guard;
(b) guards and concierge,
(c) security staff. 7)
Personal assumptions of security personnel
Only an upstanding person older than 18 years of age who is physically, mentally and professionally competent to perform specified duties and authorisations may be a security guard.
Designation and demonstration of security personnel
(1) In case of security of property, the security officer shall be identified externally.
(2) The external marking of the member of the racing guard, guard, doorman or guard is a red-colour sleeve with a width of 100 mm, marked "ZS," "TRADER," "BACK" or "HLS" in yellow, with a height of 60 mm and a width of 15 mm. This tape shall be worn on the left back-up and shall bear the stamp of the organisation in respect of which the security officer is working or working.
(3) Upon request of the persons against whom he is acting, the security officer shall be proved (8) if the circumstances of the case so permit,
(a) a licence issued by a member of the racing guard (Annex 1),
(b) by a card issued by an organisation with which the guard or the doorman is in a working or Member proportion;
(c) a document of the guard worker (Annex 2).
Basic tasks of security staff
(1) Security staff to the extent provided for by the internal Directives on the surveillance of property in particular:
(a) prevent:
1. theft, loss, abuse, damage and destruction of property,
2. unauthorised entry of persons or unauthorised entry of means of transport into the organisation's premises, 9)
(b) they control persons and means of transport leaving the organisation's premises, in particular to determine whether the property of which the organisation carries out its surveillance is unduly disposed of or exported;
(c) carry out the tasks resulting from the fire protection regulations of the organisation.
(2) The members of the racing guard shall guard, to the extent provided for by the internal directives for the surveillance of property, cash and other values during transport.
(3) In the security of property, security personnel shall cooperate in particular with fire protection units and People's militia, if they are established in the organisation, with the local public security perimeter 10) (hereinafter referred to as the District Department of VB) or SNB or Czechoslovak People's Army, if any, if such departments are involved in the surveillance of the organisation's premises.
Money security in cash and other values during transport
(1) Cash and other values are transported only by means and routes designated by the head of the organisation or by its authorised official.
(2) Prior to the transfer of cash and other values above 10 million Kčs, the head of the organisation or his authorised staff shall request cooperation from the local district administration of the SNB. 11)
(3) The security of money in cash and other values during transport can be contracted by a racing guard set up with another organisation.
Security of security staff
(1) The staff of the surveillance service shall guard the property to the extent and in the manner laid down by the economic agreement concluded between the organisation which has set up the surveillance service and the organisation for which the surveillance service shall carry out the surveillance of the property.
(2) The head of the organisation which has set up the surveillance service, or the authorised officer, shall ensure, in cooperation with the head of the organisation for which the surveillance service carries out the surveillance of the property, or by its authorised officer, the proper and verifiable familiarity of the staff of the surveillance service with their duties and privileges in the surveillance of the property and the regular training of such staff.
CORRECTION OF HEALTH WORKERS AND THEIR PROCEDURE IN RELATION TO SUCH CORRECTION
Approval of security personnel
(1) The security officer is authorised to protect property (12)
(a) to check persons entering or leaving the organisation's premises and their baggage and to require them to produce the relevant documents; 13)
(b) to check vehicles entering or leaving the premises of the organisation and their cargo and to request the presentation of relevant documents; (14) in cases specified by the head of the organisation, to prevent the continued driving of such vehicles;
(c) require in the premises of the organisation any necessary explanation of any suspected threat to property;
(d) in the object of the organisation invite anyone who
1. is suspected of unauthorised entry into, or residence in, this building in order to demonstrate its identity, the right to stay in, and, if it does not have such authority, to leave,
2. endangers the life or health of another or property, or violates the rules of socialist coexistence in order to refrain from doing so;
e) Demonstrate to a place designated by internal directives for the surveillance of the property of anyone in the organisation's premises
1. cannot prove its identity in a reliable manner;
2. causes damage to the health or death of another or damage to property;
3. Disobeys the calls referred to in point (d);
(f) withdraw the case where there is reasonable grounds for suspecting that it has been stolen or misused from the property of which the organisation carries out its surveillance;
(g) to ensure that the person shown is not armed and, if the weapon is found, to withdraw the weapon;
(h) call on everyone to avert damage to property. 15)
(2) A security guard shall be entitled, in the event of a threat to his property, to use the tactile and stunts of self-defence, the tear device, the baton (16) and the trained dog, to avert an attack on himself or another person, to overcome the resistance which seeks to thwart the performance of his tasks, as well as to prevent the escape of the demonstrated person.
Special authorisation of race guard members
(1) A member of a racing guard is entitled to inspect, in cases covered by the internal surveillance directives, the personnel of the organisation and other persons entering or leaving the organisation's premises in the designated area; only a person of the same sex may be examined.
(2) A member of the racing guard is entitled, in addition to the means referred to in § 8 (2) and under the conditions laid down therein, to use a gunshot strike, warnings and warning shot in the air.
A member of a racing guard may use firearms as an extreme device when guarding property in order to:
(a) in the event of a necessary defence, prevent an attack against or imminent attack on another person's life;
b) avert a dangerous attack that threatens a guarded object or site, following a futile call to abandon the attack;
(c) prevent the escape of a dangerous offender who cannot be otherwise detained;
(d) dispose of an animal which endangers the life or health of persons.
Security personnel procedure related to the use of their authorisation
(1) When using the authorisation referred to in Section 8 (1) (e), the security officer shall immediately notify the local competent district unit of VB and the head of the organisation or his authorised staff; continue to follow their instructions.
(2) Before using the funds referred to in Paragraph 8 (2), the security officer shall, if the circumstances of the case permit, use the arrangements, warnings or calls.
(3) When using the means referred to in § 8 (2) and § 9 (2), a security guard shall use the means which enable his duties to be carried out and, at the same time, as little as possible, harm the person against whom he acts. At the same time, it shall ensure that this device is used in a proportionate manner and that any damage is not manifestly disproportionate to the importance of the protected interest.
(4) In the case of an operation against an individual, a security guard may not use a tear-tear device, a baton, a trained dog, and a gunshot wound against a pregnant woman, a person of age, a person with an apparent physical defect or illness and a child, except where the nature of the attack carried out by that person against protected interests or the exceptional nature of the situation arising necessarily requires it.
(1) A member of the racing guard is obliged to use the means referred to in paragraphs 2 and 9 (2) of Section 8 before using a firearm, if the circumstances of the case permit.
(2) A member of a racing guard is obliged to:
(a) take care, in particular, not to endanger the lives of other persons, and to save as much as possible the life of the person against whom the use of the firearms is directed;
(b) provide the injured person, as soon as the circumstances of the case permit, with first aid or medical treatment;
(c) notify without delay any use of a firearm to the locally competent District Department of VB and to the Head of Organisation, and, until the arrival of the SNB members, provide background (17) for proper examination of the case.
(3) A member of a racing guard may not use firearms against the persons referred to in Article 11 (4) except in the cases listed therein.
(1) When using the means referred to in Articles 8 (2) and 9 (2) for the injury of a person, the security officer shall be obliged, as soon as the circumstances of the case permit,
(a) to provide emergency assistance to the injured person and, where appropriate, to provide medical treatment;
(b) notify this event to the local district department of VB and to the head of the organisation or his authorised staff. The security guard shall also inform the head of the organisation which has set up the security service or its authorised officer.
(2) The use of the authorisations referred to in Article 8 (1) (e), (f) and (g) and the means referred to in Article 8 (2), (9) (2) and (10) shall be made by the security officer in the daily report book; the alert shall include, in particular, an account of the course of the event, timing, personal data of interested parties, including witnesses, and measures taken after the use of such authorisations and means.
COMPETITIVENESS OF ORGANISATIONS WITH THE CONTRACTS OF THE SNB
Provision of methodological and technical assistance
(1) The Ministry of Interior of the Czech Socialist Republic and the Ministry of Interior of the Slovak Socialist Republic provide, at the request of the central authorities of the Federation and the Republic, methodological and professional assistance to these authorities in the elaboration of standard directives for the surveillance of property.
(2) Local district administration of SNB18) provides methodological and professional assistance to organisations in:
(a) the processing of internal directives for the surveillance of property;
(b) training of members of the racing guard in the shooting;
(c) training of the security character of security personnel;
(d) the choice of appropriate routes for transporting cash and other values;
(e) security of the object by mechanical means and security technology, including assessment of its project documentation and checks on their condition and effectiveness.
Control of security
(1) The local district administration of SNB18) checks that security personnel are guarding the organisation's premises in accordance with this decree.
(2) The organisation is required to communicate to the SNB service within 30 days of receipt of its notification of the deficiencies identified in the surveillance of the organisation's premises what measures it has taken to eliminate them.
Cooperation of organisations with SNB services
The organisation shall cooperate with the local district department of VB in preventing and detecting crime in the organisation's premises. 19)
FINAL PROVISIONS
Security of property according to special regulations
The provisions of this Order are without prejudice to the conduct of surveillance of property under specific regulations. 20)
Interpretation of certain terms
The explanations set out in the Annex to Regulation No 16 / 1974 of the Minister for the Interior of the Czechoslovak Socialist Republic on the means used by members of the National Security Corps in service operations shall apply mutatis mutandis to the interpretation of certain terms used in the previous parts. 21)
Repeal
The Ministry of National Security Order No 66 / 1953 Ú. l. (No 98 / 1953 Ú. v.) on the tasks and responsibilities of the racing guard, as amended by Decree No 320 / 1953 Ú. l. (No 365 / 1953 Ú. v.) is hereby repealed.
Efficacy
This Decree shall take effect on 1 July 1984.

1) Paragraph 8 (2) of the Economic Code.
2) The scheme measure means a set of obligations and authorisations that have been provided by the organisation for persons in the organisation's premises or for persons accompanying the property transported outside the organisation's premises (e.g. definition of movement of persons and means of transport in the organisation's premises, entry or entry into the organisation's premises only for a licence or permit). Technical measures are the use of mechanical means of defence (e.g. fencing, bars, blinds and locks) or safety equipment (e.g. electrical signalling, electric fire alarm and industrial television) together with mechanical means of defence. Scheme technical measures means a combination of regime and technical measures.
3) The means of surveillance of the property of the security staff means, in particular, the conduct of security at a fixed post, a tour of the organization, the accompanying of the property transported, the operation of the security equipment, the intervention group, or possibly using trained dogs in one of these means of surveillance of the property.
4) Security workers' equipment means, for example, uniforms of race guards and guard workers.
5) Other values refer to e.g. foreign exchange means according to § 5 of Act No. 142 / 1970 Coll., on Foreign Exchange Economy, postage stamps, stamps, collection vouchers PZO Tuzex, cheques, objects of artistic value and jewelry.
(6) Safety luggage means specially designed luggage fitted with a lock mechanism and a device that sends a warning signal in the event of illegal withdrawal or tampering (e.g. BZ and BK series safety baggage).
7) Patrol personnel are employees of an organisation which contractually ensures the security of the assets of other organisations and has this subject of activity registered in the company register.
8) The procedure means the use of the authorisations referred to in § 8 (1) (e), (f) and (g) and the means referred to in § 8 (2), § 9 and 10.
9) The object of the organisation is also the land managed by the organisation.
10) The local competence of the Public Security District Department is governed by the location of the organisation's premises in the geographical area of this department. Public Security Circuits include the local Public Security Department in Prague and Bratislava.
11) When transporting cash and other values, the local jurisdiction of the district administration of the SNB shall be governed by the location of the facility from which the cash and other values are transported in the territorial district of this department. The district management of the SNB also means the district administration of the SNB in Prague and Bratislava and the city administration of the SNB in Pilsen, Brno, Ostrava and Košice.
12) In carrying out security of property, the security officer shall be a public official.
13) For example, a card or permit authorising a person to enter an organisation's premises, a permit to issue a case of the property the organisation carries out surveillance on.
14) For example, permission to enter the vehicle into the organisation's object, driving order, statement of daily vehicle performance, delivery notes.
15) Paragraph 171 (2) of the Labour Code. Article 416 (1) and (2) of the Civil Code.
16) Only the tear forming device and baton listed in the uniform classification of industries and products may be used.
17) For example, to leave things unaltered, to provide appropriate evidence against their deterioration, to identify witnesses.
18) The local jurisdiction of the SNB district administration is governed by the location of the object in the territorial district of this department. The district management of the SNB also means the district administration of the SNB in Prague and Bratislava and the city administration of the SNB in Pilsen, Brno, Ostrava and Košice.
19) The obligation of organisations to notify offences and offences under specific regulations (Section 8 (1) of the Criminal Code) is without prejudice to this provision.
