Government Regulation
of 18 May 1948
on the remuneration of defenders in proceedings before special folk courts.
The Government of the Czechoslovak Republic hereby orders pursuant to the Act of 18 February 1921, No. 78 Coll., which authorises the Government to issue tariffs for the performance of lawyers and their offices:
A defendant chosen by the defendant or set up by an extraordinary People's Court of Procedure before that court shall be entitled to the remuneration of the defence under this Regulation.
(1) The defendants are remunerated for the defence according to the length of the hearing and the complexity of the case for each main trial of 200 to 800 Ccs. This remuneration includes the remuneration for preparation for the main trial and any written submissions.
(2) In cases of a very exceptional scale, a higher remuneration may be awarded.
(3) In addition to the remuneration, the lawyer shall be entitled to compensation for final editions if necessary.
(1) The amount of the defence fee and the amount of the compensation for final extradition shall be determined by the court, acting on a proposal from the lawyer, as a general rule immediately after the main hearing has been completed.
(2) The defendant shall be entitled to payment of the remuneration awarded and to reimbursement of the final issue from the Registry; the remuneration and compensation paid is part of the costs of criminal proceedings.
This Regulation shall enter into force on 2 April 1948; they shall be carried out by the Minister of Justice.
