GOVERNMENT REGULATION
of 15 May 2024
amending Government Regulation No 5 / 2023 Coll., on compensation for the supply of electricity and gas at specified prices, as amended
The Government orders pursuant to § 19f paragraph 8 (c) and (f) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 287 / 2022 Coll. and Act No. 469 / 2023 Coll.:
Government Decree No. 5 / 2023 Coll., on Compensation for Supply of Electricity and Gas at Fixed Prices, as amended by Government Decree No. 65 / 2023 Coll., Government Decree No. 77 / 2023 Coll. and Government Decree No. 272 / 2023 Coll., is amended as follows:
1. In Paragraph 1 (1), at the end of point (d), the word "a 'is replaced by a comma.
2. In Article 1, at the end of paragraph 1, the dot is replaced by "a 'and the following point (f) is added:
"(f) the range of data specified in the application for compensation for a specified period verified by the auditor and the scope of the audit.";
3. In Paragraph 14a (1), "31 May 'is replaced by" 28 June'.
4. In Article 14f (1), the word "third 'is replaced by" fourth' and the words "1 December 2024 to 15 January 2025 'are replaced by the words" 15 January 2025 to 15 February 2025'.
5. The following Sections 14h to 14j are inserted after Section 14g, including the headings and footnotes No 2:
Heading of the verified data in the claim for compensation
The auditor shall verify in the application for compensation for a specified period the accuracy of the amount of compensation for a specified period.
Scope of data verification
(1) The auditor shall verify the accuracy of the data referred to in Article 14h to the extent of the examination providing a limited assurance of the subject matter of verification in accordance with the international auditing standard governing verification contracts, which are neither an audit nor an examination of historical financial information2).
(2) When verifying the level of compensation for a specified period, the auditor shall also verify whether the electricity or gas trader has included in the list of electricity or gas supply data transmitted pursuant to Paragraph 14a (5) all customer demand points to which it supplied electricity or gas at a specified price.
(3) When verifying the accuracy of the calculation of the monthly compensation sub-bases for the sampling points and type B contracts, the auditor does not need to verify the accuracy of the calculation. Where the auditor is based on the calculation values communicated by the electricity or gas trader, he shall indicate this in the data verification report.
Verification of data in the new application for compensation
In order to verify the accuracy of the data provided by the electricity or gas trader in the new application for compensation submitted after the Energy Regulatory Authority has prohibited the payment of compensation for a specified period in accordance with the procedure laid down in Article 19f (5) of the Fourth Energy Act, paragraphs 14h and 14i shall apply mutatis mutandis.
2) International standard for verification contracts ISAE 3000 - Verification contracts which are neither an audit nor an examination of historical financial information. ';
Efficacy
This Regulation shall enter into force on the day following that of its publication.
