on the competence of the authorities of the Czech Socialist Republic in the field of prices
The Czech National Council decided on this law:
This law regulates the scope of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and other institutions of the Czech Socialist Republic in the field of prices.
(1) The Ministry of Finance, Prices and Wages of the Czech Socialist Republic, as the central body of the Czech Socialist Republic's state administration, shall exercise its competence in the field of prices, provided that they do not belong to other bodies or organisations under this Act or under special regulations (1).
(2) Ministry of Finance, Prices and Wages of the Czech Socialist Republic
(a) participate in the creation of a uniform state pricing policy of the Czechoslovak Socialist Republic and in ensuring its implementation in accordance with national economic plans;
(b) submit to the Government of the Czech Socialist Republic proposals for major price measures in sectors managed by the authorities of the Republic, as well as opinions on major price measures prepared by federal authorities;
(c) establish and alter the prices of products, services, performance, works (hereinafter referred to as "products") and real estate, or propose prices or changes thereto for approval by the Government of the Czech Socialist Republic in cases where the government reserves it;
d) coordinate and methodically manage the pricing and preparation and implementation of pricing measures with the authorities of the Czech Socialist Republic and the organisations managed by them.
(3) The Ministry of Finance, Prices and Wages of the Czech Socialist Republic processes and coordinates with the Federal Price Office and with the Committee of People's Control of the Czech Socialist Republic a plan for price control; coordinated, methodically managed and carried out price control in the territory of the Czech Socialist Republic, imposed corrective measures and additional charges and made further measures according to price or other regulations.
(4) The Ministry of Finance, Prices and Wages of the Czech Socialist Republic may, within the framework of its competence in pricing, entrust other bodies of the Czech Socialist Republic, the Central Council of Cooperatives, the Association of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic and, after prior agreement with them, organisations in their field of competence.
The Czech Commission for Planning and Scientific and Technological Development, in cooperation with the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, carries out analyses of the development and performance of prices for the planning of price developments, elaborates guidelines for the development of the Czech Socialist Republic's Price Development Plan and the draft Price Development Plan as part of the Czech Socialist Republic's State Plan.
(1) The Central Authorities of the Czech Socialist Republic, the Central Council of Cooperatives, the associations of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic submit as organisations in their field of competence
(a) to the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, proposals for price measures, supporting documents set out to ensure price measures, including the necessary analyses and justifications and price control plans, as well as reports on their implementation;
b) Czech Commission for Planning and Scientific and Technological Development proposals for the Price Development Plan.
(2) The Central Authorities of the Czech Socialist Republic, the Central Council of Cooperatives, the associations of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic ensure in organisations in their area of competence the implementation of price control, impose additional charges on them and take other measures according to specific regulations.
(3) The Regional National Committees and the National Committee of the City of Prague shall submit to the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and to the Czech Commission for Planning and Scientific and Technological Development the documents referred to in paragraph 1 for organisations and installations managed or managed by national committees and for state-owned enterprises set up by national committees (hereinafter referred to as "organisations within the competence of national committees") as well as for national committees of lower degrees.
(4) The Regional National Committees and the National Committee of the City of Prague set and changes the prices of products
(a) organisations within the competence of national committees and small establishments of national committees,
(b) non-agricultural production of agricultural organisations under the responsibility of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic;
(c) cooperative organisations, except consumer cooperatives;
(d) social organisations;
(e) supplied by citizens,
except in the case of prices whose determination and change is the responsibility of other bodies under the special regulations (1), or whose determination and changes are reserved by the Ministry of Finance, Prices and Wages of the Czech Socialist Republic.
(5) The Regional National Committees and the National Committee of the City of Prague shall provide for additional charges in the organisations referred to in paragraph 4, in small establishments of the National Committees and in the case of citizens supplying products for the performance of price checks, and shall impose additional charges on them and take other measures in accordance with specific rules.
(6) The Regional National Committees and the National Committee of the City of Prague may be entrusted with:
(a) the exercise of their powers under paragraphs 4 and 5 of the national committees of lower degrees;
(b) the exercise of its powers under paragraph 4, by prior agreement, of other bodies of the Czech Socialist Republic and of their controlled or established organisations.
(7) The Regional Financial Administration and the Financial Administration in the capital city of Prague carry out price checks for organisations within their respective areas of competence. On the basis of the results of the check, they impose additional levies and take other measures in accordance with specific rules. Under the authority of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, the Regional Financial Administration and the Financial Administration in the capital city of Prague participate in price checks carried out by another financial administration.
(1) Workers of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, or any other body carrying out price controls under this Act, who have been entrusted with price control, are entitled to exercise control activities, unless otherwise provided for in specific regulations (2),
(a) enter all areas of the organisation;
(b) require the staff of the institutions and organisations to establish the conditions necessary for the performance of price controls;
(c) require cooperation between other control authorities and, where appropriate, other professionals, with the exception of the authorities and personnel of the people's control.
(2) The authorities, organisations and their staff are required, at the request of the Ministry of Finance, the prices and wages of the Czech Socialist Republic, or any other body carrying out price controls under this Act, or their authorised personnel, to provide the necessary supporting documents for the performance of the price check, to provide timely and complete oral and written information and explanatory notes, without delay to remedy the deficiencies identified and to report on the implementation of the measures taken within the time limits set in the conclusions of the price check.
(3) The Ministry of Finance, Prices and Wages of the Czech Socialist Republic, or any other body carrying out price controls under this Act, may impose on controlled bodies and organisations to establish within the agreed time limits the full extent of the breach of price regulations and to quantify the funds unduly obtained in a controlled organisation and, where appropriate, in subordinate organisations, according to the control findings.
The Ministry of Finance, Prices and Wages of the Czech Socialist Republic issues, in cooperation with the central authorities involved, the necessary generally binding legislation, in which it will further regulate the process of institutions and organisations in the production and control of prices, the competence of central government bodies and the tasks of other bodies and organisations.
They are repealed with effect from the Czech Socialist Republic:
1. the provisions of Sections 18 and 19 of Act No. 53 / 1968 Coll., on Changes in the Organisation and Scope of Certain Central Authorities,
2. the provisions of Sections 33 to 35 and 46 to 49 of the Decree of the State Commission on Finance, Prices and Wages No. 47 / 1967 Coll., on Prices, as amended by the Order of the Czech Price Office No. 74 / 1969 Coll., in so far as they govern the competence of the authorities of the Czech Socialist Republic and the national committees in the field of prices,
3. item 44 of Annex C to the Act of the Czech National Council No. 146 / 1971 Coll., amending and supplementing the Act on National Committees and regulating the competence of national committees in certain sections of government.
This Law shall take effect on 1 January 1974.
