Decree of the Central Council of Trade Unions on Releasing Workers from Employment to Function in the Revolutionary Trade Union Movement

Central Trade Union Councils
of 17 September 1968
on the release of workers from employment to serve in the Revolutionary Trade Union Movement
The Central Council of Trade Unions pursuant to the provisions of § 124 (4) of the Labour Code No. 65 / 1965 Coll., § 1 of Act No. 37 / 1959 Coll., on the status of the racing committees of the basic organizations of the Revolutionary Trade Union Movement and pursuant to Article 11, 12 and 25 of Resolution IV of the All-Trade Union Convention on the Racing Committees of the Revolutionary Trade Union Movement with amendments and additions made by the Resolution of the National Trade Union Conference in May 1965 provides:
§ 1
(1) Functions in the Revolutionary Trade Union Movement are honorary and are carried out fundamentally outside of working hours.
(2) Where the nature, urgency or scope of the tasks arising from the activities of the Revolutionary Trade Union Movement organisation or its establishment (hereinafter referred to as the "basic organisation ') or from the activities of a higher trade union body so require, the function may be performed at working time. In such a case, the management of the plant shall provide the officials with leave of absence on the basis of a resolution of the member meeting or conference of the basic organisation or on the basis of a decision or initiative of the trade union.
§ 2
(1) The management of the plant will provide the worker with leave of absence to perform his duties in the Revolutionary Trade Union Movement:
(a) in the short term, on a case-by-case basis, for the period strictly necessary by decision of the company committee ROH or the race committee of the basic organisation or local committee of ROH or, where appropriate, by a race confidant (hereinafter referred to as the "race committee") or by decision or initiative of the higher trade union body;
(b) in the long term, for a predetermined working day of the week, or for a part thereof, for the whole or part of the term of office, on the basis of a resolution of the member meeting or conference of the basic organisation.
(2) If required by the scope of the activity of the basic organisation, the management of the plant shall, on the basis of a resolution of the race committee, provide the worker with the necessary short-term or long-term leave to carry out the administrative technical activities of the basic organisation.
(3) The management of the plant shall, in respect of workers so released, fulfil all obligations arising from labour law, sickness insurance, pension insurance, payroll tax, etc., unless otherwise provided by the trade union.
§ 3
In the short term, the management of the plant will provide the worker with a wage compensation equivalent to his average earnings. The trade union on whose decision or initiative the worker has been released shall pay the compensation paid to that worker by the management of the plant. The obligation to pay shall be waived where specific provisions so provide or where the worker made redundant himself or his co-workers replace the work he has missed without increasing the personnel costs or, where appropriate, if he has taken action directly related to the tasks of the plant.
§ 4
(1) The management of the plant will provide a long-term worker with no compensation. A member's meeting or conference of the basic organisation shall determine the remuneration of the worker so released instead of the salary, at least at the rate of his average earnings before release.
(2) The remuneration granted by the trade union organisation from its own resources is paid by the plant at normal pay dates. The management of the plant shall account for the payroll tax with the National Committee State Finance Department; the relevant sickness insurance benefits shall be provided and settled in the same way as for the other workers of the establishment.
(3) If the worker who was released was entitled to severance payments and similar compensation, he shall also be provided by the race committee for the duration of the release, provided that the conditions for their payment remain.
§ 5
The Order of the Central Council of Trade Unions No 93 / 1966 Coll., which publishes directives on the release of workers from employment to serve in the Revolutionary Trade Union Movement, is hereby repealed.
§ 6
This decree shall take effect on the day of its publication.
