Regulation establishing the Organisational Regulations of the State Health Institute

Regulation of the Minister for Health
of 21 May 1949
laying down the rules of organisation of the State Health Institute.
The Minister of Health hereby orders pursuant to Article 6 of the Act of 23 February 1949, No. 70 Coll., on the State Health Institute:
(1) The State Health Institute (hereinafter referred to as the Institute) is under the authority of the Ministry of Health.
(2) The Institute exercises its competence (§ 2, paragraph 1 of Act No. 70 / 1949 Coll. - hereinafter referred to as "the Act") by the Main Institute in Prague, the Regional Institute for Slovakia in Bratislava and branches.
(1) The main institute and regional institute are subdivided into the following departments:
I. the Department of Environmental Research and Control, which carries out research and control of drinking, mineral, surface and waste water, air and soil research and control and personal, housing, school, industrial and social hygiene,
II. the Department for the Exploration of Nutrition, Consumption and Objects of Need, which carries out biological research on Nutrition and Consumption, Research on Objects of Need, Research on Consumption, Objects of Need and Replacement, Development, Selection and Review of Methods for the Food Code of Czechoslovak and Microbiological, Histological and Serological Examination of Food of Animal Origin,
The III Department of Microbiology and Epidemiology, which carries out microbiological research with regard to infectious diseases, bacteriological-serological and parasitological diagnostics, epidemiology, health statistics, diagnostics and research into viral diseases, bacteriological diagnostics and tuberculus research, blood heritage research, manufacture of products for microbiological diagnostics and biochemical research of micro-organisms,
IV. Department for the examination of medicinal products, which carries out the control and examination of medicinal products, medicinal products, therapeutic and diagnostic devices, their substitutes, foreign-exchange preparations and control methods by chemical, pharmacological and biological means,
V. the Department for Health Education and Training, which takes care of both the education and training of doctors and other health professionals, and is involved in the public health sector.
(2) Branches shall have one or more of the trade unions referred to in paragraph 1.
(3) Unions are, on a professional basis, independent labour units. The branch departments are managed on a professional basis in the Czech countries by the relevant departments of the Central Institute, in Slovakia by the Regional Institute.
(1) The departments are subdivided into departments consisting of laboratories as basic labour units.
(2) The department shall establish, merge or abolish, according to the working needs of the department concerned, after hearing the heads of its department in agreement with the head of the principal, the regional institute and with the agreement of the Ministry of Health.
(3) Laboratories shall establish, combine or abolish, on a proposal from the heads of the department, in agreement with the Chief Executive, after the case of the Regional Institute.
(1) The personal and service office of all employees is the main (regional) institution. The appointment of staff not reserved for the President of the Republic or the Government shall be the responsibility of the Director of the Central Institute (Regional Institute), subject to the prior approval of the Minister for Health.
(2) General regulations shall apply to the staff of the Institute.
(3) Experts (experts) may be appointed on a proposal from the Advisory Council and with the consent of the Ministry of Health for the provision of certain professional work for which the Institute does not have permanent staff.
(1) The Central Institute and Regional Institute are administered (§ 4 (3) of the Act) and, within the limits of their competence, the Directors with medical education are represented.
(2) In the event of the employment of the Director (sickness, leave and so on), he is represented by the oldest head of the Department.
(3) The directors shall ensure the proper and uninterrupted operation of the Institute on the administrative and economic side, the maintenance and replenishment of the constitutional premises, equipment and operational needs, the preservation of constitutional assets, order and discipline, the effective cooperation of all the components of the Institute and the efficient use of the Institute's instruments and equipment. The directors shall provide the Ministry of Health with regular quarterly reports on the functioning of the Institute and exceptional reports at the invitation.
(4) The Director of the Main Institute shall be subject to the staff of the Main Institute and branches in the Czech countries, the Director of the Regional Institute, and the employees of the Regional Institute in Slovakia.
(5) The directors shall, by mutual agreement, draw up and submit to the Ministry of Health a proposal for the Institute's annual budget and supervise the maintenance of budgetary credits.
(6) The directors shall, by mutual agreement, submit to the Ministry of Health proposals for working arrangements for the various sectors of activity and administration of the Institute.
(7) The Director of the Main Institute shall be in constant contact with the Director of the Regional Institute and shall ensure that common action is maintained in administrative and economic matters. If, in view of the special circumstances of the regional constitution and branches in Slovakia, deviations would be necessary, the Ministry of Health will decide after hearing both directors.
(8) The management of branches is provided by the head of the branch department, which will be entrusted by the Minister for Health, on a proposal from the Director of the Main Institute (Regional Institute) and which is then subordinate to the Director of the Main Institute (Regional Institute). The provisions of paragraphs 1 to 5 shall apply mutatis mutandis, with quarterly and extraordinary reports and draft annual budgets being submitted to the Director of the Central (Regional) Institute.
(1) The Director of the Central Institute shall convene, as necessary, an Advisory Board to discuss serious issues relating to the administration of the whole Institute, which shall consist of representatives of trade unions and representatives of staff organisations of the Central and Regional Institute.
(2) The Director of the Central (Regional) Institute shall convene, as appropriate, in particular to discuss serious issues relating to the administration of several departments of the Main (Regional) Institute, an Advisory Board consisting of the priority of all departments of the Main (Regional) Institute and representatives of its staff organisations.
(3) The Director who shall convene the College may also invite experts and senior officials to the meeting; The Board shall be convened in advance by the Ministry of Health.
(1) Each section is headed by a preschool with a higher education and, as far as possible, with the qualifications of a higher education teacher.
(2) The priority trade unions of the main (regional) institute manage the scientific, professional and educational work of their department and of the relevant trade unions of branches separately and are directly subordinate to the Ministry of Health, to which quarterly written reports on the activities of the department are submitted and exceptional reports are also invited.
(3) A priority of the branch department is provided by the Minister for Health on a proposal from the relevant department of the main (regional) institution.
(4) In the field of economic and administrative administration, trade union leaders are subordinate to the Director of the Central (Regional) Institute.
(5) Whenever a professional task is to be dealt with, in excess of the normal activity, the trade unions of the main institute may convene and invite other staff to attend meetings of the trade unions and departments concerned. The draft resolutions of the meeting shall also be submitted to the Ministry of Health by a representative of the department which convened the meeting.
(1) The head of each department is a preschool with a higher education, which is set by the Ministry of Health on a proposal from the Heads of State Department. The Head of the Department shall direct and act in accordance with the instructions and guidelines of the Department of Science, Vocational and Educational Works.
(2) On a proposal from the Head of the Laboratory, the Heads of the Department shall appoint a representative of the Department. It provides the professional and educational work of a particular lower working section for the management of the department leader to whom it is subordinate.
The Institute and its components shall be managed in accordance with the approved budget of the Institute and the provisions of the relevant budgetary act and the implementing rules issued.
(1) Where it is in the public interest to use the professional experience of the Institute as well as at universities, the Institute shall communicate the results of its work to the competent university experts and require them to report to each other for the same purpose.
(2) If this is not to the detriment of the performance of his duties, the Institute shall, at the request of universities, provide the university staff with the necessary material for scientific research and teaching purposes and allow the university listeners to be hospitalised at the Institute.
The Ministry of Health shall, according to the needs of a single health policy, with the participation of trade unions and directors of the Central and Regional Institute, plan the work programme of the Institute and supervise its implementation, coordinate and direct the activities of all the components of the Institute in such a way as to guarantee working and organisational unity, and supervise the administration and management of the Institute. To this end, in particular:
(a) issue guidelines, guidelines and working arrangements for professional activities and for the administration of the Institute;
(b) convene meetings of trade union heads and directors of the Institute of Central and Regional at any time, but at least twice a year;
(c) take part, as appropriate, in the deliberations of trade union heads (§ 7 (5) and Advisory Council (§ 6),
(d) take appropriate measures to ensure that effective proposals made by the various components or departments of the Institute are implemented and that the experience resulting from the reports of trade union heads and directors is used throughout the Institute;
(e) approve the Institute's budget.
This Regulation shall enter into force on the day of its publication.
