amending Decree No. 82 / 2012 Coll., on the carrying out of in-service technical checks on vehicles and combination vehicles (Decree on technical roadside checks)
The Ministry of Transport provides, pursuant to Section 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 230 / 2014 Coll., Act No. 249 / 2014 Coll., Act No. 48 / 2016 Coll., Act No. 233 / 2013 Coll., Act No. 233 / 2013 Coll., Act No. 230 / 2014 Coll., Act No. 249 / 2014 Coll., Act No. 48 / 2016 Coll., and Act No. 48 / 2016 Coll.
Decree No. 82 / 2012 Coll., on the carrying out of checks on the technical condition of vehicles and combination vehicles in use on the road (Technical Road Control Order) is amended as follows:
1. In Section 1, at the end of point (b), the word "a 'is replaced by a comma.
2. In Paragraph 1, at the end of point (c), the dot is replaced by a comma and the following points (d) and (e) are added:
"(d) the definition of dangerous defects which, because of their nature or scope, significantly increase the risk of road safety or the adverse environmental performance of the vehicle or combination; and
(e) models of documents for the retention of vehicle registration certificates. ';
3. The following Section 4a is inserted after Section 4:
Withdrawal of a vehicle registration certificate
(1) A dangerous defect which, because of its nature or scope, significantly increases the risk of road safety or the adverse environmental performance of the vehicle or combination is:
(a) absence or removal of a substantial part of the exhaust system;
(b) damage to the braking system excluding its use, in particular the decommissioning of its part, the destruction of brake discs and linings;
(c) the absence or damage of the windscreen to more than 50% of the area;
(d) obvious excess leakage of operating fluids;
(e) corrosion or cracks of supporting parts manifestly affecting the strength of the frame or body;
(f) wear or damage to tyres revealing supporting layers;
(g) the deformation of the frame or bodywork reaching column A, for motorcycles a significant deformation of the basic elements of the frame;
(h) the deformation of the axle, including its deposition affecting its strength;
(i) apparent deformation of engine seating, such as torn anchorages, engine displacement,
(j) deformation of the bodywork affecting the interior of the vehicle crew;
(k) deformation of the main parts of the steering system which clearly affect the safe operation of the vehicle, such as gearboxes, power-grippers, coupling rods, steering shaft;
(l) obvious deformation or wheel cracks;
(m) obvious leakage of exhaust or other toxic gases into the driver's or passenger compartment of a vehicle of categories M2 and M3.
(2) The model of the document of detention of the vehicle registration certificate is set out in Annex 3 to this Regulation.
(3) The model of the document of detention of a vehicle registration certificate which has not yet been surrendered is set out in Annex 4 to this Regulation. '
4. the following Annexes 3 and 4 are inserted after Annex 2:
