DECLARATION
of 14 July 2014
amending Decree No 377 / 2003 Coll., on veterinary checks on imports and transit of animals from third countries, as amended by Decree No 259 / 2005 Coll.
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 359 / 2012 Coll. and Act No. 279 / 2013 Coll., to implement § § 33 (6), § 34 (5) and § 38 (4) of the Veterinary Act:
Decree No 377 / 2003 Coll., on veterinary checks on imports and transit of animals from third countries, as amended by Decree No 259 / 2005 Coll., is amended as follows:
1. in § 1 (1) of the introductory part of the provision, § 2 (h), § 3 (1) and (2), § 9 (1), § 16 (1) of the introductory part of the provision, and in § 20 (1) the words "European Communities" are replaced by the words "European Union."
2. in Article 2 (e), the word "Community" shall be replaced by "Member States (hereinafter referred to as" Union territory ")."
3. in Article 5, the words "Member States (hereinafter referred to as the Community territory) 'are replaced by the words" Union';
4. in Articles 9 (3), 11 (5), 15 (1) (b), 16 (3), 17 (2) and 20 (5), "the Community" shall be replaced by "the Union."
5. in Article 2 (g), the words "the Commission of the European Community 'are replaced by the words" the European Commission';
6. in Article 4 (2) (d), the words "computerised processing of veterinary import procedures, (4)" shall be replaced by the words "computer networks operated under European Union rules on the introduction of Traces4";
footnote 4:
"(4) Commission Decision 2004 / 292 / EC of 30 March 2004 on the introduction of the Traces system and amending Decision 92 / 486 / EEC, as amended."
7. In Paragraph 11 (5), "web 'is replaced by" Internet'.
8. In Article 12 (3), the words "In the context of information provided through a system of exchange under a special legislation, 4) 'are replaced by the words" In the context of information provided by the competent authority of another Member State of destination through a computer network operated under a European Union Regulation on the introduction of Traces4'.
9. in Paragraph 13 (1) (b) (2) (bb), the words "information exchange system under special legislation (4)" shall be replaced by the words "computer networks operated under the European Union Regulation on the introduction of Traces4";
10. In Annex 2, Part III, including footnotes 17 and 18:
"III. Sampling procedure:
Sampling to check compliance with the animal health requirements laid down in the accompanying health certificate shall be carried out as follows:
(1) At least 3% of consignments shall be subject to monthly sampling for serological examination, except for registered horses (17) accompanied by individual veterinary certificates certifying compliance with the veterinary requirements laid down in an authorisation issued under another legislation governing animal health requirements and the animal health conditions for their importation from third countries (18).
Samples shall be taken from at least 10% of the animals in each of the consignments selected for sampling in accordance with point 1, but not less than 4. If problems occur, this percentage must be increased.
2. The official veterinarian may, on the basis of a risk assessment, take any necessary samples from any animals in the consignment at the border veterinary station.

Efficacy
This Decision shall enter into force on 1 August 2014.
