implementing certain provisions of Act No. 132 / 1989 Coll., on the Protection of Rights to New Plant Varieties and Animal Breeding
The Federal Ministry of Agriculture and Nutrition, in agreement with the Ministry of Agriculture and Nutrition of the Czech Socialist Republic and with the Ministry of Agriculture of the Slovak Socialist Republic pursuant to Article 29 (2) of Act No. 132 / 1989 Coll., on the Protection of Rights to New Varieties of Plants and Breeding Animals, hereinafter referred to as "the Act ', provides:
Forms of application
Application for protection of a new variety or breed (Section 16 of the Act)
(a) details of the applicant, namely:
1. the name, registered office and State of the registered office, if any;
2. the name, surname, residence and date of birth, if any, if any;
If more than one person subscribes to the variety or breed, the application shall contain details of all applicants, including their shares,
(b) the name of the variety or breed and their working description; in the case of varieties and breeds authorised or recognised under the Specific Regulations (1) (2), the name under which they were authorised shall be indicated;
(c) the species or, where appropriate, the genus of the plants or animals to which the variety or breed applied for belongs and its Latin name;
(d) the name, surname, domicile and date of birth of all the originators, proposing their shares;
(e) a description of the variety or breed containing the identification of the important characteristics, characteristics and differences of varieties (Section 4 of the Law) and breeds (Section 5 of the Law);
(f) for breeds
1. the result of the recognition or authorisation procedure under the special rules, 2) 3)
2. frequency,
(g) the signature of the applicant.
(1) The application shall be submitted in duplicate on a form the model of which is given in Annex 1. It is completed in Czech or Slovak.
(2) If a Czechoslovak citizen submits an application, he shall make an honest statement that the variety or breed has not been created in the course of the activities of the Czechoslovak organisation [§ 2 (f) of the Act].
(3) If a variety or breed has been registered for protection previously abroad, the applicant shall indicate the place and date of filing of the first application.
(4) The information in the application for originals and the amount of their shares is signed by all originators (Section 7 (2) of the Act).
Participation in the financial contribution from commercial exploitation of varieties and breeds
(1) The financial contribution from the commercial exploitation of varieties and breeds and from the transfer of the breeding certificate referred to in Article 7 (3) of the Act (hereinafter referred to as the "financial contribution") means the sum of the financial revenue obtained in the relevant calendar year
(a) the sale of propagation material;
(b) by granting consent to commercial exploitation (licence fees),
(c) the refund on the compulsory licence,
(d) transfer of the breeding certificate to a foreign body.
(2) The revenue referred to in paragraph 1 (a) shall be:
(a) in the case of varieties, income from the sale of seed, seed and nurseries and of plants and parts thereof intended for further reproduction;
(b) for breeds, income from the sale of breeding and breeding animals, embryos, ova and semen intended for further reproduction.
The Czechoslovak organization that holds the breeding certificate records the financial contribution by variety or breed.
(1) The share of the financial benefit belongs to the originators for the duration of the breeding certificate and is paid from the year in which the financial contribution was first received after the issue of the breeding certificate (Section 3 of the Act).
(2) The share of the financial benefit shall be paid directly by the originators and shall not be included in the basis for calculating the taxes and levies of the organisation.
(1) The amount of the share of the financial benefit for varieties is governed by the species and, where appropriate, the genus of the plants to which the variety belongs and the number of years of commercial exploitation; shall be fixed at the percentage indicated in Annex 2 to this order.
(2) The amount of the share of the financial benefits for breeds is 2%, but not more than 200 000 CZK in total.
The share for the year in question shall be due three months after the end of the calendar year in which the financial contribution was achieved.
Where a financial benefit or part of it has been achieved in a foreign currency, the originator shall be entitled to a share or proportion of the financial benefit in that currency.
Transitional and final provisions
Paragraph 5 to 9 shall not apply to shares in the financial benefit of varieties and breeds which have been registered for protection under Section 30 of the Act.
This Decree shall take effect on 1 January 1990.

(2) For the next five years of commercial exploitation, the contribution shall be 30% of the rate referred to in paragraph 1.
(3) For the remaining years of commercial exploitation, the contribution shall be 10% of the rate referred to in paragraph 1.
