THE LAW
of 20 December 1970
on the competence of federal ministries
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
General provisions
This Act regulates the competence of federal ministries and certain other federal central bodies (hereinafter referred to as "federal ministries') in the performance of the federal administration. Their first task is to participate in the creation of a federation state policy and to organise its implementation within its responsibility.
The Federal ministries operate on their section of state administration within the scope of the Federation. On the basis of continuous analysis of the state of affairs, they draw up proposals for solutions to crucial issues in the relevant areas of competence of the Federation and submit them to the Government of the Czechoslovak Socialist Republic.
(1) Federal ministries submit proposals for state economic policy on their section and carry out national economic planning tasks under specific regulations within their scope; submit, in particular, the supporting documents and proposals necessary for the preparation of draft national plans for the development of the national economy of the Czechoslovak Socialist Republic, the federal budgets of the Federation and other wider-scale measures. They shall, within their competence, submit proposals for the development of the system of planned management and verify its effectiveness.
(2) Federal ministries are based in their activities on the objectives and tasks of the State plans for the development of the national economy of the Czechoslovak Socialist Republic and on the single state policy; in accordance with them, in their section of state policy, they specify and implement.
(3) Federal ministries shall cooperate with each other in the performance of their tasks and shall deliver opinions on proposals submitted by other authorities to the Government of the Czechoslovak Socialist Republic, insofar as they affect their competence.
Federal ministries are in charge of the proper regulation of the Federation in their section. They are preparing draft laws of the Federal Assembly and regulations of the Government of the Czechoslovak Socialist Republic. Under the Federal Assembly's laws and within their limits, they issue generally binding legislation if they are empowered by law to do so. They shall monitor the application of these provisions.
The Federal Ministries shall ensure, in their responsibility, the tasks of developing interstate contacts and international cooperation in the economic, scientific and technical fields, as well as in other areas. In preparing proposals to negotiate international agreements, the competent central government authorities of the Republic may require the necessary documentation. Federal ministries ensure tasks arising from international treaties and agreements as well as from the membership of the Czechoslovak Socialist Republic in international organisations.
Federal ministries are taking the necessary measures in their section to ensure the defence capability of the Czechoslovak Socialist Republic and the needs of the armed forces and to prepare state bodies, economic and other organisations as well as the defence of the population and its protection in the event of war. They prepare the necessary proposals and submit them to the Government of the Czechoslovak Socialist Republic or to the Council of State Defence.
(1) In order to ensure uniform security of state policy of the Federation, federal ministries shall take account of the needs of those areas which fall within the competence of the Republics and shall take care in agreement with the authorities of the Republics of their consistent development. Federal ministries create the conditions for coordinating the resolution of issues of common interest arising from the need for uniform security of federal state policy throughout the territory of the Czechoslovak Socialist Republic.
(2) In the interests of effective development of the single Czechoslovak economy, federal ministries ensure the development of the national economy of the Czechoslovak Socialist Republic and the needs of sectors managed by the authorities of the Republics. The single Czechoslovak economy sector, managed by the authorities of the Republics, also provides for the needs of sectors managed by federal authorities.
(1) Federal ministries are working consistently with the competent authorities of the Republics, in particular in preparing draft laws of the Federal Assembly and other generally binding legislation and in preparing, creating and implementing national economic plans, proposals in the area of uniform state economic policy and other important measures of the Government of the Czechoslovak Socialist Republic. Together with them, they shall ensure consistency of the procedure necessary for the preparation of such measures. They use their analyses, the concepts of sector development and other work. They rely on their experience and deal with their incentives.
(2) In order to ensure uniform security of state policy throughout the territory of the Czechoslovak Socialist Republic, the ministers of the Czechoslovak Socialist Republic, together with the relevant ministers of the Republics, ensure synergies and coordination. The Federal ministries shall monitor the performance of the tasks arising from the uniform application of the Federation's state policy and shall ensure that the competent authorities of the Republics ensure that positive experience is generalised and that deficiencies are eliminated. They shall discuss the measures to be taken in this respect.
(3) Federal ministries may require the supporting documents and other information they need for their activities, from the competent authorities of the Republics and to the extent agreed with them, as well as from economic and other organisations subordinate to them.
(4) The Ministers of the Czechoslovak Socialist Republic are discussing draft measures in the area of common competence of the Czechoslovak Socialist Republic and both Republics before submitting them to the Government of the Czechoslovak Socialist Republic with the Ministers of the Republics, if the proposed measures affect them; If no agreement is reached, they shall inform the Government of the Czechoslovak Socialist Republic, which shall decide.
(1) Federal ministries perform their tasks in cooperation with trade unions and other voluntary social organisations and cooperative organisations.
(2) Federal ministries use knowledge of scientific institutions and workplaces in their activities and involve them, in particular, in work on solving problems of a conceptual nature.
Specific provisions
Federal Ministry of Foreign Affairs
The Federal Ministry of Foreign Affairs is a federal central government body for foreign policy.
The Federal Ministry of Foreign Affairs ensures relations between the Czechoslovak Socialist Republic and other states and international organisations. It manages, coordinates and ensures the implementation of the foreign policy of the Czechoslovak Socialist Republic and ensures the application of the interests of the foreign policy of the Czechoslovak Socialist Republic in the activities of all bodies of the Federation and of the Republics.
The Federal Ministry of Foreign Affairs ensures representation of the rights and interests of the Czechoslovak Socialist Republic in international relations. It coordinates and ensures the preparation of the negotiation of international agreements. In preparing international treaties and representing the rights and interests of the Czechoslovak Socialist Republic in international relations in matters falling within the exclusive competence of the Republics, it shall cooperate with the central authorities of the Republics.
Federal Ministry of Foreign Affairs
(a) manages Czechoslovak representative offices abroad;
(b) declare international agreements;
c) carry out tasks in securing contacts with foreign countries in the fields of education, culture, science and health, based on the guidelines of the Government of the Czechoslovak Socialist Republic.
Federal Ministry of National Defence
The Federal Ministry of National Defence is the Federal Central Authority for Defence Security of the Czechoslovak Socialist Republic and for the Management and Command of the Czechoslovak People's Army and for Civil Defence Management. It ensures the implementation of the military policy of the Czechoslovak Socialist Republic in the Czechoslovak People's Army and proposes the necessary measures to the Government of the Czechoslovak Socialist Republic, the Council of Defence of the State and the President of the Republic as Chief Commander of the Armed Forces of the Czechoslovak Socialist Republic.
When securing defence of the Czechoslovak Socialist Republic Federal Ministry of National Defence in particular
(a) elaborates proposals for the comprehensive construction of the Czechoslovak Socialist Republic's defence system and a proposal for a defence plan of the Czechoslovak Socialist Republic;
(b) take measures to ensure the construction of the Czechoslovak Socialist Republic's military system on its section and to use the Czechoslovak People's Army in the event of war;
(c) elaborates a comprehensive plan for the construction of the Czechoslovak People's Army in terms of links to state plans for the development of the national economy of the Czechoslovak Socialist Republic and manages the relevant military resources;
d) Develop fundamental issues of war and military science and develop scientific activity for the need for a military system of the Czechoslovak Socialist Republic;
(e) develop basic issues of professional education and training of the population and propose measures to implement them;
(f) prepare the concept, focus and main civil defence tasks.
Federal Ministry of National Defence as the authority for the management and command of the Czechoslovak People's Army in particular
(a) manage the construction of the Czechoslovak People's Army and ensure its versatile readiness and continuous command to the troops;
(b) develop operational and combat use of the Czechoslovak People's Army and manage military intelligence;
c) Provides the Czechoslovak People's Army with all kinds of equipment, combat techniques and material;
(d) manage the addition, preparation, education, selection and distribution of the cadres of the Czechoslovak People's Army and take measures to ensure the living, working and social conditions of members of the Czechoslovak People's Army;
e) ensures the integrity of the airspace of the Czechoslovak Socialist Republic and is involved in ensuring the protection of state borders in a specified section.
Federal Ministry of National Defence
(a) organise and implement measures to mobilise the Czechoslovak People's Army, to keep records of citizens subject to military obligations and to keep records of means of property which will be provided in armed readiness for the use of the armed forces of the Czechoslovak Socialist Republic;
(b) calls on the people of the Czechoslovak Socialist Republic to fulfil a military obligation and, to the extent of its competence, sets out the manner in which this obligation is to be exercised.
Federal Ministry of the Interior
(1) The Federal Ministry of the Interior is the Federal Central Authority of the Government for Internal Order and Security.
(2) The Federal Ministry of the Interior is preparing the concept, direction and main tasks of the National Security Corps, of the Ministry of the Interior and of the principles of organisation, uniform performance of service and of the political and training systems of the members of the National Security Corps and of the Ministry of Interior. It ensures the development and unification of methods and means of security work.
(3) The Federal Ministry of the Interior manages State Security and, to a defined extent, Public Security.
The Federal Ministry of the Interior is the authority for the management and command of the troops of the Ministry of the Interior.
Federal Ministry of Interior
(a) the preparation and execution of international agreements in the field of internal order and security, unless entrusted to the authorities of the Republics;
(b) the prevention of the transport, import and distribution of goods of foreign origin, the content of which is contrary to protected interests or in breach of international treaties.
The Federal Ministry of the Interior, on the basis of the mandates contained in the relevant laws, issues generally binding legislation governing:
(a) the rights and obligations of members of the National Security Corps and of the troops of the Ministry of the Interior, the services of the National Security Corps, as well as the troops of the Ministry of Interior against other authorities of the State administration, organisations and citizens;
(b) the service and financial, material, social and medical security of members of the National Security Corps and the military of the Ministry of Interior;
(c) the development and operation of telecommunications equipment by the National Security Corps and the troops of the Ministry of Interior outside the single telecommunications network.
If the Federal Ministry of the Interior performs other tasks of the State Administration, special regulations apply.
The Federal Ministry of the Interior controls the performance of the tasks entrusted to it in the services of the National Security Corps and in the armies of the Interior Ministry.
Minister of Interior of the Czechoslovak Socialist Republic
(a) after consulting the Ministers of the Interior of the Republic, invite selected members of the National Security Corps to carry out the tasks of the Federal Ministry of Interior;
(b) establish, on a proposal from the Ministers of the Interior of the Republic, the Chiefs of the Regional Administration of the National Security Corps.
State Planning Commission
The National Planning Commission is a federal central government body for national economic planning and development of the system of planned management of the national economy.
The State Planning Commission, following the instructions of the Government of the Czechoslovak Socialist Republic and in cooperation with the other central authorities, organises the overall process of drawing up, ensuring and monitoring the implementation of state plans for the development of the National Economy of the Czechoslovak Socialist Republic, including a specific part of the state plans; that application is laid down in specific provisions.
State Planning Commission
(a) submit summary proposals to the Government of the Czechoslovak Socialist Republic for the development of a system of planned management of the national economy and coordinate the measures that other authorities are preparing for this section;
(b) verify the effectiveness of the system of planned management of the national economy;
(c) submit summary proposals to the Government of the Czechoslovak Socialist Republic to guide the system of materially technical supplies and to develop its base and coordinate on this section measures prepared by other central authorities.
Federal Ministry of Finance
The Federal Ministry of Finance is the Federal Central Authority for Finance.
Federal Ministry of Finance
(a) propose to the Government of the Czechoslovak Socialist Republic, in order to ensure a uniform economic policy, the concept of the financial policy of the Czechoslovak Socialist Republic for annual and multiannual periods and ensure its uniform implementation;
(b) drawing up a medium-term budgetary perspective;
(c) propose to the Government of the Czechoslovak Socialist Republic the framework principles of subsidy and depreciation policy in the Czechoslovak Socialist Republic;
d) carry out financial management analyses for the whole of the Czechoslovak Socialist Republic according to the supporting documents provided by the other federal and Republican authorities to the extent agreed with the Ministry of Finance of the Republic.
Federal Ministry of Finance
(a) submit to the Government of the Czechoslovak Socialist Republic a draft State Budget of the Federation and the State Final Account of the Federation;
(b) propose to the Government of the Czechoslovak Socialist Republic a way of securing the revenue of the Federation State Budget and adjusting the relations between the Federation State Budget and the Republic State Budget;
(c) in the context of state budgets and state accounts, it shall exercise the additional powers laid down in specific provisions. *)
Federal Ministry of Finance
(a) propose and, to the extent authorised by the Government of the Czechoslovak Socialist Republic, set out, in an agreement with the Federal Ministry of Foreign Trade, the State Planning Commission, the Federal Price Office and the State Bank, the Czechoslovak Financial Economic Instruments in Foreign Trade, in so far as they relate to state budgets, other than Additional Instruments; it shall finance and ensure the implementation of financial economic instruments, including additional instruments, in relation to organisations managed by federal authorities; * *)
(b) in cooperation with the Federal Ministry of Foreign Trade, propose to the Government of the Czechoslovak Socialist Republic concepts and economic conditions in the field of government loans granted and received in external relations;
(c) draw up, on the basis of proposals by the Ministry of Finance of the Republics and the needs of the Federation, part of the foreign exchange plan concerning non-commercial salaries for the whole of the Czechoslovak Socialist Republic and establish economic instruments for them;
(d) after consulting the Federal Ministry of Foreign Trade, the State Planning Commission and in agreement with the Czechoslovak State Bank, submit proposals to the Government of the Czechoslovak Socialist Republic for the creation, use and extent of foreign reserves;
(e) lay down the principles governing the financing of external trade;
(f) ensure, in cooperation with other participating authorities, the processing of financial, monetary and foreign exchange issues arising from the participation of the Czechoslovak Socialist Republic in the Council of Mutual Economic Assistance and prepares proposals for the procedure of Czechoslovak delegations in the bodies of the Council of Mutual Economic Assistance on these issues.
Federal Ministry of Finance
(a) submit to the Government of the Czechoslovak Socialist Republic draft legislative amendments in its field of competence; If there are proposals for legal adjustments to the foreign exchange economy, it does so in cooperation with the Federal Ministry of Foreign Trade, the State Planning Commission and the State Bank of Czechoslovakia, and if there are proposals for major legal adjustments in the matters of savings banks and insurance companies, in cooperation with the State Bank of Czechoslovakia;
(b) issue, by virtue of the mandates contained in the relevant laws, generally binding legislation governing the management of national assets, invoicing, payment and financial management of state economic organisations;
c) pursuant to this Act it issues regulations on the implementation of periodic revisions in the Czechoslovak Socialist Republic and sets out a methodology for financial tax revisions.
Federal Ministry of Finance
(a) together with the Czechoslovak State Bank, propose to the Government of the Czechoslovak Socialist Republic the adjustment of the Czechoslovak currency and the principle of the circulation of legal money and supervise the protection of the currency;
(b) declare the issue and the description of each type of money and its withdrawal;
(c) oversees the printing and stamping of money.
Federal Ministry of Finance
(a) review the management of federal authorities, federal funds and organisations managed by federal authorities;
(b) exercise supervision of the federal special-purpose funds;
(c) ensure uniform implementation and application of the Federal Assembly's laws on levies and taxes, as well as the rules on charges relating to abroad; authorises exemptions and exemptions from levies and taxes on organisations managed by the federal authorities and fees in relation to abroad; the exemptions and exemptions from corporate levies and taxes are permitted on a proposal from the competent ministries;
(d) ensure, in agreement with the Ministry of Finance of the Republic, a uniform concept of deposit, credit, insurance and interest policy for savings banks in relation to the population and insurance undertakings;
(e) exercise jurisdiction in matters relating to the management of national property in respect of national assets managed by the federal authorities and organisations managed by them.
Federal Ministry of Foreign Trade
The Federal Ministry of Foreign Trade is the Federal Central Authority for Foreign Economic Relations.
Federal Ministry of Foreign Trade
(a) propose to the Government of the Czechoslovak Socialist Republic the principles of a single foreign trade policy, manage its implementation and directly implement it, depending on the nature of the matter; to this end, it shall lay down provisions under this law and take the necessary measures;
(b) ensure, in cooperation with the relevant federal central authorities and central authorities of the Republic, the preparation of international agreements in the field of external trade;
(c) in cooperation with the relevant federal central authorities and central authorities of the Republic, ensure the national implementation of international treaties and compliance with the international obligations of the Czechoslovak Socialist Republic in the field of foreign trade;
(d) specify additional economic instruments in foreign trade;
(e) lay down rules for the implementation of price policies in the field of foreign trade, in accordance with established principles of State pricing policy and foreign trade policy.
Federal Ministry of Foreign Trade
(a) prepare, in cooperation with the relevant federal central authorities and central authorities of the Republic, draft foreign trade plans and submit them to the State Planning Commission;
(b) carry out, in the field of foreign trade, a breakdown of the plan for foreign trade organisations and organisations authorised to conduct foreign trade activities.
(1) Federal Ministry of Foreign Trade
(a) issue, on the basis of the mandates contained in the relevant laws, generally binding legislation on foreign trade and on its organisation and control its implementation;
(b) after consulting the central authorities of the Republics, establish and abolish the organisation of foreign trade and determine the scope of their authorisation, grant and withdraw the authorisation to carry out foreign trade activities and represent foreign enterprises in the Czechoslovak Socialist Republic and, in agreement with the Federal Ministry of Finance, decide on holdings abroad;
(c) manage the Foreign Trade Organisation against which it carries out tasks of the Central Authority; other organisations authorised to conduct foreign trade activities shall, in cooperation with other competent authorities, manage the plan and economic and commercial policy instruments.
The Federal Ministry of Foreign Trade ensures the consistency of foreign trade policy with foreign exchange policy and, in an agreement with the Czechoslovak State Bank, decides on matters related to the part of the foreign exchange plan and the balance of payments that is based on foreign trade activity.
(1) The Federal Ministry of Foreign Trade has jurisdiction in customs, customs policy and customs tariffs matters.
(2) The Central Customs Administration is a special component of the Ministry of Foreign Trade. The Customs Directorate for the Czech Socialist Republic and the Customs Directorate for the Slovak Socialist Republic are its bodies for the territory of the Republic; these directorates are directly subordinate to customs.
Federal Ministry of Labour and Social Affairs
The Federal Ministry of Labour and Social Affairs is a federal central government body for labour, wages and social policy.
Federal Ministry of Labour and Social Affairs
(a) submit to the Government of the Czechoslovak Socialist Republic proposals for uniform principles of labour relations, in particular adjustments to working conditions and working hours, and proposals for a system for regulating the distribution of labour, employment policy, productivity and rationalisation of labour, labour reproduction and qualification;
(b) proposes to the Government of the Czechoslovak Socialist Republic to secure recruitment of labour for organisations which perform the tasks set out in the State Plan for the Development of the National Economy of the Czechoslovak Socialist Republic as a priority;
(c) in accordance with the State Plan for the Development of the National Economy of the Czechoslovak Socialist Republic, proposes to the Government of the Czechoslovak Socialist Republic, after consulting the Labour and Social Ministers of the Republic, the movement of labour between the Republics;
(d) propose to the Government of the Czechoslovak Socialist Republic an inter-state agreement on work assistance and the regulation of fundamental employment issues for foreign nationals in the Czechoslovak Socialist Republic and Czechoslovak citizens abroad;
(e) issue generally binding legislation in the matters referred to in (a) to (d) on the basis of the authorisations contained in the relevant laws.
(1) Federal Ministry of Labour and Social Affairs
(a) submit proposals to the Government of the Czechoslovak Socialist Republic and, according to their directives, establish uniform principles governing wage developments, wage systems, the granting of benefits in kind and the reimbursement of expenditure linked to the performance of work, the normalisation of labour consumption and wage control;
(b) in accordance with the above-mentioned guidelines of the Government of the Czechoslovak Socialist Republic, pursuant to this Act, it issues generally binding legislation governing:
- wage tariffs, types and amounts of wage supplements and the conditions for their granting,
- the way wages are regulated,
- reimbursement of work-related expenses, and
- allowances on entering and leaving the service.
(2) The other federal central authorities and central authorities of the Republic may issue the provisions referred to in paragraph 1 (b). (b) to the extent and under the conditions agreed with the Minister for Labour and Social Affairs of the Czechoslovak Socialist Republic and, as regards the central authorities of the Republic, with the relevant Minister for Labour and Social Affairs of the Republic.
Federal Ministry of Labour and Social Affairs
(a) propose to the Government of the Czechoslovak Socialist Republic measures aimed at carrying out the tasks of the Federation in the field of social policy, in particular in the field of social and sickness security for the population, social care for the family and youth, and creating favourable conditions for the development of the population, and the principles of state housing policy from a social perspective;
(b) issue, on the basis of the mandates contained in the Social Security Act (*), generally binding legislation with regard to pension insurance (insurance), mother and child security, sickness insurance and provision allowance for members of the families of the armed forces.
Federal Price Office
The Federal Price Office is a federal central government body for prices.
Federal Price Office
(a) propose to the Government of the Czechoslovak Socialist Republic the principles of pricing policy and price adjustment directives;
(b) propose guidelines for drawing up a price development plan;
c) proposes a plan for the development of prices as part of the state plan for the development of the national economy of the Czechoslovak Socialist Republic.
