DECLARATION
of 20 April 2016
amending Decree No. 302 / 2001 Coll., on technical inspections and measurement of vehicle emissions, as amended
The Ministry of Transport provides pursuant to § 91 (1) of Act No. 56 / 2001 Coll., on the conditions of operation of vehicles on the road and on the amendment of Act No. 168 / 1999 Coll., on liability insurance for damage caused by the operation of the vehicle and on the amendment of certain related laws (Act No. 297 / 2009 Coll.), as amended by Act No. 103 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 170 / 2007 Coll., Act No. 297 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 239 / 2013 Coll. and Act No. 260 / 2014 Coll., to implement § 48 (5):

Decree No. 302 / 2001 Coll., on technical inspections and measurement of vehicle emissions, as amended by Decree No. 99 / 2003 Coll., Decree No. 9 / 2006 Coll., Decree No. 83 / 2012 Coll. and Decree No. 342 / 2014 Coll., are amended as follows:
1. Paragraph 8 (4), including footnote 1a, reads:
"(4) The repeated technical inspection shall be a technical inspection following a prior technical inspection in accordance with paragraph 1 (a), (c), (d), (g) and (h), a prior inspection of the technical condition of a road vehicle under a specific legislation or other similar check in another Member State where a serious or dangerous defect has been detected on the vehicle, or a vehicle registration certificate under a specific legislation. A repeated technical inspection carried out within 30 calendar days of the previous technical examination shall be carried out to the extent that the technical condition and operation of the road vehicle systems, components and separate technical units on which a serious or dangerous defect has been detected are limited to the extent that there is no other obvious serious or dangerous defect during the inspection. A repeated technical examination carried out over a period of more than 30 calendar days after the previous technical examination shall be carried out in full. A repeated technical inspection following the retention of a vehicle registration certificate under special legislation (1a), if there are dangerous defects detected in the clarification of the accident, shall always be carried out in full.

2. In the second sentence of Article 8 (7), the words "identifiers' are replaced by the words" identification data ', the word "approved' is deleted and the words" which is part of the Central Information System for the STK 'are inserted after the word "databases'.
3. In the fifth sentence of Article 8 (7), the words "The description of the approved database, including the determination of its content, the conditions for its administration, the disclosure by the Ministry of Technical Control and the approval of its contents, 'are replaced by the words" Definitions'.
4. The following shall be added at the end of Annex 7:
"-" Vehicle identification "- here means an activity where the technical inspection station examines the compliance of the identification data with the submitted vehicle registration document, which is in particular the vehicle registration certificate, the technical document, the statement of technical data to the vehicle issued by an accredited representative or by an authorised technical service, the COC sheet or other equivalent document. The compliance of vehicle identifiers shall be compared with the approved database.
- "Identifier" - here means in particular the vehicle identification number (VIN) and the manufacturer's mandatory label. In order to identify the vehicle, other data assigned to the vehicle may, as a general rule, be used either by the vehicle manufacturer or by a registration site: an engine number, if fitted with it and provided in the vehicle documents, the registration mark, colour and execution of the vehicle or other similar data, according to which the uniqueness of the vehicle may be determined. ';
5. In Annex No 20, point (2), the words "vehicle registration certificate or technical licence certificate 'are replaced by the words" vehicle registration certificate, technical licence certificate or document of detention of vehicle registration certificate pursuant to special legislation9'.

6. In Annex No 20, at the end of the text in point (2), the words "- the Protocol on the prior inspection of the technical condition of a road vehicle under specific legislation or other similar control in another Member State where a serious or dangerous defect has been detected on the vehicle, if this inspection has been carried out. ';

Efficacy
This decree shall take effect on the day of its publication.
