THE LAW
of 10 November 1982
amending and supplementing the Family Act
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Čl. I
The Family Act No 94 / 1963 Coll. is amended as follows:
1. In Paragraph 37 (3), the dot at the end is replaced by a comma and the following words are added: "which will represent the child in the proceedings or in a particular legal act."

„§ 45
(1) If the interest of the child so requires, the court may entrust the child to the upbringing of a citizen other than the parent if the citizen provides a guarantee of his proper upbringing. In so doing, the court shall determine the scope of its rights and obligations to the child. In this way, the child can also be entrusted to the married couple. The divorce of marriage ceases to exist; If one of the husbands dies, the child remains in the custody of the other husband.
(2) The child can be confided in foster care; the conditions shall be laid down in a separate Regulation.
(3) If the child's upbringing is seriously threatened or seriously impaired and other educational measures have not led to a correction or if, for other serious reasons, parents cannot ensure the upbringing of the child, the court may order constitutional upbringing. If necessary in the interests of the minor, the court may order constitutional education even if other educational measures have not been preceded. For important reasons, the court may extend constitutional education to up to one year after maturity. '
3. In Paragraph 58, the following paragraph 2 is inserted after paragraph 1:
"(2) A father to a child born between the hundred and eighty days and the third day after the artificial insemination carried out with the consent of the mother's husband shall not be denied. However, paternity may be denied if it is demonstrated that the mother of the child has become pregnant differently. ',
paragraph 2 shall become paragraph 3.
4. in Article 68 (1) (a), "one year" is replaced by "six months."
5. The following sentences are added at the end of Paragraph 74 (2):
"Exceptionally, a lonely person can also acquire such a thing if it is otherwise assumed that this adoption will fulfil his social mission. In such a case, the court shall also decide to delete the entry of the second parent of the child from the register. '.
6. In the first sentence of Paragraph 92 (1), "necessary 'is replaced by" adequate'.
7. § 93 is deleted.
8. Paragraph 95 (1) reads as follows:
"(1) The father of the child for whom the mother of the child is not married shall be obliged to contribute to the mother adequately for a period of one year, as well as to the cost of pregnancy and sleep. '
9. In the second sentence of Paragraph 100, the words "the 25th 'are replaced by the words" the 26th'.
10. In Section 103, the words "and, in this context, the amount of the nursing allowance 'are deleted.
Čl. II
The Bureau of the Federal Assembly is hereby authorised to declare in the Collection of Laws the full text of the Family Act, as is apparent from the amendments and additions made by this Act.
Čl. III
This Act shall take effect on 1 April 1983.
