on the Agreement on the Trade Representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics
On 30 May 1973, the Agreement on the Trade Representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics was signed in Moscow.
Pursuant to Article 5 thereof, the Agreement entered into force on 19 July 1973.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
on the trade representation of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics
The Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics,
the managing director with a joint decision to develop all-round cooperation and contribute to strengthening economic relations between the two States in accordance with the principles of the Treaty of Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics of 6 May 1970,
noting that the Treaty on Trade and Navigation between the Republic of Czechoslovakia and the Union of Soviet Socialist Republics of 11 December 1947 regulates the legal status of the Union of Soviet Socialist Republics in the Czechoslovak Socialist Republic, and
Observing the wish of the Czechoslovak Party to transform the Trade Department of the Embassy of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics into the Trade Representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics,
agree on the following:
The Trade Department of the Embassy of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics is transformed into the Commercial Representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics.
The representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics shall perform the following functions:
(a) promote the development of economic relations between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics;
(b) represents the interests of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics in all matters relating to foreign trade;
(c) in the framework of the mandates given by Czechoslovak legislation, manage commercial operations and control the exchange of goods between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics.
The Commercial Prosecutor acts on behalf of the Government of the Czechoslovak Socialist Republic.
The Commercial Representative is part of the Embassy of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics and has its seat in Moscow. The branches of the commercial office can be opened in other cities of the Soviet Union in an agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics.
The Head of the Trade Representative of the Czechoslovak Socialist Republic in the Union of Soviet Socialist Republics and its representatives shall enjoy all rights and privileges conferred on members of diplomatic missions.
In addition to the persons referred to in the preceding paragraph, employees of the commercial representative who are citizens of the Czechoslovak Socialist Republic will be exempt from Soviet taxes on service income which they will receive from the Czechoslovak State and enjoy similar rights and privileges as those granted to embassy employees who do not have diplomatic status.
The offices of the sales agency and its branches are untouchable.
The sales office and its branches have the right to use cipher.
The Government of the Czechoslovak Socialist Republic is responsible only for trade contracts that could be concluded in the Union of Soviet Socialist Republics on behalf of the Commercial Representative or where the Trade Representative would provide a guarantee in the Union of Soviet Socialist Republics and which would be signed by persons empowered to do so.
The Trade Representative shall enjoy all immunity arising from Article 3 of this Agreement with the following exceptions:
(a) disputes arising from trade contracts concluded or guaranteed in the territory of the Union of Soviet Socialist Republics shall be subject to the commercial representation referred to in the preceding paragraph, unless the jurisdiction of the arbitration or other court is reserved, to the jurisdiction of the Union of Soviet Socialist Republics. In so doing, however, the measures to safeguard the claim against the commercial representative shall not be allowed;
(b) the compulsory execution of final pleadings which have been delivered in the abovementioned disputes against the commercial representative and have entered into legal proceedings may be carried out only on goods and debts of the commercial representative.
This Agreement shall enter into force on the date of the exchange of notes on its approval under the legislation of the two Parties and shall apply for the period of validity of the Trade and Navigation Treaty between the Republic of Czechoslovakia and the Union of Soviet Socialist Republics of 11 December 1947, unless the Parties agree otherwise.
Written in Moscow on 30 May 1973 in duplicate, each in the Czech and Russian languages, the two texts being equally authentic.
