GOVERNMENT REGULATION
of 6 December 1967
on the additional levy in the event of failure to fulfil the specified supply tasks for foreign trade
The Government of the Czechoslovak Socialist Republic provides pursuant to § 9 (2) (d) of Act No. 83 / 1966 Coll., on the fourth Five-Year Plan for the Development of the National Economy of the Czechoslovak Socialist Republic:
(1) If the supplier organisations and organisations responsible for the conduct of foreign trade in the defined monetary breakdown do not comply with the binding volume of export supplies (hereinafter referred to as "the part of the supply not met") *, they shall be charged an additional levy.
(2) The additional levy shall also be imposed on the supplier organisations which, in the fixed monetary breakdown, will deteriorate the fixed balance between supplies for export and supplies of non-investment nature on imports or their ratio (hereinafter referred to as "the unfulfilled part of deliveries'). *)
(1) The additional levy provided for in Article 1 shall be imposed directly by the authorities in charge of the supply and foreign trade organisations, by an amount fixed under this Regulation. The imposition of the additional levy directly by the authorities shall be discussed in advance.
(2) The competent authorities shall communicate the amount of the additional levy imposed to the competent national district committee.
The basis for the calculation of the additional levy is the total value of the outstanding part of the supply at the prices of fco čs. border, including foreign exchange interest, reduced, where appropriate, by the value of the increased tasks taken over under § 4.
If the supplier organisation undertakes to increase the binding volume of export supplies, to improve the balance between export and non-investment supplies on imports or their ratio in the fixed monetary breakdown for the following year and the directly superior authority, in agreement with the Ministry of Foreign Trade, accepts such an undertaking, the basis for calculating the additional levy referred to in Article 3 shall be reduced by the value of the task increase or, where appropriate, the improved balance or ratio taken over. The commitments taken over shall be increased by the next year's tasks for the purposes of possible calculation of the additional levy.
(1) The supplier organisations carry out an additional levy of 18% on the basis of Article 3.
(2) The organisations entrusted with the conduct of foreign trade shall make an additional contribution to the part of the business margin attributable to overheads on the basis of Article 3.
The additional levy shall be carried out by the organisations within 30 days of its deposit in the bank accounts of the State Budget and, as regards organisations managed by the national committees, on the relevant account of the Management National Committee.
The Ministry of Finance may, where justified, authorise an exemption from the provisions of Section 5.
The provisions of this Regulation shall apply to the unfulfilled parts of the supply from 1968 onwards.
This Regulation shall enter into force on the day of its publication.
