Regulation establishing the rules of organisation and procedure of the State High School Committee and specifying its responsibilities

of 1 September 1950
laying down the rules of organisation and procedure of the State High School Committee and specifying its responsibilities.
The Minister of Education, Science and Arts hereby orders, pursuant to § 6 (7) of Act No. 58 / 1950 Coll., on Higher Education Institutions (hereinafter referred to as the Act):
§ 1.
(1) The State Committee, such as the Advisory, Initiative and Coordination Body of the Minister for Education, Science and Arts, makes proposals and is heard on fundamental issues and on important measures concerning universities, in particular:
(a) a plan for the development of universities and its substantive and financial security;
(b) determining the number and types of universities, faculties, department departments, special studies and courses as well as the establishment of scientific and artistic institutes;
(c) determining the locations of universities, their names and locations;
(d) annual and forward-looking plans for the development of the scientific and artistic activities of universities;
(e) the care of the scientific and artistic level of universities;
(f) the appointment of professors and docents, in particular as regards the assessment of their scientific or artistic competence, proposals for delegation and for determining or changing the place of employment of higher education professors, docents, heads of departments and directors of scientific and artistic institutions, following other questions concerning their employment;
(g) the provisions of the temporary representative for the unfilled scientific or artistic field;
(h) the establishment plan for universities;
(ch) the appointment of Rectors, Prorectors, Dean and Dean,
(i) study and test plans and ensure their implementation;
(j) study and test schedules, organisational and other regulations for universities;
(k) plans for the admission of students to higher education and general directives for their admission;
(l) a plan to put university graduates into practice;
(m) a comprehensive plan of aspirants, as well as a plan to put aspirant graduates into practice;
(n) a plan for the publication of textbooks and teaching tools for universities;
(o) principles for the achievement of professional competence and the award of scientific and artistic degrees;
(p) the award of an honorary scientific or artistic degree;
(r) support for the scientific or artistic activities of and the posting of university and artistic staff abroad, as well as the invitation of foreign scientific and artistic staff;
(s) the organisation of bodies in universities;
(t) social care for university students.
(2) The President of the State Committee may instruct the members of the State Committee or other persons to examine directly at each university the issues within the competence of the State Committee and ask the authorities of the universities for the necessary explanations.
§ 2.
(1) The seat of the State Committee is Prague.
(2) Bratislava is the seat of the turnoff of the State Committee for Higher Education in Slovakia ("turnoff").
§ 3.
(1) Of the three Vice-Presidents of the State Committee, at least one of the sections for higher education and at least one of the sections for higher education.
(2) The Presidents of the sections shall be appointed by the Minister of Education, Science and Art from among the members of the Bureau of the State Committee (hereinafter referred to as the Bureau). The Sectoral Secretaries are appointed by the Minister of Education, Science and Art of the Section Members.
(3) The Bureau of Turnover shall consist of the President, the Secretary and one other member. The chairman and secretary of the detour shall be appointed by a representative of education, science and art from Slovak members of the State Committee. Another member of the Bureau shall elect a detour from their members.
(4) The Bureau shall appoint the chairmen of the expert commissions.
§ 4.
(1) The Plenary Session of the State Committee (hereinafter referred to as the "Plenary Session") sets out the work plan and oversees its implementation, discusses the essential issues of universities, outlines other work to the sections, turns and Bureau, talks about the activities of the Bureau as well as the reports and proposals of the sections, divergences and expert commissions presented to it by the Bureau.
(2) The Plenary Session shall determine the tasks and extent to which the sections and turnovers are to be dealt with separately and may authorise the Bureau to deal with certain matters to the extent specified.
§ 5.
(1) The sections are preliminary to discuss in their field the matters on which plenary sessions are to be held, dealing separately with the matters on which the plenary session has determined that they are to be dealt with separately (Section 4 (2)), as they concern matters which concern only higher education institutions or only higher education institutions of the artistic direction, which have been required by the plenary session (Section 4 (1)) and are discussing the initiatives which the Bureau has given them for preliminary consideration (Section 7 (1)).
(2) Reports of the activities of the sections as well as their proposals shall be submitted by the Presidents of the sections of the Bureau.
(3) The Section elects two members of the Bureau (Section 6 (4) of the Act).
§ 6.
(1) The department is an advisory, initiative and coordination body of the school, science and art director.
(2) The Plenary Session will determine the competence of the State Committee in higher education matters in Slovakia and the extent to which the turnoff operates separately (Section 4 (2)), as these are matters which require special adaptations in order to ensure the full development of the physical and spiritual forces of the Slovak people (Section 6 (2) of the Act).
(3) In other matters relating to universities in Slovakia, the turn is preliminary to discuss in its field the cases on which the plenary session is to be held, if requested (§ 4 (1)) or on its own initiative.
(4) The report on the activity of the detour, as well as its initiatives, shall be submitted by the President of the Bureau.
(5) The section elects a member of the Bureau to take turns (Section 3 (3)).
§ 7.
(1) The Bureau shall coordinate the activities of sections, divergences and expert commissions. In doing so, he shall, in particular, ensure that the ordinary tasks assigned to the State Committee by the Minister for Education, Science and Arts are carried out in a timely and proper manner. As a general rule, the initiative received shall give the relevant section or expert committee a preliminary discussion.
(2) The Bureau shall deal separately with ordinary cases and cases which it has empowered the Plenary Session to deal with (Paragraph 4 (2)).
(3) The Bureau shall set up expert commissions, appoint their chairpersons (Article 3 (4)), define the tasks of such commissions and manage their activities. If this is needed, representatives of the central authorities involved are also called to the expert committees.
(4) The Bureau shall prepare the meeting of the Plenary Session, report to it on its activities as well as on the reports and proposals of the sections, divergences and expert commissions (Sections 5 (2), 6 (2), 8 (2)) and implement the resolution of the Plenary Session. The negotiations are being prepared and its resolution is being carried out by the Bureau.
§ 8.
(1) The expert commissions carry out the work which has been ordered by the Bureau and for its management (§ 7 (3)) and discuss the initiatives which the Bureau has given them for preliminary consideration (§ 7 (1)).
(2) Reports of the outcome of the work shall be submitted by the Presidents of the expert committees to the Bureau.
§ 9.
(1) The President of the State Committee shall represent the State Committee on the External Borders, shall convene and prepare a plenary session together with the Secretary-General, shall direct it, submit its resolution to the Minister of Education, Science and Art (Section 13 (2)), shall convene and prepare a meeting of the Bureau together with the Secretary-General, shall manage and implement the resolution.
(2) The chairmen of the sections shall convene and prepare together with the Secretaries of the sections of the sections, manage them, implement their resolutions and report on the activities of the sections as well as on their proposals to the Bureau (Section 6 (2)).
(3) The President of the Diverts shall convene and prepare, manage, implement and report on the activities of the Diverts, together with the Secretary of the Diverts (Section 5 (3)).
(4) The chairmen of expert commissions shall convene meetings of expert commissions, prepare their deliberations, manage them and report on the outcome of the work to the Bureau (Section 8 (2)).
§ 10.
(1) The Secretary-General is the Executive Authority of the State Committee.
(2) Concept and office work for the State Committee is provided by the Ministry of Education, Science and Arts.
§ 11.
(1) Plenary sittings are generally non-public. The meetings of sections, digressions and the Bureau are also generally private.
(2) Plenary sittings shall normally be held every quarter of the year. Section meetings and turns are usually held every two months. The Bureau shall hold meetings as necessary.
(3) Extraordinary plenary sessions and extraordinary meetings of sections shall be convened when convened by the Minister for Education, Science and Art. Similarly, he calls an extraordinary meeting of the detour director of education, science and art.
§ 12.
(1) The Plenary Session is capable of a resolution if three fifths of the members are present. Meetings of sections, turnovers and the Bureau shall be able to vote if three-fifths of the members are present.
(2) A simple majority of the votes shall be required for the validity of the resolution.
§ 13.
(1) The Secretary-General shall notify the Ministry of Education, Science and Art and the delegation of education, science and art. The Ministry of Education, Science and Arts and the Board of Directors of Education, Science and Arts may send representatives to the plenary session who have an advisory vote.
(2) The resolution of the plenary session is presented by the President of the Minister for Education, Science and Art. If the resolution of the plenary sitting differs from the resolution of a section or a detour, a draft of the section or a detour shall also be submitted at the request of the President or the President.
§ 14.
The provisions on civil servants shall apply mutatis mutandis to the reimbursement of travel expenses and remuneration for the performance of special duties to members of the State Committee and to expert commissions as well as to remuneration for the performance of duties to members of the Bureau and to the secretaries of the sections.
§ 15.
Members of the State Committee and of the expert committees shall be obliged to keep secrets about matters which they have learned in the performance of their duties.
§ 16.
This Regulation shall enter into force on the day of its publication.
