on the addition and amendment of the Decree of the President of the Republic of 4 October 1945, No 105 Coll., on the Purgatory Committees for the Review of the Activities of Public Employees.
The Provisional National Assembly of the Czechoslovak Republic decided on the following Act:
The Decree of the President of the Republic No. 105 / 1945 Coll. is added and amended as follows:
1. the following sentence shall be added to Article 1 (2):
"Where this decree refers to public resting or provision salaries or to resting (provision) salaries, this includes in particular any provision benefits provided under military provision laws. '

"(4) The provisions of this Decree shall not apply to professional military gayists. ';
3. the following paragraph 5 (5) is added:
"(5) If recognised for one of the punishments referred to in paragraph 1, points (A), (3) to (6), (B), (a), (2) to (4), or (b), military rank may be withdrawn from military persons by administrative measures of the Minister of National Defence. In the case of major and sub-colonel, the withdrawal of military rank may be carried out only with the approval of the Government, with the approval of the Colonel and the generals only with the approval of the President of the Republic. The Deputy Director shall withdraw the military rank from the order of the Minister of National Defence. '
4. In Section 4, paragraph 7, the words "legal services' are deleted.
5. In Article 5, paragraph 3 is added after paragraph 2:
"(3) If the accused is the recipient of military provision benefits, at least one member of the cleansing and upper cleansing commission shall be taken from representatives of the military administration. ';
Paragraph 3 shall become paragraph 4.
6. In Section 7, paragraph 3 is inserted after the words "on the proposal 'of the word" disciplinary representative (§ 10) or on the proposal'.
(7) Paragraph 17 shall be added as follows:
"A disciplinary representative may lodge a complaint in accordance with paragraph 2b within 15 days of the receipt of the order directly from the Purgatory Board to the relevant High Purgatory Commission. '

"A complaint may be lodged against a resolution of the Purgatory Commission within 15 days of the receipt of the order directly from the Purgatory Commission to the relevant High Purgatory Commission. The lodging of a complaint shall not have suspensory effect. ';
9.
"(c) to the Ministry of National Defence, when accused of being a retired military officer, a military officer in reserve, a military staff member or a recipient of military benefits providing for any kind and provision of longer service and survivors (§ 15 (2))."
10. In the first sentence of Article 32, the words "31 March 1946 'shall be replaced by the words" 31 December 1946' and the following sentence shall be inserted after the first sentence: "The notification referred to in Article 15 shall be submitted by 30 June 1946 at the latest. '
This Act shall take effect on the day of its publication; it shall be carried out by all members of the Government.
