on protection zones of natural medical resources of the Bludov spa site
The Ministry of Health provides pursuant to § 46 (1) of Act No. 20 / 1966 Coll., on the Care of People, as amended by Act No. 548 / 1991 Coll.:
Preliminary provisions
(1) In order to protect the natural medical resources of the Bludov spa site, protection zones 1 and 2 are established.
(2) The first-degree protection zone consists of the territory in which the routes of exit of natural medical resources are located. The 2nd stage protection zone consists of an infiltration zone of the base structure of mineral waters north of the Bushinian turning point, which takes place in the area from the southern region of Bohtěn to the northern edge of Pošermov. It is divided according to geological conditions on parts A and B with different degrees of protection.
(3) The siting of the first-degree protection zone is graphically indicated in a copy of the cadastral map annexed to No 1 of this Decree. The position of the two protection zones is graphically marked on the map in the scale 1: 50 000, annexed to No 2 of this Decree.
Level 1 protection zone
(1) Level 1 protection zone (2)
(a) build or operate:
1. objects other than those required for the operation of natural medical baths or for the use of natural medical resources;
2. waste landfills, waste storage (3) and machinery fertilizers,
3. Parking not secured against oil losses into the field,
4. any objects in which oil, petroleum products, toxic or radioactive substances are handled;
(b) apply liquid ammonia fertilisers, cattle and pigs;
(c) discharge, discharge or drip liquids into soil or surface water which could adversely affect the quality of natural medical resources; 4)
(d) use chemical sprinkler materials which could cause contamination of natural medical resources;
e) park with motor vehicles outside the marked parking lot or closed garage.
(2) Level 1 protection zone (2)
(a) carry out:
1. drilling and tearing,
2. mining activity or activity carried out in a mining manner, (5) which is linked to interference with the land;
3. any construction activity;
4. the collection of water from a natural medical source above the values laid down in the decision authorising the use of the resource;
5. groundwater-free sampling;
(b) apply industrial and livestock fertilisers and chemical plant protection products;
if the Czech Inspectorate of Spa and Foundation ("the Inspectorate ') has not issued a positive binding opinion on these activities or the conditions laid down in that opinion have not been fulfilled.
Level 2 protection zone
(1) Part A in the protection zone (2)
(a) carry out:
1. large-scale shredding work, 8)
2. the extraction of the fluvial deposits of the river Moravia, except for the extraction permitted before the entry into force of this decree,
3. mining or mining activities, 5) which are linked to interference with the land, with the exception of exploration and exploitation of natural medical resources, 9)
4. extraction of raw materials using chemical technologies;
(b) to build and operate landfills and storage of all waste (3) and machined fertilisers.
(2) Part A in the protection zone (2)
(a) to make hydrotechnical adjustments to surface streams and ponds;
(b) use the fluvial floods of the river Moravia to take groundwater (10), with a reduction in the level of more than 5 m or in a quantity greater than 2 l / s for individual users;
where the inspectors have not issued a positive binding opinion on these activities, or the conditions laid down in that opinion have not been met.
(3) Part B of Part B of the protection zone (2) cannot be carried out by tearing work of a large scale (8) and extraction of raw materials using chemical technologies.
(4) Part B of the protection zone (2) cannot be carried out
(a) hydrotechnical treatment of surface streams and ponds;
(b) mining and mining activities, (5) linked to interference with the land;
(c) rock drilling and underground water10) from these rocks;
in the absence of a positive binding opinion on these activities, or the conditions laid down in that opinion have not been met.
Objects and activities still in operation on the territory which constitutes the protection zone 1 and the protection zone 2 shall be brought into line with the provisions of § 2 (1) (a) (2), (3), (4) and § 3 (1) (b) no later than two years after the entry into force of this decree.
This Order shall take effect three months after the date of its publication.
