THE LAW
of 7 January 1998
amending and supplementing Act No. 288 / 1995 Coll., on firearms and ammunition (Firearms Act)
Parliament has decided on this law of the Czech Republic:
Act No. 288 / 1995 Coll., on firearms and ammunition (Firearms Act) is amended as follows:
1. in § 3 (k), a comma is inserted after the word "frame" and the following words are inserted: "cylinder of revolver."
2. In Paragraph 16 (1), the words "established verification 'are replaced by the words" conformity assessment'.
3. In Article 16 (2), the words "to verify the competent state service (9) 'are replaced by the words" to assess conformity under a special Regulation (7)'.
4. Note 7:
"7) § 12 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Laws."
Note 9) is deleted.
5. In Paragraph 16 (3), the word "verified 'is replaced by" assessed'.
6. In Paragraph 16 (4), the words "to verify the competent national service 'are replaced by the words" to assess conformity under a separate Regulation, 7)'.
7. Article 17 (1) (a) reads as follows:
"(a) firearms of which the energy of the missile is at most 7,5 J and gas weapons of which the energy of the missile is at most 10 J,"
8. In Article 32 (1), the following shall be inserted after the words "he is entitled": "if he has a valid hunting ticket."
9. In Paragraph 41 (1), the dot at the end of the sentence is replaced by a comma and the following words are added: "unless otherwise provided for by this law."
10. In Paragraph 41, the following paragraph 2 is inserted after paragraph 1:
"(2) The lower age limit for issuing the A, B and C arms licence shall be 18 years, unless otherwise provided for in this Act. ';
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
11. in Article 41 (5), "2 and 3" is replaced by "3 and 4";
12. The following § 48a is inserted after § 48:
The district office shall notify the district police department immediately of the removal or termination of the hunting ticket. ';

Anyone who acquires ownership of a weapon and ammunition on the basis of an arms accompanying document for the permanent export of a weapon and ammunition (§ 58) shall be required to export them permanently outside the Czech Republic no later than five days after the acquisition of ownership of the weapon and ammunition. "
14. Article 62 shall be added to paragraphs 7 and 8 as follows:
"(7) The arms accompanying document shall be issued upon written request.
(8) In the application for the issue of an arms passport, the applicant shall indicate:
(a) personal data, travel document or identity card number, place of residence of the natural person or data identifying the legal person and its registered office;
(b) particulars identifying the weapon (type, manufacturer's mark, model (s), calibre and serial number of the weapon),
(c) data identifying ammunition (species, calibre and quantity);
(d) particulars of the type and quantity of dust free or black;
(e) an indication of the place from and to which the export and import of the weapon and ammunition or of the powder, free or black, or, where appropriate, of the places through which the transit of the weapon and ammunition or of the powder is carried out;
(f) the personal data of the person who will carry the weapon, ammunition or non-lethal or black powder across the Czech Republic '.
15. in Paragraph 84 (g), the dot at the end is replaced by a comma and the following point (h) is added:
"(h) arms accompanying documents for permanent export and permanent import."
16. The following Section 84a is inserted after Section 84:
The Ministry of Interior and Police of the Czech Republic shall provide data from the records kept under this Act to the competent national authorities only if it is necessary for the performance of their tasks under a special law and the competent authorities of foreign states, only if the international treaty to which the Czech Republic is bound so provides. "
1. The holder of Group C weapons licence, who does not have a valid hunting ticket at the date of application of this Act, is entitled to hold hunting weapons, hunting bullets and individual parts of these rounds for a period of one year after the entry into force of this Act. If he does not hold a valid hunting ticket within this time limit, he will dispose of the hunting weapons, the hunting rounds and the individual parts of those bullets he holds, according to the Firearms Act.
2. Any person who, on the date of the effectiveness of this Act, holds a firearm for which possession or wearing was not required under the existing regulations and under this Act is required to carry a firearm or firearm, shall be required to apply for the issue of the relevant firearm or firearm permit no later than four months after the entry into force of this Act.
This Act shall take effect on the day of its publication.
