Decree of the Ministry of Justice of the Slovak Socialist Republic on compensation to judges from the people

Ministry of Justice of the Slovak Socialist Republic
of 17 February 1970
concerning compensation to judges of the people
The Ministry of Justice of the Slovak Socialist Republic shall, in agreement with the Ministry of Finance, Labour and Social Affairs of the Slovak Socialist Republic and the Slovak Trade Union Council, provide for the Act No. 36 / 1964 Coll., on the organisation of courts and the election of judges, as amended by Act No. 156 / 1969 Coll.:
§ 1
(1) The State pays the non-employment judges *) the income which they have missed by performing the judicial function.
(2) If the judges of the people are employed in a proportion similar to the employment rate * *) under the Labour Code or other special regulations, they shall be compensated for in the amount of the average earnings. * * *)
(3) It is for judges of people who are neither in employment nor in a similar employment relationship, if they are employed, to make up for the loss of earnings at an amount determined on the basis of the average annual income of the previous calendar year. otherwise, the reimbursement of expenses incurred by them in respect of the performance of their duties as judges shall be subject to reimbursement.
§ 2
(1) The amount of the loss of earnings must be demonstrated by evidence of the organisation in which the judges of the people work, where appropriate, in which they are grouped together or which is a payment point for them; If there is no such organisation, the amount of the lost earnings must be demonstrated by confirming the local national committee in the municipality where the judge of the people resides.
(2) Where the Judges of the people referred to in Paragraph 1 (3) cannot be reliably established on the basis of the document submitted, taking into account the nature of their employment, the amount of the loss of earnings may be awarded, taking into account the overall proportions of the Judge of the people, but not more than 6 Ccs per hour and not more than 48 Cds per working day.
§ 3
The final expenses incurred by the judges of the people, i.e. travel, subsistence, bed and other expenses, shall be reimbursed in accordance with the rules on reimbursement of travel, removal and other expenses. The total expenditure is replaced by the State. When assessing the entitlement to reimbursement of such expenditure and determining the amount of the refund, the provisions applicable to workers in employment shall apply mutatis mutandis. †)
§ 4
The judges of the people shall be entitled, in addition to compensation for the loss of earnings and reimbursement of the final expenses, to a flat-rate refund for each day of their proceedings of 15 Ccs provided by the State.
§ 5
The exercise of judicial functions means, in addition to the conduct of proceedings, participation of judges from the people in training, assets and other actions relating to the function of judges from the people and belonging to their tasks.
§ 6
Compensation for loss of earnings and flat-rate compensation for actions shall be the functional benefit of the wage tax.
§ 7
The right to reimbursement of lost earnings granted by the State (§ 1), to reimbursement of final expenses (§ 3) and to flat-rate compensation (§ 4) must be exercised within 15 days of the judicial office of the administration of the court for which the judge is elected.
§ 8
Decree of the Ministry of Justice No. 64 / 1961 Coll., on refunds to judges who perform their duties in addition to their employment, will cease to be effective for the territory of the Slovak Socialist Republic.
§ 9
This Decree shall take effect on 1 March 1970.
