Budget Law 1958
of 16 April 1958
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1
State budget objectives
The funds shall be determined by the State budget as the basic financial plan of the State. Their source is mainly socialist production and the efforts of the working people. It serves for the economic fulfilment of all the tasks of the national plan for the development of the national economy, for speeding up the development of production forces, particularly in the heavy industry, for the substantial rise in agricultural production and for the development of single agricultural cooperatives, for the introduction of new technology into production, for the substantial increase in labour productivity and thus for the continued increase in the material and cultural level of the working people and for the promotion of peace-keeping efforts. In order to achieve these objectives, the active participation of the people as the sole economic and social owner of all national wealth in the management of the economy and the administration of the state to ensure the continued growth of national income needs to be increased.
§ 2
Determination of State Budget
(1) The total revenue of the state budget is determined by the amount of CZK 94.725,167.000, the total expenditure by the amount of CZK 94.530,552.000, resulting in a surplus of CZK 194,615.000; within the framework of the State budget, the revenue for Slovakia is determined by the amount of CZK 15.824,128.000 and the expenditure by the amount of CZK 17.516,836.000; The Slovak National Council may increase revenue above the fixed amount and by the same amount and expenditure.
(2) The national budget contains the budgets of the national committees whose revenue and expenditure amount to CZK 31.025,377.000; the balance of the budgetary appropriations to be transferred to the national committees until 1959 is fixed at CZK 441,800,000.
(3) In order to balance the budgets of the national committees, the Government provides for shares in state revenue.
§ 3
Management by State Budget
(1) Expenditure may be effected only up to the amounts laid down in the State budget.
(2) The Government may authorise the implementation of the expenditure necessary for the national economy and not covered by the State budget, provided that its reimbursement is ensured by higher revenue or savings on other expenditure in the State budget, or by delaying other, less urgent expenditure. Similarly, the Government may authorise a reduction in some of the national budget revenue if it exports such a reduction by increasing other national budget revenue or by reducing expenditure.
§ 4
Management responsibility
The Government and each member of the national committees, the Board of Directors and each member thereof, the heads of the other central offices and the Board of National Committees, as well as the Heads of Union and Board of National Committees, shall be responsible for ensuring that, in their field of competence, all the planned tasks are carried out economically, that the reserves in the emerging economy are identified and used, that the revenue of the State budget is at least achieved and that the expenditure is not exceeded, except in cases permitted under this law.
§ 5
Timing of appropriations
(1) Budget appropriations may be used only until the end of 1958 and only to cover expenditure due by the end of that year.
(2) The reimbursement of the expenditure which they have and may be effected under the provisions of this Act from the 1958 budget must not be deferred to the next year's budget.
(3) Referring to money to cover expenditure due after 31 December 1958 or creating any savings reserves on appropriations shall not be permitted.
§ 6
Detection of budgetary consequences of legal and other measures
(1) For draft laws, legal measures of the Bureau of the National Assembly, the laws of the Slovak National Council, government regulations, government resolutions, regulations of the board of delegates, resolutions of the board of delegates, regulations of the ministers, decrees of the mandates, decrees and all measures of the central authorities, as well as proposals of the resolutions of the national committees, and their advice, they must be considered with the utmost responsibility, and the consequences of their economic and financial consequences in the proposals. The consequences of these measures, in particular for expenditure, where appropriate, for State budget revenue, for population revenue and expenditure balance or for the credit plan, should be quantified and the calculation added to the draft measure. Each proposed measure must examine whether its nature permits the introduction of new budget revenue and, if so, the new revenue must always be proposed.
(2) At the same time, all the measures referred to in paragraph 1, which increase expenditure or reduce the revenue of the State budget, must provide for the payment of increased expenditure or the reimbursement of revenue loss.
§ 7
Inadmissibility of netting of claims against the State
The debtor may not pay his obligation to the State by offsetting his claim on the State.
§ 8
Supplementary budgets of national committees
(1) If the national committee has achieved, or has certainly achieved, higher revenue than its budget has set, or if it saves on budgeted expenditure, while carrying out all its planned tasks, it may draw up an additional budget.
(2) In order to obtain higher revenue as resources for complementary budgets, the national committees primarily develop services and local production, thereby creating conditions for further development of the economy and culture in their district and thereby extending their economic base.
(3) The supplementary budget must be balanced.
(4) The additional budget of the National Lower Level Committee shall be approved by the Board of the National Higher Level Committee.
(5) The Minister of Finance shall lay down the detailed arrangements by means of directives, which shall also lay down the procedure for the transfer of unused additional appropriations by next year. It may also allow a derogation from the provisions of paragraph 4 in the Directives.
§ 9
Interim management of state management in 1959
The Government shall take appropriate measures for the State's management between 1 January 1959 and the publication of the Budget Act for 1959, unless the Budget Act for that year is declared before 1 January 1959. Paragraph 4, 6, 7, 8 and 12 shall apply mutatis mutandis to this period.
§ 10
Guarantees to national committees
Paragraph 10 (2) of Act No. 83 / 1952 Coll., on the budgets of national committees, is deleted and replaced by the following:
"National committees may be guaranteed only for the liabilities of subordinate undertakings and only up to an amount commensurate with their income from economic activity; the details shall be adjusted by the Ministry of Finance. The national committees may be guaranteed other commitments only under special rules. '
§ 11
Long-term loan funds for production cooperatives
(1) Government Regulation No 108 / 1953 Coll., on long-term loan funds for production and consumer cooperatives, is repealed.
(2) The organisation, tasks and management of long-term loan funds for the organisation of production cooperatives are governed by the statutes issued by the Minister of Finance in agreement with the Chairman of the Central Association of Production Cooperatives for Funds in the Czech Regions and by the Finance Officer in agreement with the Chairman of the Slovak Association of Production Cooperatives for Funds in Slovakia.
Final provisions
§ 12
(1) The Government is hereby authorised to use the financial surplus of previous years to cover commitments made in previous years.
(2) The Minister for Finance is hereby authorised to:
(a) to issue guidelines for the management and control of the State budget, in particular as regards the use of budgetary appropriations, the reimbursement of expenditure on new tasks imposed on the national committees, the tying of budgetary appropriations to cover tasks which have been lost and the procedure for the reimbursement of expenditure on tasks which are not fully budgeted. In so doing, the Minister of Finance may allow a derogation from the provisions of Paragraph 5 (1);
(b) to regulate the use of overpaid profits and the payment of unplanned and overpaid losses by economic organisations in the State Socialist sector;
(c) provide for exemptions and derogations from the provisions of Act No. 106 / 1951 Coll., on the Financing of National and Municipal Enterprises, and from the Regulations issued under it, and provide that the provisions of those provisions shall apply to the other organisation of the socialist sector, to the extent they determine.
§ 13
This Act shall take effect on 1 January 1958; by the Minister for Finance and other members of the Government.
