amending Act No 221 / 1999 Coll., on professional soldiers, as amended by Act No 155 / 2000 Coll.
Parliament has decided on this law of the Czech Republic:
Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 155 / 2000 Coll., is amended as follows:
1. In Paragraph 165, the following sentence shall be added at the end of paragraph 5: "The beneficiary of a service allowance granted to him under the legislation in force before 1 December 1999 until 60 years of age shall, upon request, be paid a service allowance under the conditions laid down in the first sentence, up to a maximum of 60 years of age. No later than 60 years of age, he shall receive a service allowance under the conditions laid down in Paragraph 134. '.
2. The following Section 165a is inserted after Section 165:
Adjustment of payment of the service allowance
(1) The beneficiary of a service allowance granted to him under the legislation in force before 1 December 1999 to 60 years of age, which, at the time of 1 December 1999, had been reduced or stopped because he had reached the age of two years above the age applicable to the entitlement to an old-age pension, shall be granted a service allowance on the basis of his application at the earliest from the date of the limitation or cessation of payment, plus any increase under Paragraph 137 which would have been due to him from that date. No later than 60 years of age, he shall be entitled to a service allowance under the conditions laid down in Paragraph 134.
(2) If the beneficiary has received an old-age pension for the period of limitation or cessation of payment of the service allowance referred to in paragraph 1, the oldage allowance shall be granted to him, on application, from the date of the limitation or termination of payment, equal to the difference between the old-age pension and the service allowance calculated in accordance with paragraph 1, if the latter is higher. "
Efficacy
This Act shall take effect on the day of its publication.
