DECLARATION
Ministry of Food Industry
of 19 June 1964
on the issue of basic conditions for the supply of food and certain other products
The Ministry of Food Industry and the Ministry of Health, in agreement with the participating central authorities and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides for Section 392 of Economic Code No. 109 / 1964 Coll. ("the law '):
Scope
This decree regulates the supply of food and other products produced by food industry, tobacco products and mineral waters; However, it shall not apply to supplies for export and from imports and to direct supplies to public and cooperative retail organisations. *)
Conclusion of contracts
(K § 153 of the Act)
1. The contractor shall submit a draft contract (order) in duplicate at the latest:

In the draft contract, the customer shall define the subject matter of the transaction by detailed assortment and packaging and shall also indicate the relevant product list item.
2. The contractor is obliged to comment on the draft contract within 10 days (if the supplier is n.
3. Where a detailed range is agreed at quarterly contract negotiations, the registration of such negotiations shall be, if it contains the elements of an economic contract and is signed by the customer and the supplier, the contract or, where appropriate, the supplement thereto. The contract shall be held no later than 35 days before the beginning of the quarter.
4. A supplier with a customer or their superior authorities may agree that for certain products a contract is concluded only on the items of the list of products with the allocation of the quarterly quantity per month (for wines with quality classes); the specification necessary for delivery (detailed assortment and packaging) shall be agreed by the organisation no later than 20 days before the beginning of the month in which delivery is to take place.
5. In cases where the quantity and range of products are determined for each quarter or month by the operational schedules carried out by the superior authorities or, where appropriate, by the national committees, these schedules are imposed on suppliers and customers by commitments within the meaning of Section 117 of the Act.
Quantity
(K § 175 of the Act)
1. The quantity shall be determined in units according to the list of the Ministry of Food Industry and the Ministry of Health. The quantities delivered for each consignee may deviate by a maximum of ± 5% from the quantities specified in the appeal or available for transport.
2. The minimum dispatch quantity is set out in the Annex; does not apply to deliveries from Mr Řempo. Organisations may agree on other minimum quantities if the products are supplied on pallets.
Transport disposition
(K § 189 of the Act)
Unless otherwise assessed by the organisation, the customer shall deliver the transport disposition to the supplier in two copies; if non-food products (including feedingstuffs) are carried out on a quarterly basis, not later than the fifth day of the month preceding the quarter in which delivery is to be made; if foodstuffs, mineral waters, extracted scrap and tobacco products are taken monthly, no later than the 12th day of the month preceding the month in which the delivery is to take place.
Delivery periods
(K § 187 of the Act)
1. Fish products are supplied in regional cities and in agreed industrial places three times a week; in other places twice a week. Smoked fish must be delivered no later than Friday unless otherwise assessed by the organisation.
2. In the case of mineral waters, the buyer is entitled to set delivery times for each consignee in the transport by such a way that 50% of the total monthly quantity of products must be delivered by the 15th day of the month and the remainder by the end of the month; the buyer is obliged to comply with the minimum quantities specified.
Transport
(K § 180 of the Act)
1. If the customer ensures the transport of vegetable edible fats with less than 42 days warranty time, the supplier will pay the transport costs according to the ČSAD tariff.
2. Shipments carried by means of means of transport of the supplier shall be placed on the entrance ramp or on a ready-to-use trolley to the entrance of the warehouse where the means of transport is available. During transport by means of means of transport provided by the customer, the supplier is obliged to transfer the consignment to the entrance ramp or load it without settling it on the means of transport. Products may only be supplied on pallets if agreed upon by the organisation; where supplies are carried out in such a way by means of means of transport of the supplier, the customer shall provide the supplier with a pallet trolley including operator for unloading.
3. The supplier may, after prior notice, supply the customer with means of transport at his choice, although he was obliged to do so under contract or appeal.
Samples
(K § 181 of the Act)
1. The supplier shall submit samples to the customer as a basis for the quality assessment, where the customer requests them in the draft contract. The supplier is obliged to send a sample to the customer within 5 days of the inception of the contract. The collector shall be obliged to comment on it within 5 days of its delivery; If they do not do so, they shall pay the sample for the approved sample.
2. For internal trade supplies where samples are required by the superior customer authority, samples shall be sent to that authority. The competent authority of the buyer shall approve the samples in a quantity corresponding to the number of customers. Confirmed samples shall be sent by the supplier to the customers.
Verification of filling
(K § 193 of the Act)
1. If the customer finds a defect of quantity or quality, he shall be obliged to notify the supplier by telegram or telephone without undue delay and at the same time invite him to participate in the compilation of the registration and sampling. If a supplier fails to make a registration, the customer must invite the social inspection body or any other impartial person to draw up the registration and take samples.
2. If quality defects are ascertained, the beneficiary shall immediately take three samples in accordance with the provisions of the relevant technical standard and, failing that, in the usual manner. Those samples shall be signed by the persons who took part in their collection. One of the samples shall be retained by the customer and two shall be submitted to the supplier at the same time as the claim. In the complaint, the customer shall also indicate how and in what quantities samples were taken. If there is no agreement between the organisations to settle the complaint, the supplier shall send one sample with the registration and quality certificate to the central (Slovak Regional) inspectorate of the State Inspection of Quality Products of the Food Industry, Prague (Bratislava) and, for mineral waters, to the Research Institute for Physiatry, Balneology and Climatology of the Mariánska Spa (Prague branch) or to the laboratory agreed upon by the organisation; simultaneously notify the customer. The test result is binding on both organisations. The supplier shall inform the customer of the result of the analysis without undue delay. The costs of the assessment shall be borne by an organisation in the absence of which the assessment (analysis) has been submitted.
3. When the alcohol is withdrawn, the customer must first establish the integrity of the conclusion; the gross weight of each consignment must be checked before removing the seal. It is also required to determine by individual containers the apparent tightness (temperature of alcohol from net weight and from actual tightness of alcohol according to reduction tables). The sum of the whole quantity of alcohol shall be rounded to the nearest litre. Before detecting apparent tightness and temperature of the alcohol, the recipient is required to mix the contents of individual containers properly. If the consignments of alcohol transported by rail result in damage (losses), the damage must be confirmed by the entry of the railway station of destination with an accurate description of how it occurred. A copy of the entries shall be sent by the customer to the consignor. The suspended alcohol or bulkheads shall be kept in sealed containers in which they were transported until the supplier arrives for the enrolment and sampling.
4. In the case of the collection of spirit drinks transported in transport cabinets, the customer shall invite the social inspection body or other impartial person to open these cabinets.
Complaints
(K § 198 and 200 of the Act)
1. The warranty period is set out in technical standards; if it is not so determined, it shall be 6 months after delivery.
2. In the case of products that are quickly spoiled, the customer will prove defects, which are already evident at the time of collection from the transmitting organisation, as a general rule only if he proves the deadlock of the delivery by registration in accordance with Section 194 of the Act.
3. A copy of the claim shall also be sent by the customer to the consignor (establishment, plant); failure to comply with this obligation shall not result in the loss of liability rights.
4. Weight losses, up to the level of the permissible pass laid down in the railway timetable for bulk products, cannot be claimed by the customer.
Packaging
(K § 179 of the Act)
2. The collector is obliged to return the empty typical bottles to the supplier continuously during the quarter in the same types in which the bottles were supplied full. Bottles with cork inside or with the rest of the cap on the throat or bottles not sorted by species need not be taken by the supplier from the customer; If they are overpaid, the customer invokes the supplier (s) the price of the bottle reduced by 10 cents per unit.
3. Each consignment of returned packaging (including bottles) must be notified in advance to the consignee and accompanied by a document stating the address of the consignor and the number of packages by species; If the consignor fails to fulfil this obligation, the quantity of packages determined by the consignee shall be deemed to have been returned.
4. Deliveries in bulk shall be provided by the supplier with gardening as required. When using the supplier's garages, the customer is obliged to return the garages to the supplier on a paid basis within 20 days of the date of delivery of the products for transport.
5. Where a mineral water supplier uses protective covers or mats during dispatch, the buyer shall return them to the supplier for his cargo no later than 3 days after the receipt of the consignment. The repayment period shall be respected if the covers or mats are returned or reported to the public carrier no later than the last day of the deadline, the date of the declaration to the importer shall be indicated in the transport document.
7. The costs of transporting bottles shall be borne by each of the two organisations in one direction.
(K § 174 of the Act)
If there is a change in the retail price, the customer may not exclude the indication of the original retail price on bottles delivered within one month of the date of the change in the price. The changed prices are marked on the packaging within one month by the buyer.
(K § 178 of the Act)
The supplier is obliged to supply products to state-owned enterprises in the following packaging:
(a) in packages of not more than 50 kg - for flour, milling products, sugar, crystal, poppy and rice (except rice on importation);
(b) in a package of not more than 25 kg - for cube sugar, groats, meal and pasta;
(c) sugar hygienically packaged in the quantities specified in the price lists.
Specific provisions
1. In order to improve the supply of citizens and to speed up the journey of goods, deliveries from production plants directly to shops should be made where conditions are in place, in particular for flour, sugar, pasta, wine, etc. In such cases, the organisation shall agree on the designation of the stores, the quantity of products and the delivery plans.
2. Vegetable edible fats may not be sold in the store after the guarantee period has expired. The collector may return vegetable edible fats for which the guarantee period has passed; not more than 10% of the quantity delivered in the previous month for the price initially charged; other vegetable edible fats may be returned only if they are evaluated by the authorities superior to the supplier and the customer at the price of the raw material. The costs of the return shall be borne by the customer.
Property sanctions
If the customer does not return the payment within the prescribed period, the supplier shall be entitled to charge the customer with a property penalty of 20 Kčs per head per day but no more than 200 Kčs.
This Decree shall take effect on 1 July 1964.

Minimum shipping quantity delivered by one establishment or establishment to one consignee.
1. When supplying goods by rail, the customer is obliged to submit appeals to the supplier within the minimum quantity and amount of funds allocated to the relevant supplier plants or establishments for the respective customer plant in order to enable the supplier to pool consignments and use the loading area or weight of railway wagons according to the ČSD freight tariff.
2. For each type of goods, the minimum dispatch quantity shall be fixed as follows:
(a) for products of the fat industry:

When delivered in barrels, the minimum quantity shall be 10 tonnes; if the quarterly need for this quantity is not reached, it shall be sent to the customer by one consignment per quarter, at least one original package (about 180 kg) or multiple of it.

The minimum quantity shall be valid for each species of listed groups. Individual species may be grouped when they are produced by the sending plant of the supplier. If the monthly need for each species is less than the minimum quantity laid down, the buyer shall be obliged to merge the following needs into one place and one consignment to the customer's undertaking, unless the combined consignment reaches a minimum quantity, it shall be dispatched once per quarter:

If a combined consignment from a single production plant does not reach the minimum quantity specified per beneficiary, the minimum combined consignment shall be dispatched at the national wholesale price of Kčs 5000 or Kčs 15,000 at the retail price once per quarter; in this consignment, at least one original package or multiple of each species is supplied.
(b) In the case of alcohol and distillery:
for alcohol generally denatured with a degree of 92 ° vol 281 l alcohol,
for other types of alcohol 25 litres, unless the annual planned quantity is lower,
in the case of a lump of 1 hl alcohol, if the annual planned quantity is not lower;
(c) in the case of spirits, fermented vinegar, yeast, starch products and potato flakes.
(aa) for spirit drinks and vinegar of fermented spirit;
potable spirits, provided they are delivered from the same production plant in a quantity of 500 litres, otherwise as agreed,

Deliveries which would not achieve a minimum quantity will be managed at one branch or store of the customer or will be made provided that the customer pays the increased costs, unless otherwise specified in the wholesale price list. One transport original package shall not exceed 40 kg.
Consignments in excess of the quantities referred to in paragraph cc shall be rounded to the nearest higher weight of the original package.
Note: a delivery shall be made through Rempa, the retail outlets, if the quarterly need for starch products does not reach the following quantities:

When purchasing the customer's own cars, the minimum quantity shall be reduced to 1 original transport package;

The minimum quantity for consignments is set at 10 original packages (cartons, boxes and cans). However, where the monthly consumption of one consignee is lower, the minimum quantity shall be that of the monthly consumption of one consignee, but not less than one original package;
(h) for coffees:
The minimum quantity of all types of coffees together, which can be withdrawn for submission in individual deliveries, shall be 1 wagon with full use of its loading area. If the monthly need for the consignee does not reach this quantity, his monthly need must be withdrawn for a single consignment, but at least 4000 kg. Where the one-month consumption of one beneficiary is less than 4000 kg, the delivery shall be made according to the customer's availability to the joint beneficiary, the supplier covering the necessary costs of redispatching each beneficiary, but not more than the car transport tariffs, unless the parties decide otherwise in specific cases;
(i) for pasta, breadcrumbs, dumplings, water biscuits and baby meal:

The supply of natural mineral waters referred to in points (a) and (b) may be combined in one consignment of a total minimum weight of 12 000 kg, provided that they are dispatched from one dispatch point to one consignee. In the case of consignments delivered by cars, the minimum quantity of vehicle size and capacity shall be the same.
3. For deliveries to stores (via wholesale), the minimum dispatch quantity shall be as follows:
