GOVERNMENT REGULATION
of 19 June 2018
amending Government Regulation No 74 / 2017 Coll., laying down certain conditions for granting aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No 74 / 2017 Coll., laying down certain conditions for the granting of aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, is hereby amended as follows:
1. in Article 1 (b), the words "and medium-term" shall be deleted;
2. in Article 2 (1) (b), the words "packed fruit and vegetable juices and fruit purges" are replaced by the words "packaged fruit purée and mixtures of fruit-vegetable purée containing at least 50% of the fruit component (" fruit purée ") and packaged fruit and vegetable juice."
3. In Article 2 (2) (c), the word "printed 'shall be inserted after the words" action and'.
4. In Article 2 (3), the words "the supply of the products referred to in Article 1 (a) and (b) or at the time 'are deleted.
5. in Article 5 (1), the following point (h) is inserted after point (g):
"(h) a package of sour milk product with a protein content of more than 5,6% of a minimum weight of 140 g,"
Points (h) and (i) shall be renumbered as points (i) and (j).
6. In Article 5 (2), the words "and unflavoured dairy products referred to in Article 23 (4) (b) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, 'are deleted.
7. In Article 6 (4), the words "milk or 'are deleted.
8. In Article 7 (3), the words "including, where appropriate, a draft of printed educational material 'shall be inserted after the words" school year'.
9. In Article 9, the sentence "The authorised applicant who directly supplies or controls the supply of organic products shall not be added at the end of paragraph 6 to the aid application for the next delivery period to the documents referred to in the first sentence unless they have been amended. '
10. In Annex 2, Group 1 reads:

Transitional provisions
1. Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation, shall apply to the application for aid for products for the school year 2017 / 2018.
2. This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
3. The application for approval of an aid applicant for the school year 2018 / 2019 pursuant to Article 6 of Government Regulation No 74 / 2017 Coll., as effective from the date of entry into force of this Regulation, shall be submitted by the applicant to the Fund on the form issued by him by 1 August 2018.
4. An application for a change in the range of products supplied or an application to modify the composition of the product delivered for the school year 2018 / 2019 pursuant to Article 7 (4) of Decree No 74 / 2017 Coll., as effective from the date of entry into force of this Regulation, shall be submitted by the applicant to the Fund on the form issued by it by 1 August 2018.
Efficacy
This Regulation shall enter into force on 1 July 2018.
