of 22 April 2010
on the competence to label dogs by tattoo
The Ministry of Agriculture provides, pursuant to § 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 162 / 1993 Coll., Act No. 77 / 2004 Coll., Act No. 312 / 2008 Coll. and Act No. 291 / 2009 Coll., ("the Act ') for the implementation of Section 7 (5) of the Act:
§ 1
Subject matter
This decree regulates the content, scope and organisation of training with a focus on dog marking by tattoo, method and organisation of the verification of acquired knowledge, certification and maintenance of the list of persons who have received this training.
§ 2
Training with the focus on dog tagging
(1) Training with a focus on dog tagging (hereinafter referred to as "training") is provided by a university with a veterinary study programme (hereinafter referred to as "training centre"). The list of training centres is published by the Ministry of Agriculture in a way that allows remote access.
(2) Training takes place within the scope of 4 teaching hours of theoretical teaching and 2 teaching hours of practical teaching. The duration of the lesson is 45 minutes.
(3) The content of the training is:
(a) the provisions of the law, implementing legislation issued and the selected parts of the legislation relating to the marking of dogs by tattoos, in particular veterinary legislation, legislation governing the organisation of work and working procedures, which the employer is obliged to ensure in the course of work relating to animal husbandry, legislation governing infringement and administrative delicacies, criminal code and civil code;
b) the principles of anatomy and physiology of dogs with a focus on the body landscapes in which tattoos are carried out, i.e. earplugs and weaknesses;
(c) the technique of carrying out dog markings by tattoo and use of equipment for handling dogs;
(d) principles of labour safety when marking dogs with tattoos;
(e) knowledge of transmissible diseases in dogs.
(4) Animal handling is not part of the training and testing.
§ 3
Method and organisation of knowledge verification
(1) At the end of the training, the examination shall be carried out in the form of a practical examination, a written test and, where appropriate, an oral examination. In the practical test, the participant must demonstrate knowledge of the technique of marking dogs by tattoo and use of equipment for handling dogs. For a successful practical test, it is necessary to perform the marking correctly by tattoo and proper use of dog handling aids. The outcome of the practical examination shall be decided by the examination committee by voting. The written test shall be evaluated by the Examination Committee by assessing each correct response with one point. For a successful written examination it is necessary to achieve at least 80 percent of the total number of points. If the participant does not reach 80 per cent of the points but reaches more than 60 per cent of the points, he shall be invited immediately to the oral examination before the examination committee, which, according to the knowledge of his expertise, will decide whether to issue a certificate of aptitude for dog marking by tattoo. In order to pass the test successfully, at least 80% of the total number of points in the written test and, where appropriate, the successful completion of the oral examination, and the successful completion of the practical examination, shall be achieved. The test result is evaluated by a word that has succeeded or failed.
(2) The examination shall be carried out by a three-member examination panel composed of experts from veterinary administration and training centre. The Chairman of the Examination Board shall always be an employee of the Veterinary Administration, who shall be qualified under Article 26 (1) of the Act and professional practice in the field of animal protection and welfare in the animal protection bodies referred to in Article 19 (1) (a) or (b) of the Act for at least 3 years. Other members of the examination committee must be qualified in accordance with § 26 (1) of the Act or the higher education of the veterinary direction or at least 3 years of experience as a teacher of veterinary articles.
(3) A report shall be drawn up by the Examination Panel on the course and outcome of the examination, indicating the name and / or names of the members of the Examination Board, the date and place of the examination, the identification data of the participants in the training and the results of their evaluation. The protocol shall be signed by all members of the examination committee. The protocol shall be registered and kept at the training centre for a minimum period of 5 years.
(4) A training participant who has succeeded in the examination will issue a certificate of competence for dog marking by tattoo. The model of the certificate of aptitude for dog marking is set out in the annex to this decree.
(5) A trainee who has failed the test may request a repetition of the training not later than 3 months from the date on which he was notified that he had failed the test. The training participant may repeat the exam at least 1 month after the failure to pass the exam. For repeated testing, paragraphs 1 to 4 shall apply mutatis mutandis.
(6) A trainee who has failed the test and has not applied for it to be repeated no later than 3 months after the date on which he was notified that he has failed the test, as well as a trainee who has failed the repeat test referred to in paragraph 5, shall be retrained before the next test.
§ 4
Recognition of qualification and differential test
(1) If the recognition body only partially recognises the professional qualification under another legislation1), the candidate may pass the differential examination before the Examination Board.
(2) In the case of a differential test, the tenderer is not tested from those areas referred to in Section 2 (3) in which he has been recognised as a professional qualification.
(3) Paragraph 3 (1) to (4) shall apply mutatis mutandis.
(4) The candidate who has failed the test will receive training before the next test. The candidate may repeat the test at least 1 month after failing to pass the test. Paragraph 3 (1) to (4) shall apply mutatis mutandis to the repeated test.
§ 5
Keeping a list of training participants who have completed training
(1) The training centre shall keep in electronic form a list of training participants who have completed the training (hereinafter referred to as "the list").
(2) The list contains the following information:
(a) the title, the name and, where applicable, the names and surnames of the trainee, the date and place of birth of the trainee;
(b) the date and result of the test referred to in § 3 or 4;
(c) the registration number of the certificate of aptitude for dog marking by tattoo.
(3) The entry in the list shall be carried out by the training centre without undue delay after the examination has been evaluated by the examination committee, but no later than 10 days from the date of evaluation by the examination committee.
§ 6
Efficacy
This Decree shall take effect on the 15th day following its publication.
