Ministry of Interior
of 19 April 1993
implementing the Civil ID Act
The Ministry of Interior provides, pursuant to Section 13 of Act No. 75 / 1957 Coll., on Civil ID, in agreement with the participating central authorities:
Documents needed for issuing the identity card
§ 1
(1) The basis for the issue of the first ID card to Czech citizens (hereinafter referred to as "citizens") at the age of 15 years is:
(a) birth certificate;
(b) two photographs;
(c) certificate of residence issued by the competent authority, 1)
(d) proof of birth number, (2) if the birth number is not indicated on another document presented,
(e) birth certificates of parents or marriage certificates of parents.
(2) The basis for the issue of the first identity card of a citizen after the return of eligibility for legal acts is:
(a) the birth certificate or the birth certificate and the birth certificate;
(b) two photographs;
(c) a final decision by the court on the recovery of legal capacity;
(d) certificate of residence issued by the competent authority, 1)
(e) proof of birth number, (2) if the birth number is not indicated on another document presented;
(f) proof of family status, if the citizen is married, divorced or widowed,
(g) birth certificates of parents or marriage certificates of parents.
(3) The basis for the issue of the first identity card of a citizen following the acquisition of citizenship by a declaration, grant or choice in accordance with special regulations, 3) or for the issue of the first identity card after the end of the permanent residence abroad, shall be:
(a) the birth certificate or the birth certificate and the birth certificate;
(b) two photographs;
(c) proof of citizenship issued under special regulations, 3)
(d) certificate of residence issued by the competent authority, 1)
(e) proof of birth number, (2) if the birth number is not indicated on another document presented;
(f) proof of family status, if it is a citizen who is married, divorced or widowed.
§ 2
(1) The basis for issuing a new identity card is its current identity card and two photographs; if the surname is not indicated on the current identity card, the birth certificate or the birth certificate and the birth certificate shall also be provided.
(2) In addition to the documents referred to in paragraph 1, in addition to the documents referred to in paragraph 1, proof of such amendment is the basis for the issue of a new identity card where it is justified for the issue of an amendment to one of the entries entered in the identity card.
(3) (4) In addition to the documents referred to in paragraph 1, proof of that information shall also be provided for the issue of a new identity card if the reason for its registration is the entry.
(4) In addition to the documents referred to in paragraph 1, the final decision of the court to restrict or restore legal capacity shall be the basis for the issue of a new identity card to a citizen who has been restricted or returned to legal proceedings; data on the limitation of the citizen's legal capacity shall be entered in the section for special records.
(5) The basis for issuing a new identity card to a citizen to whom a prohibition of residence has been imposed or for whom the prohibition of residence has been enforced, or where that sentence or the rest of it has been waived, shall be a final judgment of the court confirming those facts; data on the execution of the residence ban are entered in the section for special records.
(6) The basis for issuing a new identity card shall be:
(a) a certificate of surrender, loss or theft of the identity card;
(b) the birth certificate or the birth certificate and the birth certificate;
(c) two photographs,
(d) certificate of residence issued by the competent authority, 1)
(e) proof of family status, if the citizen is married, divorced or widowed,
(f) birth certificates of parents or marriage certificates of parents.
(7) In addition to the documents referred to in paragraphs 1 to 6, the document of the birth number shall also be the basis for the issue of a new identity card if the birth number is not shown on another document submitted.
§ 3
(1) If, at the time of the issue of a new citizenship card, a citizen simultaneously applies for the registration of an academic degree, academic degree or other degree of graduate of a higher education or the designation of a graduate of a higher vocational school, 4a) who did not have an existing citizenship card, the relevant document, such as diploma, university certificate, proof of the composition of the national rigorous examination or rigorous examinations (5) or a certificate of the discharge of the higher vocational school shall be presented. (a) There is only one title to be written before the citizen's surname. At the request of a citizen, other degrees and titles of a graduate of a higher vocational school are entered in the section for special records.
(2) Where a citizen requests, when issuing a new identity card, the entry of data on serious diseases which, under certain circumstances, require the immediate administration of medicines or the provision of other first aid, the entry of blood group or sub-group data which he did not have on his current identity card, he shall submit a medical certificate on such matters; the details are entered in the section for specific alerts.
§ 4
(1) A extract of the special matrix shall be presented instead of a matrix document issued by a foreign authority. 6)
(2) If a decision of the foreign court is submitted in support of the information entered in the ID card, the decision of the Supreme Court of the Czech Republic on recognition of the decision of the foreign court in the territory of the Czech Republic shall be submitted together with such decision if that recognition is necessary under the law. 7)
(3) The documents necessary for the issue of the identity card shall be presented in the original or certified copy (certified photocopy); for foreign language documents, a certified translation into the Czech language is submitted.
(4) Where it is necessary to submit a final judgment to the court in order to substantiate the information entered in the identity card, that decision shall be accompanied by a legal clause.
(5) If there are doubts as to the citizenship of a citizen before the issue of the identity card is issued, the document on citizenship issued under the special legislation.3)
(6) Photographs required for the issue of a card must be sharp, unprinted, made from the same negative on a smooth shiny half-carton or made with a simultaneous multiple lens exposure of 35 × 45 mm, showing the citizen in front view with a height of the face of the head from the chin to the chin of at least 13 mm, without glasses with dark glasses except blind and without the headgear, unless the use is justified by reasons of religion or health; However, the headgear shall not cover the facial part in such a way as to prevent the identification of the citizen.
(7) The documents required for the issue of the identity card may be presented by the authorised representative as a citizen.
Issue and surrender of civil certificates
§ 5
The citizen's ID card is issued to the District Directorate of the Police of the Czech Republic (hereinafter referred to as the "Police Authority '), in whose district the citizen is reported for permanent residence.
§ 6
The citizen shall confirm the receipt of the identity card and the accuracy of the information contained therein by his signature; at the same time, the documents submitted shall be returned to the citizen, with the exception of the current identity card or certificate of surrender, loss or theft of the identity card.
§ 7
(1) A citizen's card which has been deprived of legal capacity by a final decision of the court shall be handed over to the police authority responsible for the place of permanent residence of such a citizen.
(2) The deceased's identity card shall be handed over to the police authority responsible for the last place of residence of the deceased or to the office in charge of the mantle; the office responsible for the management of the register shall immediately forward the identity card to the police authority responsible for the last place of residence of the deceased.
(3) A citizen's citizenship card which has ceased permanent residence in the Czech Republic and an ID card whose holder has lost citizenship of the Czech Republic will be taken over by the police authority responsible for the last residence of such person in the Czech Republic.
§ 8
A citizen's identity card shall, at his request, be taken over by the police authority responsible for the permanent residence of such a citizen for the duration of his long stay abroad and shall issue a certificate thereof.
Provisions common, transitional and final
§ 9
(1) In the documents issued before 30 April 1993, the authorities responsible for the specific regulations (8) and the police authorities shall enter the particulars and, where appropriate, their amendments. evidence of such data or changes thereto shall be provided by the police authorities.
(2) The authorities of the police and the authorities responsible for the management of the register shall enter data on citizenship in the identity cards issued by 30 April 1993. If there is doubt about the citizenship of a citizen, the document on citizenship issued under the special legislations.3)
§ 10
The model of the ID card is set out in the Annex to this Order.
§ 11
Decree No. 119 / 1984 Coll., implementing the Civil ID Act, as amended by Decree No. 178 / 1988 Coll. and Decree No. 125 / 1991 Coll., is hereby repealed.
§ 12
This Decree shall take effect on 1 May 1993.
