implementing the Social Security Act
The Federal Ministry of Labour and Social Affairs provides, pursuant to § 172 (1) to (5) of Act No. 121 / 1975 Coll., on Social Security (hereinafter referred to as the "Act '), in agreement with the Federal Ministries of National Defence, Interior and Agriculture and Nutrition, with the Ministries of Labour and Social Affairs and Justice of the Republics, with the other central authorities involved and with the Central Council of Trade Unions, and in agreement with the Ministries of Culture of the Republics and according to the principles laid down by the Government of the Czechoslovak Socialist Republic:
Work applications
C § 85 and 87 of the Act
(1) The selection of suitable jobs for citizens with altered working capacity is carried out by a qualified worker, appointed by an organisation, with a racing district doctor or, where appropriate, with a local district doctor or with another doctor designated by the Director of the District Institute of National Health, with the participation of an official of the basic organisation of the Revolutionary Trade Union Movement and, where appropriate, a similar body of the members of the production cooperative and, if applicable, a single agricultural cooperative, with the participation of a member of the social committee of that cooperative; a representative of the National Committee may always participate in such selection.
(2) An employment plan for citizens with altered job capacity shall be set by the competent national committee each year by the organisation of how many people with altered work capacity are obliged to employ in total in appropriate jobs; taking into account the needs of the national economy and local conditions. Central authorities, national committees, courts, prosecutors, budgetary organisations of federal ministries of national defence and home affairs, ministries of the interior and justice of the Republics and social organisations are not provided for in the employment plan of citizens with altered working capacity.
(3) Technical and organisational measures ensure, in particular, the necessary adjustment of working conditions (such as employment for shorter working hours), the adaptation of workplaces, the establishment of sheltered workshops (workplaces), the preparation for the working use of citizens with altered working capacity and the improvement of their qualifications in the performance of their regular employment.
(4) The national committees, in cooperation with the bodies of the cooperative production sector, ensure that the composition of the member base in the disability cooperatives corresponds to the model statutes; In cooperation with the institutions of the disabled associations, they shall ensure that in their economic establishments citizens with a reduced working capacity with disabilities (Section 88 of the Act) are mainly employed and that other workers are employed in such establishments only if necessary to operate.
Reinsurance
Article 86 of the Act
(1) In deciding on the organisation's proposal to grant prior consent to the termination of employment by a citizen with altered capacity, the Regional National Committee (44) shall, in particular:
(a) whether the worker can be transferred to another suitable post in the organisation, where appropriate after prior preparation for the work use;
(b) whether the worker can obtain suitable employment in another organisation;
(c) the social circumstances of the worker.
The National Committee may require the organisation to carry out appropriate measures to allow a citizen with a changed working capacity to remain in employment.
(2) The organisation shall notify the national committee in advance of the termination of the employment relationship with a citizen with an altered capacity of work, other than by denunciation of the organisation, and of the reasons therefor.
(3) An organisation in which a suitable place is situated (§ 132) may refuse to engage in an employment relationship with a citizen with an altered capacity as recommended by the National Committee only if:
(a) the citizen does not have the expertise required by the nature of the job and the organisation is unable to provide him with training for work; or
(b) it does not fulfil the other conditions required by the nature of the work and work, or
(c) his acceptance would be contrary to the general provisions on employment.
(4) The organisation shall inform the national committee of the reasons for which it has refused to negotiate an employment relationship with a citizen with an altered job capacity who has been recommended to it for admission. If the national committee does not agree with the reasons for the rejection, it shall decide on the obligation of the organisation to admit a citizen with an altered working capacity to work. 45)
Youth care
K § 87 of the Act
(1) Organisations are required to accept, as a priority, young people with altered work capacity to posts reserved for young people. Schools shall be recruited preferably by youthful citizens with altered working capacity, in accordance with the recommendation of the National Committee, provided that adolescents meet the other conditions for admission to study.
(2) Teenage citizens with altered working capacity shall be provided free of charge for meals and / or housing while preparing for work in training centres or facilities of national committees.
Obligations of organisations
Article 90 of the Act
(1) The organisation shall, as a priority, complement the status of its skilled staff to citizens with altered working capacity, which have been provided with preparation for work.
(2) Organisations give priority to domestic and occasional work to citizens with altered working capacity.
(3) The organisation is obliged to notify within 3 days the relevant national committee of the negotiation and termination of the employment relationship with a changed working capacity citizen; within the same time limit, it shall notify the vacancies listed in the list of suitable posts for citizens with altered capacity of work and within 8 days of the date of receipt of the notification to the national committee, such posts may not be filled without the consent of the competent national committee.
(4) The record kept by the organisations concerning their workers, who are citizens with altered working capacity, contains in particular personal data, residence, the designation of the decision according to which the worker is considered to be a changed working capacity and the information on the initial qualifications, the preparation provided for the work and the type of work carried out with the workplace designation and, where appropriate, the type of pension that the worker receives.
