DECLARATION
Ministry of Finance
of 16 June 1999
amending Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (Law on the valuation of assets)
According to § 33 (1) of Act No. 151 / 1997 Coll., on the valuation of assets and on the amendment of certain laws (the law on the valuation of assets), the Ministry of Finance provides:
Čl. I
Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the Valuation of Assets and on the Amendment of Certain Laws (Law on the Valuation of Assets), is amended as follows:
1. in Paragraph 2, the following points (h) and (i) are replaced at the end of the dot:
"(h) a holiday cottage building intended for individual recreation with a built-in space of not more than 360 m3 and a built-up area of not more than 80 m2, including veranda, entrances and covered terraces; may be underglued and have a maximum of one above ground floor and attic,
(i) a garden cottage building designed for individual recreation with a built-in space of not more than 110 m3 and a built-up area of not more than 25 m2 including veranda, entrances and floor-covered terraces; may be understacked and have a maximum of one above ground floor and attic. ';
2. in Section 5, footnote 3 reads:
"3) § 3 (c) of Decree No. 137 / 1998 Coll., on general technical requirements for construction."
3. in Article 6, footnote 4 shall be deleted;
4. in Section 8, footnote 5 shall be deleted;
5. In the first sentence of paragraph 1 of Section 10, the following is added: "and the coefficients K5 from Annex 13, Ki from Annex 32 and Kp from Annex 33 are multiplied. '
6. In Paragraph 12 (2), the second sentence is deleted.
7. In Paragraph 13, the following sentence is added at the end of paragraph 1: "For both cases, the floor area of balconies shall be multiplied by 0,17 and the floor area of terraces by 0,10. '.
8. In Article 15, the following paragraph 2 is inserted after paragraph 1, including footnote 7a:
"(2) The price of the construction for which the removal is due to poor technical condition is not required by the permit of the construction office, 7a) shall be established in accordance with paragraph 1.
7a) § 88 (5) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act). '
Paragraph 2 shall become paragraph 3.
9. In Article 21 (1), the words "their floor areas' are replaced by the words" their rooms'.
10. In the first sentence of Paragraph 22 (2), the words "or lower than normal rent 'shall be inserted after the words" if not available'.
11. in Paragraph 22 (2), the following sentence is inserted after the first sentence: "The use of normal rent must be shown to be justified."
12. in Article 22 (4) (c), the word "average" shall be deleted and the words "kept in the accounts" shall be inserted after the word "depreciation."
13. in Paragraph 22 (4) (c), "3%" is replaced by "3,5%";
14. in Article 23 (1) (a):
"(a) in the capital of Prague and neighbouring municipalities of Prague-East and Prague-West
1. 1 700 CZK in the capital of Prague,
2. 350 CZK in the district of Praha- east and Praha- west, whose cadastral territory is adjacent to the different cadastral territories of the capital of Prague, "
15. in Article 23 (1) (d), the words "according to the last census" shall be deleted;
16. in Paragraph 23 (1), the following sentence shall be inserted at the beginning of the paragraph following point (i):
"Population shall be determined according to the last census."
17. in Article 23 (1), the last sentence is deleted;
18. In the last sentence of Paragraph 23 (1), the word "coefficient 'is replaced by" coefficients Ki from Annex 32 a'.
19. In the second sentence of Paragraph 23 (2), "coefficient 'is replaced by" coefficients Ki from Annex 32 a'.
20. Paragraph 23 (3) reads:
"(3) The price per m2 of unbuilt land determined by the decision to use the land (15) for landfills, playgrounds, storage, weaning and handling areas or land so used, excluding land valued in accordance with paragraph 9, shall be multiplied by 0,50. This price shall be adjusted in accordance with Annex 15 to Table 1 and the coefficients Ki from Annex 32 and Kp from Annex 33. ';
21. in the last sentence of Paragraph 23 (4), the word "coefficient" shall be replaced by "coefficients Ki from Annex 32 a."
22. in Article 23 (5), "Kp coefficient" is replaced by "Ki coefficients from Annex 32 and Kp."
23. In the second sentence of Paragraph 23 (6), "2 'is replaced by" 3'.
24. in § 23 (7), "§ 26 (1)" is replaced by "§ 26 (2)";
25. in Paragraph 23 (10), the words "the state of use" shall be replaced by "the extent of construction."
26. in Article 23, paragraph 12 is added, including footnote (15a):
"(12) Land which, according to § 9 (1) (a) of Act No 151 / 1997 Coll. are not building land but are included in the applicable municipal spatial or regulatory plan, 15a) is valued according to § 23 (1) and multiplied by a coefficient of 0,30. This price may not be lower than the price established under Paragraph 26 (3).
15a) Sections 10 and 11 of Act No. 50 / 1976 Coll., as amended by Act No. 83 / 1998 Coll. '
27. in the first sentence of Article 24 (3), the word "adjacent" shall be deleted.
28. in Article 24 (3), the last sentence is deleted;
29. In Article 26, the following paragraph 1 is inserted:
"(1) The price per m2 of a garden or other area forming a single functional unit with construction and building land valued in accordance with § 23 (1) and (4) and not for land owned by the same entity shall be the price fixed in accordance with § 23 (1) and (4) multiplied by the coefficient 0,40."
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
30. In Paragraph 26 (2), "CZK 0,50" is replaced by "CZK 0,70."
31. in Article 26 (3), "paragraph 1" is replaced by "paragraphs 1 and 2";
32. In Paragraph 26 (3), the amount "5 Kč" is replaced by "7 Kč."
33. In Paragraph 27 (6), the amount "CZK 2" is replaced by "CZK 3."
34. In the first sentence of Paragraph 27 (7), "CZK 0,50 'is replaced by" CZK 0,70'.
35. In Annex No 2, in the first table in column 3 "Purpose of use of the building ', the words" non-residential premises in other buildings' and in column 5 "CZK / m2 floor area 'are added at the end of the text and the words" (price by type of building, sl. 4 x koef. 3,4)'.
36. In Annex 2, under the first table, the heading "Notes: 'is deleted.
37. In Annex 2 to the table "STANDARD EQUIPMENT OF BUILDINGS 'in entry 13" Windows', points F to L fall in the first part of the column.
