of 25 April 1990
on certain measures relating to the issue of the Private Entrepreneurship Act
The Czech National Council decided on this law:
(1) The authority responsible for registration under the Private Entrepreneurship Act (1) (hereinafter referred to as "the Act") is the Regional National Committee (hereinafter referred to as the National Committee).
(2) Registration shall be decided by the National Committee responsible for the permanent place of business, if there is no such place, according to the residence of the entrepreneur.
(3) The National Committee shall decide on the registration, amendment and revocation of the registration. (2)
The business permit is issued by the Ministry of the Interior of the Czech Republic to the registrant who is not resident in the territory of the Czech and Slovak Federal Republic. 3)
(1) The National Committee may impose a fine on an entrepreneur who infringes the obligations laid down in § 10 (1), § 13 (1), § 19, 20, 23, 24, 25 and 27 of the Act, up to a maximum of CZK 10 000.
(2) In the event that the conduct referred to in Paragraph 3 (1) is punishable by a fine higher than 10 000 Kčs under the special rules, the national committee shall initiate proceedings under those rules. It shall itself decide on the fine provided for in Article 3 (1) in the event that no fine has been imposed in proceedings under these rules. The period referred to in Article 3 (3) shall not run from the date of the submission of such an initiative until the national committee has been informed of its execution, but for a maximum period of three months from the submission of the complaint.
(3) The fine may not be imposed on an entrepreneur who has been affected under other legislation for the same infringement.
(4) The fine may be imposed no later than one year after the date on which the infringement occurred.
(1) The Ministry of the Interior of the Czech Republic (hereinafter referred to as "the Ministry") is obliged to cooperate in the exercise of the state administration on the private business of citizens with the relevant central authorities of the state in which the sectors in which the business is operated are responsible.
(2) The Ministry may request the necessary opinions and observations from the central government bodies referred to in paragraph 1. These authorities are obliged to provide opinions and observations within the time limits set by the Ministry.
Authorisations granted to citizens under the Act of the Czech National Council No. 127 / 1981 Coll., on Internal Trade, and under the Decree of the Ministry of Education and Culture No. 104 / 1965 Coll., on private teaching in the field of art and in the field of foreign languages, will expire on 30 September 1990.
The following shall be deleted:
1. § 4 (1) (b) and (d), § 6 to 8 and § 11 of Act No. 81 / 1957 Coll., on Concert and Other Music Activities;
2. § 3 (f), § 7, 8 and 10 of Act No. 82 / 1957 Coll., on estates, artistic productions and folk entertainment;
3. § 22c of Act No. 69 / 1967 Coll., on National Committees, as amended by Act No. 115 / 1988 Coll., amending and supplementing the Act on National Committees;
4. § 3 (1) (a) and (b), § 8, 9, 15, 17, 28 and 30 of the Act of the Czech National Council No. 33 / 1978 Coll., on theatrical activities (theatrical Act), as amended by the Act of the Czech National Council No. 122 / 1989 Coll.;
5. Sections 10 to 14 and 21 paragraphs 2 and 3 of the Decree of the Ministry of Culture of the Czech Republic No. 75 / 1978 Coll., implementing certain provisions of the theatre law, as amended by the Decree of the Ministry of Culture of the Czech Republic No. 198 / 1989 Coll.;
6. § 32d of the Act of the Czech National Council No. 77 / 1978 Coll., on State Administration in Education, as amended by the Act of the Czech National Council No. 31 / 1984 Coll., amending and supplementing the Act of the Czech National Council on State Administration in Education, and the Act of the Czech National Council on Education Equipment;
7. § 24 to 28 of the Czech National Council Act No. 127 / 1981 Coll., on Internal Trade;
8. Decree of the Government of the Czech Republic No. 63 / 1984 Coll., on granting temporary accommodation in private with the consent of the National Committee;
9. Decree of the Government of the Czech Republic No. 1 / 1988 Coll., on the sale of goods and services by citizens on the basis of the permission of the National Committee;
10. Decree of the Ministry of Education and Culture No. 104 / 1965 Coll., on private teaching in the field of art and foreign languages;
11. Sections 51 and 52 of the Order of the Ministry of Trade of the Czech Republic No. 93 / 1982 Coll., implementing certain provisions of the Czech National Council Act No. 127 / 1981 Coll., on Internal Trade.
This Act shall take effect on 1 May 1990.
