Ministry of Education of the Slovak Socialist Republic
of 16 October 1978
on schools for youth requiring special care
The Ministry of Education of the Slovak Socialist Republic, after consulting the Ministry of Health of the Slovak Socialist Republic and the Ministry of Labour and Social Affairs of the Slovak Socialist Republic, provides, pursuant to § 23 (4) and § 25 (2) of Act No. 63 / 1978 Coll., on measures in the system of primary and secondary schools and pursuant to § 14 (2) (a) and § 22 (2) of the Slovak National Council Act No. 79 / 1978 Coll., on State Administration in Education:
Basic provisions
This decree regulates the types, types and names of schools for youth requiring special care (1) (hereinafter referred to as "schools'), the conditions for their establishment and cancellation, the details of the organisation of certain schools and the conditions for the classification of pupils in those schools.
Types and types of schools
(1) A special school, an auxiliary school and a special vocational training centre are set up for pupils with mental disabilities.
(2) A primary school for the hearing impaired, a primary school for pupils with hearing remnants, a primary school for the deaf, a vocational school for the hearing affected youth, a secondary vocational school for the hearing affected youth, a gymnasium for the hearing affected youth and a secondary industrial clothing school for the hearing affected youth.
(3) For pupils with speech defects, a primary school is established for faulty speaking and a primary school for non-speaking.
(4) A primary school for the visually impaired, a primary school for the visually impaired, a primary school for pupils with vision remnants, a primary school for the blind, a vocational school for the visually impaired youth, a secondary vocational school for the visually impaired youth, a gymnasium for the visually impaired youth, a conservatory for the visually impaired youth, a vocational training school for the visually impaired youth, an economic school for the visually impaired youth, a secondary economic school for the visually impaired youth and a study of the field of masseurs for the visually impaired youth at the secondary medical school.
(5) For pupils with disabilities, a primary school is established for disabled people, a vocational school for disabled young people, a secondary vocational school for disabled young people, a gymnasium for disabled young people and a secondary economic school for disabled young people.
(6) A primary school at a hospital, a primary school at a children's hospital, a primary school at a children's spa hospital, and a primary school at a children's health care facility (hereinafter referred to as "primary school at health institutions') are established for pupils who are sick or disabled.
(7) A special school at a hospital, a special school at a children's hospital, a special school at a children's hospital and a special school at a children's spa hospital, and a special school at a children's recovery centre (hereinafter referred to as a "special school at health institutions') shall be established for pupils who are ill or disabled.
(8) A primary school is established for pupils who are difficult to educate in a children's education institution and a children's diagnostic institution, and a vocational training centre for young people.
(9) For pupils who are mentally disabled, a special school is set up in a children's education institution and a children's diagnostic institution, in a youth education institution, a special vocational training centre.
(10) For pupils with hearing disabilities, for pupils with speech defects, who are also mentally affected, schools are set up for pupils with multiple defects, namely: special school for deaf, special school for deaf, special vocational school for deaf young people, special school for disabled people, special school for non-speaking, special school for weak-sighted, special school for pupils with vision, special school for blind, special vocational training for visually impaired young people, special school for disabled people and special training for disabled young people.
School names
(1) The name of the school consists of a designation of the degree, type or type of school (§ 2), indicating the school's headquarters, e.g. "Primary School for the weak-sighted in......, district.........."
(2) The name of the school for pupils of Hungarian (Ukrainian) nationality is made up of a name established for a certain degree, type or type of school and accompanied by a description of the language of instruction, e.g. "Special School with Hungarian language in......., district........" The foreign language translation of the name shall be given in the second place.
Establishment and cancellation of schools
(1) Schools are set up for at least 10 pupils.
(2) Schools shall be abolished if the number of pupils falls below the number referred to in paragraph 1. With the agreement of the National Committee, which is the head of the school, the school may be left in operation even if the number of pupils is lower; taking into account the school network established by the Ministry of Education of the Slovak Socialist Republic.2)
Organisation of certain schools
(1) Regional National Committee (3) may set up, at the latest until the beginning of the school year 1983 / 84, secondary vocational training courses, vocational training courses and special vocational training courses for young people requiring special care, providing only theoretical training and extracurricular and extracurricular education. Practical training or professional training shall be provided by the organisation for which the youth are prepared.4)
(2) At the conservatory for visually impaired young people, a preparatory class may be set up for pupils who have demonstrated musical aptitude and abilities during the entrance exam but have not achieved the necessary degree of technical maturity in the game. The class shall be set up at least three pupils.
(3) Individual grades, types and types of schools may be managed by one director.
School Sanitary and School Club
(1) The School Satellite and the School Club (hereinafter referred to as the "Satellite and Club") may be set up if at least 10 pupils are regularly present.
(2) The cooperative and the club shall be cancelled if the number of pupils arriving regularly falls below 10.
Internal care
(1) The boarding school provides educational care, rehabilitation, accommodation and meals for pupils outside the school. Parents or other persons who have a maintenance obligation on the child (hereinafter referred to as "legal representatives') shall contribute to the partial reimbursement of the costs associated with the residence of children under specific rules. 5)
(2) The boarding school also provides education outside teaching and training for pupils who are in full-time care of the school.
(3) The details of the organisation of educational work in boarding school and the resulting rights and obligations of pupils and their legal representatives shall be determined by the internal rules of the boarding school approved by the National Committee which shall lead the school in a professional capacity.
(4) Teaching, accommodation and physical care can be provided to pupils with an ordered constitutional education, even during school holidays. The school provides these pupils with educational care until their vocational training is completed. If these pupils do not have parents and their own income, they are provided with a boarding school and allowance according to special regulations. 6)
Classification of pupils requiring special care in primary schools for youth requiring special care, special schools and support schools
(1) The inclusion of pupils in primary schools for youth requiring special care, special schools and auxiliary schools (except primary school pupils in medical institutions and primary school pupils for pupils difficult to educate) is decided by the district national committee responsible for the place of residence of the pupil. 7)
(2) Incentives to negotiate the inclusion may be submitted to the district national committee by the school in which the pupil is taking part, pedagogic-psychological counseling, health care facilities, legal representatives of the pupil, childcare bodies and other social institutions.
(3) The District National Committee will provide a comprehensive examination of the pupil, which has been proposed for inclusion in the school.
(4) A student enrolled in a school is obliged to attend that school. An exception may be made if the pupil cannot be placed in a school after the decision of the National Committee for lack of space. In this case, the pupil shall temporarily enter the primary school responsible for his place of residence.
(1) Pupils with such mental shortcomings are included in a special school for which they cannot be successfully educated at other schools. Pupils with such mental shortcomings are included in the secondary school, for which they cannot be educated even at a special school, but are still educational.
(2) Teachers with hearing defects are included in the primary school for pupils with hearing disabilities, for which they cannot be educated in primary school even if they are using common electroacoustic aids.
(3) Pupils with visual defects for which they are not able to be educated at primary school are included in the primary school.
(4) The primary school for pupils with speech defects includes pupils with speech disorders in which the removal of a medical preventive care disorder, including rehabilitation care, cannot be achieved.
(5) Pupils with physical disabilities for whom they cannot successfully be educated at primary school are included in primary school.
(6) Special schools for pupils with hearing disabilities, for pupils with speech defects, for pupils with visual disabilities or for pupils with physical disabilities shall be classified as having a disability and a mental deficiency for which they cannot be successfully educated at other schools.
(7) Pupils with multiple defects who are not mentally affected are to be classified in a school referred to in § 2 (1) to (6) taking into account the dominant defect.
Replacement of pupils
(1) Where necessary, the school director shall, within five months of the date of the adoption of the national district committee which has decided on the inclusion, initiate the transfer of the pupil to another school. the same progress is made if, during attendance, the pupil has changed significantly to the school of his disability.
(2) The complaint referred to in paragraph 1 shall be lodged by the school director after the expert doctor has expressed his opinion and after consultation with the school's pedagogical board.
(3) The national district committee shall decide on the initiative of transferring a pupil to another school, which shall decide on its inclusion in the school.
(4) A pupil who has been assigned to a primary school for youth requiring special care after prior attendance at primary school may, after consulting the school's pedagogical board, be enrolled in a primary school for youth requiring special care in a higher grade than he has completed compulsory schooling at primary school, provided that this is permitted by his age, year of schooling and knowledge of the school which corresponds to the year in which he is to be enrolled.
(5) If, during schooling, there is a substantial change in the student's disability in primary school requiring special care, the pupil shall be assigned to primary school responsible for his / her place of residence or other type or type of school.
(6) Pupils with extended compulsory education (8) continue at primary school responsible according to their place of residence or at a school where the compulsory education was not extended, in a lower year than they would have completed compulsory education at the school from which they were reassigned. When transferring pupils with extended compulsory education to a school to which pupils have also been extended, pupils shall continue the same year.
Compulsory education
Pupils in schools are included in compulsory education, which they did at other primary schools.
Secondary schools
(1) Candidates shall be admitted to secondary schools requiring special care in accordance with the rules applicable to other secondary schools.
(2) The period of study required to obtain secondary education or complete secondary education is extended to three years at the School of Economic Education for the visually impaired youth, at the Secondary Economic School for the visually impaired youth for five years, at the Vocational Seas School for the visually impaired youth for four years, at the Conservatory for the visually impaired youth for five years. For pupils in the preparatory class of the conservatory for visually impaired youth, the study is extended to six years.
(3) Pupils may be admitted to youth secondary schools requiring special care after the successful completion of the senior year of the primary school for youth requiring special care or of the final year of the primary school or of the basic nine-year-old school where there has been a significant deterioration of the defect in the final year of the primary school or of the basic nine-year-old school.
(4) Special vocational training courses, vocational training courses and secondary vocational training courses for young people requiring special care are organised for their apprenticeships for 20 working days.
(5) In vocational schools designed for sensually or physically disabled young people, a department for the mentally disabled (a section for pupils with multiple defects) can be established.
Training arrangements
The primary schools for youth requiring special care, special schools and auxiliary schools in accordance with the rules applicable to primary schools (9), with the following derogations:
(a) the optional subject group may be set up if at least five pupils join it;
(b) the department of physical education of the weakened shall be established with at least five pupils; The highest number of students in the department is eight. If the number of pupils below five is reduced, the separation shall be cancelled;
(c) tutoring groups, balancing classes and specialised classes shall not be established.
Health and safety care for pupils
In the care of the health and safety of primary school pupils requiring special care, special schools and auxiliary schools, schools shall follow the rules applicable to primary schools (9) with the following derogations:
(a) there are no more than five bathing pupils in one group;
(b) ski training shall be carried out by one instructor with a maximum of 10 pupils.
Final provision
Unless otherwise provided for in this Decree, primary schools for young people requiring special care, special schools and auxiliary schools shall be subject to the rules applicable to other primary schools, secondary schools for young people requiring special care shall be subject to those applicable to other secondary schools of the species concerned.
Efficacy
(1) Measures taken as from 1 September 1978, if they comply with this Decree, shall be deemed to have been implemented under this Order.
(2) This decree shall take effect on the day of its publication.
