The Federal Ministry of Technical and Investment Development, the State Planning Commission and the Federal Ministry of Finance provide, pursuant to § 53 (a) to (c) of the Act No. 133 / 1970 Coll., on the competence of the Federal Ministries, § 17 (1) (e) of the Act No. 145 / 1970 Coll., on National Economic Planning, § 391 of the Economic Code No. 109 / 1964 Coll., in the full version published in § 37 / 1971 Coll., and § 11 (2) of the Act No. 83 / 1958 Coll., on the modification of financial planning and financial economy of national enterprises and other economic organisations of the State Socialist sector:

INTRODUCTORY PROVISIONS
§ 1
Purpose of the Order
The purpose of the decree is to adjust the method of equipping flats with materials, products and structures (hereinafter referred to as "products') in quality and quantity above the level laid down by the specific regulation1) and to define the types of such products as well as to adapt certain other related issues.
§ 2
The decree covers the construction of flats in cooperative, corporate and municipal housing, carried out in a supplier's way and, mutatis mutandis, the reconstruction and modernisation of flats (hereinafter referred to as "flats').
§ 3
The concept of above-standard apartment equipment
(1) The equipment of the flats listed in the list annexed to this Decree is considered to be superior equipment of flats ("superstandard equipment").
(2) Products other than those listed cannot be regarded as above standard equipment under the provisions of this Decree.
(3) The list shall also specify which products become part of the basic device and which are transferred to the personal property of the user of the apartment.

PROCEDURE IN THE NADSTANDARD PROCESSING OF BETS
§ 4
Application of the requirement for superstandard equipment
(1) The investor will apply the requirement to equip flats with products that form superstandard equipment to the contractor of construction works (construction parts of construction) when discussing preparatory or project documentation, but not later than when concluding an economic supply contract. If the investor applies the requirement for superstandard equipment at a later date, a supplement to the economic contract shall be concluded.
(2) The above standard equipment can be used for at least one section of the apartment building; for an individual apartment only if it does not require basic design adjustments and an agreement is reached between the investor and the supplier.
(3) At the initiative of the supplier, the use of spare materials and products compared to the authorised documents2 cannot be considered to be superstandard equipment.
(4) The volume of works and supplies resulting from above-standard equipment is included in the performance of the supplier's plan.
(5) The construction periods laid down in special regulations, 3) are not extended due to the increase in the cost of superstandard equipment.
§ 5
Documentation of superstandard equipment
(1) The provisions of Decree No. 163 / 1973 Coll., on the documentation of buildings with above-standard equipment apply to the documentation of residential buildings, with the derogations specified in the following paragraphs.
(2) The budgets and sales budgets of residential buildings include budgetary costs corresponding to standard equipment in the respective titles.
(3) The budgets referred to in the preceding paragraph shall be drawn up by means of an annex to a separate budget indicating:
(a) budgetary costs of above-standard equipment;
(b) the budgetary costs of standard equipment replaced by superstandard equipment;
(c) the difference in budgetary costs referred to in points (a) and (b).
(4) The budgetary costs referred to in point (a) of the previous paragraph shall be broken down into the costs of the products,
(a) which will become part of the cost of the basic funds (residential buildings),
(b) which go into the personal ownership of the users of the apartments.
(5) The difference in budgetary costs referred to in paragraph 3 (c) shall be added in the budgets and sales budgets (paragraph 2) to the cost of the housing facility corresponding to the standard equipment.
(6) The general budget of the construction shall include the budgetary costs of residential buildings (paragraph 2) adjusted in accordance with the preceding paragraph.
(7) The budgetary costs of standard equipment residential buildings are the basis for comparison with technical economic indicators.
(8) If an agreement has been reached between the investor and the supplier on the application of superstandard equipment after the submission of the relevant stage of the project and budget, the processor shall ensure that the original documentation is revised in return for the payment provided by the investor.
(9) If there is an increase in the budgetary costs of the construction after the approval of the general budget as a result of the additional application of the above-standard equipment, this shall not be considered as an increase in the budgetary costs under the specific regulation.4)
(10) Sales agreements shall be concluded on the basis of the sales budgets adjusted in accordance with paragraph 5.
§ 6
Financing and invoicing of superstandard equipment
(1) General legislation applies to the financing of the cost of superstandard equipment. The cost of superstandard equipment shall be borne by the investor to the supplier from the means of investment; for municipal construction from the reserve fund and development. The cost of superstandard equipment for corporate housing does not constitute a deductible item according to Act No. 111 / 1971 Coll., on contributions to the state budget and social security contributions, and Act No. 113 / 1971 Coll., on pension tax and social security contributions; for buildings whose investors are agricultural and forest organisations, superstandard equipment shall not be financed by State budget funds.
(2) Repayments and invoices shall be made in respect of the amounts of budgetary costs shown in the sales budgets adjusted in accordance with Article 5 (5).

OBLIGATIONS OF ORGANISATIONS RELATING TO THE USE OF HOUSEHOLDS WITH THE NADSTANDARD EQUIPMENT AND OBLIGATIONS OF THE MEMBERS OF THE SEPARATE ORGANISATIONS
§ 7
Obligations of investors
The investor is obliged to forward to the organisation which will manage the residential house (if not itself) the budget of the above-standard equipment adjusted according to the actual costs incurred, at the latest when the dwelling is transferred to its administration.
§ 8
Obligations of members of cooperative organisations and obligations of other organisations managing homes
(1) In cooperative housing, members of the cooperative will bear the costs of superstandard equipment, which becomes part of the base vehicle, by increasing their membership shares. 5) Excessive equipment transferred to personal property is paid directly by members of the cooperative (§ 10).
(2) In municipal housing construction, an organisation managing a residential house is obliged to pay a remuneration for the above-standard equipment of apartments transferred to personal property to the budget of the relevant national committee that financed the construction in favour of its reserve fund and development. For corporate housing, this remuneration shall be paid to the construction fund.

COMMON, TRANSITIONAL AND FINAL PROVISIONS
§ 9
Provision of loans
In order to increase members' shares in the payment of above-standard equipment, which is not transferred to personal ownership, the State Savings Bank grants loans to members of the cooperative under the same conditions as loans per member share.6)
§ 10
Payment maturity
The payment for superstandard equipment, which becomes the personal property of the user of the apartment, is due within 14 days of the conclusion of the agreement on the surrender and takeover of the apartment. 7) The superstandard equipment becomes personal property by the conclusion of this agreement and the takeover of superstandard equipment. The costs of the above-standard equipment of an apartment transferred to personal ownership [Paragraph 5 (4) (b)] are specified in detail in the agreement.
§ 11
Statistical reporting of superstandard equipment costs
The cost of superstandard equipment shall be reported in statistical records (8) in order to allow monitoring of the cost of superstandard equipment, broken down into costs included in the purchase price of basic funds and other costs.
§ 12
Transitional provision
Products that have been used in accordance with the existing regulations (9) in the design documentation of the residential building developed before the effective date of the decree are not considered to be above standard equipment.
§ 13
Efficacy
The decree shall take effect on 1 January 1976.
