amending and supplementing Government Regulation No. 12 / 1968 Coll., adjusting remuneration and allowances and certain other ratios of Members of the National Committees and of the Commissions and Assets of the National Committees
The Government of the Czech Socialist Republic orders pursuant to § 17 paragraph 3 of Act No. 69 / 1967 Coll., on National Committees, § 124 paragraph 3 of the Labour Code No. 65 / 1965 Coll. and having regard to the provisions of § 142 of Act No. 101 / 1964 Coll., on Social Security:
Government Regulation No. 12 / 1968 Coll., on the adjustment of remuneration and allowances and certain other ratios of members of national committees and members of committees and assets of national committees, shall be amended as follows:
1. In Article 2 (2), the words "or the Chairman of the Committee of People's Control of the National Committee" shall be inserted after the words "President of the Commission."
2. In Article 4, paragraph 3 is added as follows:
"(3) Remuneration may be granted to long-term members of national committees for significant work and life years under the conditions applicable to the staff of national committees. *) '
3. In Paragraph 5, which is renumbered paragraph 1, the following paragraph 2 is added:
"(2) The social security authority responsible for deciding on pension benefits shall, at the request of the Member who is long-term released, determine the pension on the average monthly earnings recorded on the gross earnings earned in employment and on the gross remuneration obtained for the performance of his duties in the national committee, including the part of the remuneration exempt from salary tax, for the last 10 or, where applicable, for the last five calendar years preceding the year in which the termination took place, where that average is more favourable to him than the average monthly earnings established under the general rules. This advantage shall be granted only to long-term Members whose reason for discontinuing their duties in the national committee is not a gross violation of or abuse of the duties of Members. ';
4. Article 6 (1) reads as follows:
"(1) The national committee shall, if there is no reason to terminate the duties of a national committee, grant a gross breach of the duties of a Member or misuse of such a post, as long-term vacancy of officials to a national committee of a lower grade. This allowance shall be granted for a period of six months and shall be paid through the organisation. This allowance shall be granted for long-term vacancies who have completed their duties two years before the age required to qualify for an old-age pension; in cases of special consideration, in particular where the Member has performed this function for several parliamentary periods, a contribution may be granted, with the agreement of the Council of the National Committee of the Higher Level and, for officials of the Regional National Committees and the National Committee of the City of Prague, with the agreement of the Ministry of the Interior, until the age required to qualify for an old-age pension. ';
5. Paragraph 8 (2) of the second sentence reads:
"This also applies to members and co-workers of the Committees of People's Control of National Committees. '
This Government Regulation shall enter into force on the day of its publication.
