on certain transitional measures in the field of press and other mass information
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
(1) In the interests of further peaceful development, the important interests of the internal and foreign policy of the state should not be undermined in the field of periodical press and other mass information. At the same time, universal care must be ensured for the development of periodical press and other mass information.
(2) The Office for Press and Information, the Slovak Office for Press and Information, is established as public authorities in Slovakia. The current competence of the Ministry of Culture and Information pursuant to Act No. 81 / 1966 Coll., on Periodic Printing and on Other Mass Information Means, as amended by Act No. 84 / 1968 Coll., is transferred to the Slovak National Council for Culture and Information, as amended by Act No. 84 / 1968 Coll., to the same extent, to the Slovak Office for Press and Information. In particular, the task of the printing and information authorities is to direct and control the activities of periodical printing and other mass information.
The organisation and integration of the Office for Press and Information, as well as a more detailed definition of its competence, shall be determined by the Government and, as regards the Slovak Press and Information Office, by the Slovak National Council.
(1) Paragraph 17 of Act No. 81 / 1966 Coll., as amended by Act No. 84 / 1968 Coll., is suspended.
(2) The competent printing and information authority shall have the right, directly or through agents designated by the head of the competent authority on a joint proposal from the publisher and the editor (hereinafter referred to as the agent), to ensure that the periodic press (other mass information device) does not disclose information which contains facts which conflict with the important interests of the internal or foreign policy of the State. Where the information contains such a fact, the competent authority for the printing and information or the agent may suspend its publication or any other extension.
Act No. 81 / 1966 Coll., as amended by Act No. 84 / 1968 Coll., is amended as follows:
Paragraph 8 reads as follows:
(1) The registration expires and the authorisation to issue periodical printing expires,
(a) if the issue of periodical printing does not commence within one year of registration,
(b) if, by decision of the publisher, the publication of newspapers for a longer period of one month, the publication of a magazine or other periodical printed matter for a longer period of one year, or
(c) if an additional factor for which registration could not be carried out (§ 7 (2)) is provided.
(2) If the reports, data and other information published in newspapers, magazines or other periodical publications are contrary to the mission of the periodical press (§ 2), in particular if they infringe the important interests of the internal or foreign policy of the State (§ 1 and 3 of Act No. 127 / 1968 Coll., on certain transitional measures in the field of printing and other mass information), the authority responsible for carrying out registration may take one of the following measures before taking a decision under paragraph 1 (c):
(a) notify the publisher of non-compliance with the mission of the periodical press;
(b) to reprimand the publisher;
(c) impose a pecuniary penalty on the issuer of up to 50 000 CZK;
(d) withdraw temporarily, for a maximum period of three months, the authorisation to issue periodical printing.
(3) The decision referred to in paragraph 1 (c) or paragraph 2 (c) and (d) shall be reviewed by the Regional Court on a proposal from the publisher. The Civil Code (§ 244 et seq.) shall apply to the application procedure. '
The Government may impose obligations on organisations and bodies which have been granted a publishing authorisation under Act No. 94 / 1949 Coll., on the publication and dissemination of books, music and other non-periodic publications, so as to ensure that the important interests of the internal and foreign policy of the State are not undermined in their publishing activity; It may, by analogy, lay down those obligations for companies of the printing industry or other organisations in the production of printed matter not covered by Act No 94 / 1949 Coll.
The freedom to publish scientific and artistic results is not affected by this law.
This Act shall take effect on the day of its publication.
