Government Regulation
of 17 December 1951
on transfers of competence in civil servants' personal matters with central offices to subordinate personal offices.
The Government of the Czechoslovak Republic hereby orders pursuant to § 1 of Act No. 143 / 1949 Coll., on Changes in the Organisation of Public Administration and within the jurisdiction of its bodies:
By moving the scope under this Regulation, the central authorities are to be free as far as possible from decision-making in individual civil servants' personal matters in order to simplify and streamline their handling.
(1) The central offices in the personal affairs of the staff of the national committees are transferred to the regional national committees (central national committee of the capital of Prague).
1. setting off the periods of time for the procedure provided for in Sections 7 (2) and 8 (2) of Decree-Law No 68 / 1950 Coll., which issue the Staff Regulations for Administrative Employees, or under similar rules, where this is the case under Directives issued under Section 10 of these Regulations (similar rules),
2. Deciding on the transfer of a staff member associated with the change of a personal office (§ 12 (2) of Decree-Law No 120 / 1950 Coll., on the rights and obligations of civil servants, on proceedings concerning their employment and arbitration), provided that the persons involved agree on the transfer,
3. decision on the transfer of an employee to another branch of government (§ 12 (3) of the Law No. 120 / 1950) if the transfer does not result in a change of personal office,
4. the authorisation of exemptions from the prohibition to employ relatives or married persons, spouses and persons who are in a custody or training relationship in such a way that one is directly subordinate to the other, or are subject to its cashier's or accounting control (§ 9 (3)).
(2) The transfer of the staff member referred to in paragraph 1 (2) shall be decided by the current personal staff member's office.
(3) Where, in the cases referred to in paragraph 1, another central office has also taken joint decisions, such participation shall also be waived.
The central authorities within whose jurisdiction decisions are taken in the personal matters of other civil servants shall be empowered to delegate, as necessary, the powers referred to in Article 2 (1) to the personal authorities directly subordinate to them.
Paragraph 2 (1) (g) of the Decree of 31 March 1949 No 80 Coll., on the internal organisation of the Prague authorities of the People's Administration, is deleted.
This Regulation shall enter into force on 1 January 1952; All members of the government will do it.
