Statutes
United Nations Food and Agricultural Organisations.
Foreword
The States receiving these Statutes are committed to helping the common good by promoting special and collective measures aimed at:
to increase the level of nutrition and the living rate of the population under their responsibility,
to ensure greater production performance and better distribution of all food and agricultural products,
to improve the living conditions of the rural population,
and thus contributed to the development of the world economy. They therefore establish a United Nations Food and Agricultural Organisation, hereinafter referred to as' Organisation ', through which members will inform each other of the measures taken and the progress made in the field of the activities mentioned above.
Článek I
Activity of Organisation
1. It will gather, explore, interpret and disseminate reports on nutrition, food and agriculture.
2. The organisation will support and recommend, as necessary, state and international measures concerning:
(a) scientific, technological, social and economic research on nutrition, food and agriculture;
(b) improving education and administration in matters of nutrition, food and agriculture, as well as broadening the general knowledge of nutrition and agricultural science as well as work;
(c) maintaining natural resources and introducing improved agricultural production methods;
(d) improvement of production processes, sales and distribution of food and agricultural products;
(e) the adoption of directives for the care of sufficient agricultural credit by both state and international;
(f) the adoption of international guidelines for agreements on agricultural products.
3. The task of Organisation will also be to
(a) provide technical assistance if governments demand it;
(b) organise, together with the governments involved, missions to support governments as appropriate in the fulfilment of commitments resulting from the recommendations adopted by the United Nations Assembly on Food and Agriculture; and
(c) at all, to take all necessary and appropriate measures to carry out the tasks of the Organisation referred to in the Foreword.
Článek II
Composition
1. The original members of the Organisation shall be those of the States listed in Annex I which adopt these Statutes in accordance with Article XXI.
2. Other members may be admitted to the Organisation by a resolution of a two-thirds majority of all members of the Assembly, and if they accept the Statutes as they will apply at the time of their adoption.

Assembly
1. The organisation will have a meeting where each Member State will be represented by one member.
2. Each Member State may appoint an alternate, a representative and an adviser for its member of the Assembly. The Assembly may lay down rules for the participation of alternates, representatives and advisers in the deliberations, but any such participation shall be without voting rights, except that the alternate or representative shall participate in the seat of a member.
3. No member of the Assembly may represent more than one Member State.
4. Each Member State shall have only one vote.
5. The Assembly may invite any public international organisation which has obligations similar to the Organisation to designate a representative who, under the conditions laid down by the Assembly, will attend its meetings. No such representative shall have the right to vote.
6. The Assembly shall meet at least once each year.
7. The Assembly shall elect its own officials, amend its rules of procedure and lay down rules on the convening of meetings and the setting of the agenda.
8. Unless otherwise expressly specified by these Statutes or by the rules issued by the Assembly, the Assembly shall decide on all matters by a simple majority of the votes cast.
Článek IV
Operation of the Assembly
1. The Assembly shall determine the directives, approve the budget of the Organisation and exercise the other powers conferred on it by these Statutes.
2. The Assembly may, by a two-thirds majority of the votes cast, vote on food and agriculture on recommendations to be made to Member States to consider their implementation by State measures.
3. The Assembly may, by a two-thirds majority of the votes cast, submit to the Member States conventions on food and agriculture matters in order to consider adopting them in accordance with the relevant constitutional procedure.
4. The Assembly shall issue rules on the procedure to be taken care of
(a) appropriate consultation with governments and appropriate technical training prior to the meeting on the proposed recommendations and conventions; and
(b) appropriate consultation with the governments of the Parties of the relationship between the Organisation and the State institutions or private persons.
5. The Assembly may make recommendations to any public international organisation on any matter for the purpose of the Organisation.
6. The Assembly may agree, by a two-thirds majority of the votes cast, to carry out any other activity which is consistent with the purpose of the organisation and which would be transferred to it by governments or provided for in an agreement negotiated between the Organisation and any other public international organisation.
Článek V
Executive Committee
1. The Assembly shall designate an Executive Committee, consisting of at least nine members and not more than 15 members of the Assembly, or their alternates, representatives or advisers, who are suited to their administrative experience or other specific characteristics to contribute to the achievement of the objectives of the Organisation. There will be no more than one Member State. The execution and conditions of the Office of the members of the Executive Committee shall be governed by the rules to be laid down by the Assembly.
2. In accordance with the provisions of paragraph 1 of this Article, when determining the Executive Committee, the Assembly shall take account of the need for its members to represent the most diverse experience in the various types of food and agricultural economies.
3. The Assembly may delegate powers to the Executive Committee as it itself may, with the exception of those referred to in Article II (2), Article IV, Article VII (1), Article XIII and Article XXof these Statutes.
4. The members of the Executive Committee shall exercise the powers conferred upon them by the Assembly, for the entire assembly and not as representatives of their governments.
5. The Executive Committee shall designate its officials and shall lay down its rules of procedure in accordance with the decisions of the Assembly.
Článek VI
Other committees and meetings
1. The Assembly may set up technical and territorial standing committees and appoint committees to study and report on any matter relating to the purpose of the Organisation.
2. The Assembly may convene general, technical, territorial or other special assembly in the manner for which it decides and may arrange for national or international bodies dealing with nutrition, food or agriculture to be represented.

Director-General
1. The organisation will have a Director-General elected by the Assembly in a manner and under conditions determined by the Assembly.
2. Under the general supervision of the Assembly and its Executive Committee, the Director-General will have all the authority to manage the work of the Organisation.
3. The Director-General or a representative appointed by him shall participate, without the right to vote, in all meetings of the Assembly and its Executive Committee and shall prepare proposals for appropriate measures for meetings of the Assembly and the Executive Committee in matters to be submitted to them.
Článek VIII
Staff
1. The staff of the Organisation shall be appointed by the Director-General in a manner which determines the rules laid down by the Assembly.
2. The staff of the organisation shall be accountable to the Director-General. The duties of personnel shall be of a purely international nature and personnel shall not require or receive instructions from any official outside the Organisation concerning the performance of their duties. Member States shall undertake to fully conserve the international nature of the duties of staff and not to seek to influence any of their members in the performance of their duties.
3. When appointing staff, the Director-General, having regard to the sovereign importance of ensuring the highest possible level of performance and technical capabilities, shall take due account of the importance of selecting the staff at the geographical base as broad as possible.
4. Each Member State shall undertake to admit, if possible under its constitutional procedure, to the Director-General and to the senior officials of the privileges and immunities of the diplomatic, to the other staff of any relief and immunity granted to non-diplomatic staff assigned to diplomatic missions, or to admit to other staff the immunity and relief which may subsequently be granted to equal staff of other public international organisations.
Článek IX
Location
The seat of the Organisation will be determined by the Assembly.
Článek X
Territorial and liaison offices
1. A territorial office shall be established as designated by the Director-General, approved by the Assembly.
2. The Director-General may appoint liaison officers for specific countries or territories under an agreement with the government involved.
Článek XI
Members' reports
1. Each Member State shall report periodically to the Organisation on progress in achieving the purpose of the Organisation referred to in the Foreword and on the action it carries out in accordance with the recommendations made by the Assembly or under the agreements submitted by it.
2. These reports shall be submitted within such time limits, in such form and with such data as the assembly would have requested.
3. The Director-General shall submit such reports together with their analysis to the Assembly and shall publish reports and analyses to be approved by the Publication Assembly, together with their reports concerning and the Assembly adopted.
4. The Director-General may request any Member State to submit a report concerning the purpose of the Organisation.
5. Each Member State shall notify the Organisation on request of any laws, regulations and official reports and statistics relating to nutrition, food and agriculture as soon as they are published.
Článek XII
Cooperation with other organisations
1. In order to ensure close cooperation between the Organisation and other public international organisations with similar obligations, the Assembly, acting in accordance with the provisions of Article XIII, may conclude an agreement with the relevant actors of those organisations to determine the allocation of obligations and methods of cooperation.
2. The Director-General may, acting by the resolutions of the Assembly, conclude an agreement with other public international organisations on the joint execution of work, the joint arrangements for the acquisition, training, the conditions of service of staff and other related matters, as well as the exchange thereof.
Článek XIII
Relation to other general global organisations
1. The organisation shall, in accordance with the procedure laid down in the following paragraph, be part of any general international organisation entrusted with coordinating the activities of international organisations with specific tasks.
2. Arrangements establishing relations between the Organisation and such general organisation must be approved by the Assembly. Notwithstanding the provisions of Article XX, such arrangements may, if approved in the Assembly by a two-thirds majority of the votes cast, amend the provisions of these Statutes, but subject to the condition that no such arrangements are to be amended by the purposes and limits of the Organisations established by those Statutes.
Článek XIV
Supervision of other organisations
The Assembly may approve arrangements by which other public international organisations dealing with food and agriculture issues submit general powers to the Organisation under conditions to be agreed with the relevant actors of the organisation concerned.
Článek XV
Legal status
1. The organisation will have the character of a legal person capable of implementing any legal act suitable for its purpose which does not go beyond the powers conferred on it by these Statutes.
2. Each Member State undertakes to admit, if possible under its constitutional procedure, all the immunity and relief it grants to the diplomatic representative, including the integrity of rooms and archives, the exemption from jurisdiction and taxation.
3. The Assembly shall take measures to ensure that disputes concerning service contracts and conditions for the appointment of staff members are decided by the administrative court.
Článek XVI
Fish and forestry products
In these Statutes, the term "agriculture 'and its derivatives also refer to fisheries, marine products, forestry and forestry primary products.
Článek XVII
Interpretation of Statutes
Any question or dispute between the parties to the interpretation of these Statutes or any international agreement adopted in connection with them shall be referred for judgment to the competent international court or arbitration tribunal in a manner to be determined by the Assembly.
Článek XVIII
Expenditure
1. Under the provisions of Article XXV., the Director-General shall submit to the Assembly an annual budget covering the anticipated expenditure of the Organisation. Once the budget has been adopted, the aggregate amount shall be allocated to the Member States in a proportion to be determined from the time of the assembly. Each Member State undertakes to contribute without delay to the Organisation its share thus determined, in accordance with the requirements of its constitutional procedure.
2. Each Member State shall pay, when it adopts these Statutes, its first contribution to the annual budget for the current financial year.
3. The financial year of the Organisation shall be from 1 July to 30 June, unless otherwise specified by the Assembly.
Článek XIX
Performance
Any Member State may notify its withdrawal from the Organisation at any time after four years of its adoption of these Statutes. This notification shall take effect one year after the date of its communication to the Director-General of the Organisation, provided that the State has paid its contributions at that time for all years of its membership, including the financial year following the date of such notification.
Článek XX
Amendments to the Statutes
1. For the amendments to these Statutes, which contain new obligations by the Member States, the Assembly shall be required to approve them by a two-thirds majority of all its members, and once adopted by two-thirds of the Member States, they shall become effective for each Member State which has accepted the amendment and then for each remaining Member State as soon as it has adopted it.
2. Other amendments shall take effect when approved by the Assembly by a two-thirds majority of its members.
Článek XXI
Efficiency of the Statutes
1. These Statutes may be adopted by the States listed in Annex I.
2. The instruments of acceptance shall be submitted by each government to the provisional Food and Agricultural Commission of the United Nations. The latter shall notify the governments of the States listed in Annex I. The Interim Commission may be notified by a diplomatic representative; in which case the instrument of acceptance shall be submitted to the Commission as soon as possible after notification.
3. As soon as the Interim Commission receives 20 notifications of acceptance, it shall ensure that these Statutes are signed in a single copy by the authorised diplomatic representatives of the States which have notified their acceptance. When at least 20 of the States listed in Annex I have been so signed, these Statutes shall immediately become effective.
4. Acceptances that will be announced after these Statutes become effective will become effective once they are received by the Interim Commission of Organisation.
Článek XXII
First meeting of the Assembly
The United Nations Food and Agriculture Commission shall convene the first meeting of the Assembly at the appropriate time after these Statutes have become effective.
Článek XXIII
Official language
Until the assembly approves the rules on language, it will act in English.
Článek XXIV
Temporary seat
The temporary headquarters of the Organization will be in Washington until the assembly decides otherwise.
Článek XXV
First financial year
These exceptional measures concern the first financial year in which these Statutes become applicable:
(a) the budget shall be the provisional budget set out in Annex II to these Statutes;
(b) Member States shall contribute in the ratio set out in Annex II to these Statutes, subject to the condition that each Member State may deduct the amount already contributed to the expenditure of the Interim Commission.
Článek XXVI
Dissolution of the Interim Commission
At the beginning of the first meeting of the Assembly, the provisional Food and Agricultural Commission of the United Nations will be deemed to be dissolved and its files and other assets will become the property of the Organisation.
