amending Act No. 320 / 2001 Coll., on Financial Control in Public Administration and amending certain laws (Financial Control Act), as amended
Parliament has decided on this law of the Czech Republic:

1. In the first sentence of Article 1 (1), the word "administration 'is replaced by" management1). "

2. in Article 2 (a), the words "voluntary association of municipalities" shall be inserted after the words "urban part of the capital of Prague," and the words "or urban part of the capital of Prague" shall be replaced by the words "urban part of the capital of Prague or voluntary association of municipalities, state organization Railway Infrastructure Administration."
3. In Article 5, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) In the case of a voluntary association of municipalities, natural persons other than the employees of a voluntary association of municipalities may carry out financial control. ';
4. § 9a, including the title:
Scope of voluntary communes
(1) The voluntary municipalities' bundles control the management of public funds set up by them.
(2) The voluntary municipalities' bundles shall carry out public administrative checks on applicants for public financial aid or on beneficiaries of public financial aid granted to them.
(3) The voluntary volumes of municipalities are obliged to create a financial control system under this Act, which will ensure financial control of both their management and the management of the contribution organisations established by them. At the same time, they shall ensure that the adequacy and effectiveness of this system are verified and evaluated regularly, at least once a year. ';
5. Paragraph 22 (2) reads as follows:
"(2) The public authority shall submit an annual report on the results of the financial checks to the Ministry of Finance."
6. Paragraph 22 (3), including footnote 24, is deleted.
Paragraphs 4 to 7 shall be renumbered paragraphs 3 to 6.
7. In Article 26, paragraphs 6 to 8 are added:
"(6) In the case of a voluntary association of municipalities, natural persons other than employees of a voluntary association of municipalities may also carry out a preliminary management check.
(7) In the case of municipalities, counties, capital of Prague, urban part of the capital of Prague, urban districts and part of the statutory city, the director of the operation may be a member of the council.
(8) For a public authority with no more than 5 employees, the main accounting officer or administrator of the budget may be a natural person other than an employee of the public authority. "
8. In Paragraph 29 (2) (d), the words "the Railway Infrastructure Administration State Organisation or 'shall be inserted after the words" the statutory body'.
9. In Article 29 (5), the words "and the voluntary communal volumes referred to in Article 9a (3) shall be inserted after the words" Paragraph 9 (3) for their organisational components and contribution organisations within their competence. "
10. In the first sentence of Paragraph 29 (6), the words "and the voluntary volumes of the municipalities' shall be inserted after the words" 15 000 inhabitants' and the words "the municipality and the municipality of the capital of Prague 'shall be replaced by the words" the municipality, the city of the capital of Prague and the voluntary volumes of the municipalities'.
Efficacy
This Act shall take effect on 1 January 2020.
