THE LAW
of 5 March 1992
on the protection of the character and name of the Red Cross and the Czechoslovak Red Cross
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
PROTECTION OF THE SIGNS AND NAMES OF THE BLACK CROSS
(1) The sign of the red cross on the white field and the words "red cross" or "Geneva cross" protected by the Geneva Conventions of 12 August 1949 on the protection of war victims, as amended by the Additional Protocols to these Conventions of 8 June 19771 (hereinafter referred to as the Geneva Conventions), may only be used in the territory of the Czech and Slovak Federal Republic at peace:
(a) a military medical service for the designation and protection of health services and institutions, personnel and material protected by the Geneva Conventions and other international conventions governing similar matters, by which the Czech and Slovak Federal Republic is bound;
(b) the Czechoslovak Red Cross (§ 3), its Constitution and Equipment, in its activities in the cases referred to in (a) and in its other activities at a time of peace under the conditions laid down by the Geneva Conventions;
(c) international organisations of the Red Cross and their personnel;
(d) operators of vehicles designated as ambulances and operators of rescue stations exclusively intended for the free treatment of injured or sick persons to designate such ambulances and rescue stations at a time of peace, but only with the express agreement of the Czechoslovak Red Cross (§ 3).
(2) For other purposes, or other natural or legal persons, the character and name referred to in paragraph 1, or the character and name, shall not be used.
(1) A natural, legal or commercial natural person commits an offence by improperly using the character or name referred to in Section 1.
(2) A fine may be imposed for the offence referred to in paragraph 1 until:
(a) 10 000 CZK,
(b) 50 000 CZK if the negotiations are held at the time of the events covered by the Geneva Conventions.
(3) The proceeds of the fines imposed under paragraph 1 are in favour of the Czechoslovak Red Cross.
(4) The unauthorised marking of the case by the mark or name referred to in § 1 shall be immediately removed by the holder of the case; If they do not do so, the competent administrative authority shall decide to remove the unauthorised mark on the holder's cargo. If it cannot be removed from the case, the competent administrative authority shall declare forfeiture or prevent the case, even if the offence referred to in paragraph 1 has not been dealt with or the offence has been dealt with; The forfeited or seized item comes without compensation to the Czechoslovak Red Cross.

(1) Czechoslovak Red Cross is a company within the meaning of the Civil Association Act .2)
(2) The only state recognised company of the Red Cross in the territory of the Czech and Slovak Federal Republic is the Czechoslovak Red Cross based in Prague.
The Czechoslovak Red Cross has the status and authority of a national company under the Geneva Conventions and performs in particular the following tasks:
(a) act as an exclusively recognised subsidiary organisation of the military health service;
(b) operate in the field of civil defence and public protection and provide assistance in the event of disasters and other incidents;
(c) provide medical, rescue, social and other humanitarian services;
(d) disseminate knowledge of the Geneva Conventions;
(e) educates citizens to participate in health tasks and its constituents cooperate closely with health service providers;
(f) provide a search service under the Geneva Conventions and Resolutions of the International Conferences of the Red Cross and the Red Crescent; in carrying out this task, the Police of the Czech Republic, the Ministry, other public authorities and local authorities provide him with synergies and necessary information including personal data.
(1) The Czechoslovak Red Cross receives funding for its activities in particular:
(a) by Member States, the proceeds of their own activities, the acceptance of gifts, legacy references and the contributions of the State;
(b) the Government of the Czech and Slovak Federal Republic provides annually from the state budget of the Czechoslovak Red Cross the means to carry out its activities under the Geneva Conventions within the scope of the tasks defined in Section 4 of this Act.
(2) In carrying out its tasks under the Geneva Conventions and the Resolutions of the International Conferences of the Red Cross and the Red Crescent, the Czechoslovak Red Cross is exempt from taxes, fees and duties.
(1) The State shall return to the Czechoslovak Red Cross the property which was withdrawn from it between 25.2.1948 and 31.12.1989 to the extent set out in the Annex to this Act.
(2) The real estate listed in the Annex to this Act is declared to be the property of the Czechoslovak Red Cross on the date of entry into force of this Act.
(3) The Czechoslovak Red Cross will enter into an agreement on the removal of immovable property listed in the Annex to this Act with existing users of real estate using them to provide medical or social services or for education, cultural or educational activities. If no agreement is reached, the Czechoslovak Red Cross shall be entitled to the removal of the properties listed in the Annex to this Act serving the above-mentioned purposes after five years. The conclusion of an agreement on the use of flats and non-residential premises is governed by the provisions of the Civil Code, the Law on the rental and subletting of non-residential premises and related regulations. This undertaking passes on to all other owners at that time.
(4) If there is no agreement on the amount of the rent and the conditions under which it is paid between existing users of real estate using it for the purposes set out in § 6 (3) of this Act and the Czechoslovak Red Cross, the level of the rent shall be decided by the competent authority of the state administration in accordance with generally applicable price regulations.
The Government of the Czech and Slovak Federal Republic may, by way of regulation, lay down detailed conditions for the implementation of this Act.
They shall be deleted:
1. Act No. 60 / 1952 Coll., on the Czechoslovak Red Cross and on the use of the sign, badge and name of the Red Cross,
2. Act No. 16 / 1958 Coll., amending and supplementing Act No. 60 / 1952 Coll., on the Czechoslovak Red Cross and on the use of the sign, badge and name of the Red Cross,
3rd Decree of the Ministry of Health No 56 / 1958 of the Ú.l., on the performance of the medical tasks of the Czechoslovak Red Cross,
4th Decree of the Ministry of Health and Social Affairs of the Czech Socialist Republic No. 112 / 1989 Coll., on the implementation of the medical, health and social tasks of the Czechoslovak Red Cross in the Czech Socialist Republic.
This Act shall take effect on 1 July 1992.
