The Treaty was approved by the Federal Assembly of the Czechoslovak Socialist Republic and ratified by the President of the Czechoslovak Socialist Republic. The instruments of ratification were exchanged in Prague on 10 October 1989.
The Treaty entered into force on 10 October 1989 pursuant to Article 5 thereof.
The Czech version of the Treaty is hereby published at the same time.
Minister:
JUDr. Johanes v. r.
TREATY
between the Czechoslovak Socialist Republic and the Polish People's Republic on the progress of national borders in relation to the results of the first joint examination of the progress of the Czechoslovak-Polish state borders at border waterways
President of the Czechoslovak Socialist Republic and the State Council of the People's Republic of Poland in an effort to fulfil their obligations to maintain national borders and border features arising from the Treaty between the Czechoslovak Socialist Republic and the Polish People's Republic on Legal Relations at the Czechoslovak-Polish State Borders, on Cooperation and Mutual Assistance in Border Affairs, signed in Prague on 2 December 1967 ("the Treaty on Legal Relations'),
they have decided to conclude this Treaty and to that end have appointed their agents:
President of the Czechoslovak Socialist Republic
JUDr. Vratislav Vajnar CSc.
Minister of Interior of the Czechoslovak Socialist Republic,
State Council of the People's Republic of Poland
General of the arms Czesława Kiszczaka
Minister of Interior of the People's Republic of Poland,
who, following the exchange of their full powers, found in good and proper form, have agreed on the following provisions:
In line with the results of the first joint examination of the progress of the Czechoslovak-Polish national border at the border waterways, which was carried out under the Treaty on Legal Relations by the Standing Czechoslovak-Polish Border Commission, the Czechoslovak-Polish national border at the border waterways is carried out as shown in the new border documents, which are:
(a) the protocol descriptions of the course of the border line with the numbers tables;
(b) drawings of the 1: 2000 scale of the border line;
(c) Final Protocol on the first joint examination of the progress of the Czechoslovak-Polish state border at border waterways in the years 1976- 1983, signed in Prague on 9 December 1983.
New border documents are an integral part of this Treaty.
The new border documents shall replace the relevant parts of the border documents, which form an integral part of the Treaty between the Czechoslovak Republic and the People's Republic of Poland on the definitive establishment of national borders, signed in Warsaw on 13 June 1958, in relation to the commonly examined sections of national borders at border waterways.
Areas of parts of the State Territories of the Czechoslovak Socialist Republic and the Polish People's Republic separated by sudden natural changes in the position of the riverbed of border watercourses, contained in the Final Protocol referred to in Article 1 (1). (c) the Treaties are mutually balanced.
The border line at the border waterways shown in the new border documents is, regardless of any changes in the position of their riverts, the starting line for the design of the water economic adjustment of border watercourses and for the second joint examination of the progress of the Czechoslovak-Polish state borders at border watercourses.
This Treaty shall be ratified and enter into force on the date of the exchange of instruments of ratification. The replacement of instruments of ratification will take place in Prague.
Done in Warsaw on 10 December 1986 in duplicate, each in the Czech and Polish languages, the two texts being equally authentic.
To prove this, the agents of the Contracting Parties signed this Treaty and sealed it.
