Ministry of Forestry and Water Management of the Czech Socialist Republic
of 7 October 1976
on water and summary water registers
The Ministry of Forestry and Water Management of the Czech Socialist Republic provides pursuant to § 15 paragraph 2 of the Act of the Czech National Council No. 130 / 1974 Coll., on State Administration in the Water Economy ("the Act"):
§ 1
Water registration
(1) The register shall contain the registers (file case) on which the measures referred to in Article 3 (hereinafter referred to as "measures"), the list of registers, the list of authorised (applicants) to whom the measure was issued and the collection of documents and documentation.
(2) The water management authorities shall keep a register of their measures and record the results of the review procedure carried out by the higher authorities.
(3) The measures of local (urban) national committees and, where appropriate, regional national committees to the extent provided for in Article 3 (2) of the Act and other measures of regional national committees concerning individual citizens (hereinafter referred to as "measures of local importance") are recorded in the lists of measures of local importance.
§ 2
Total water records
(1) The regional and similar national committees are entrusted with the management of the county's comprehensive water record. The summary water management record of the district shall include, in addition to the water management record of the district, the registers and a copy of the measures taken by other water management authorities concerning the territory of the district, together with any other documents and a clear map, giving an overview of the measures registered ("the clear map ').
(2) Watercourses managers (hereinafter referred to as "water catchment areas") are entrusted with the management of the summary water management register. The summary water management register of the river basin contains the registers, the list of registers, the list of authorised (applicants) to whom the measure has been issued, the collection of documents and documentation and a clear map. The registers shall record the measures of the water authorities relating to the river basin managed by the competent undertaking of the river basin with the following exception: for the Vltava river basin, the aggregated register in the catchment area of the lower Elbe (under Mělnik) shall be limited to measures having an immediate relation to the river basin managed by it.
(3) The Research Institute of Water Management Prague is entrusted with the management of the comprehensive water management register of the Czech Socialist Republic; it is managed by the Ministry of Forestry and Water Management of the Czech Socialist Republic ("the Ministry ').
§ 3
Measures notified
The following shall be recorded as part of the water register:
(a) a permit for the management of water, (1) to water works, (2) to certain activities and to construction in water-intensive areas, (3) to discharge waste water into public sewerage (4), as well as changes, cancellations and disappearances of such permits;
(b) agreements on the construction, installation and activities which may affect the water ratios (5) and the lapses in the validity of such agreements;
(c) an indication of whether the planned investment, the change in the production process or in the scope of production, or the modification or modification of the water-based work is possible from a water-based point of view and, where appropriate, under what conditions, if the permit or consent of the water-based authority is required to implement the project, 6)
(d) other measures taken by the water authorities
(1) establishing the territory of water courses within which the approval of the water authority is required for construction, plant or activities, (7)
2. Determination of flood areas, 7)
3. protection zones for the protection of the salinity, quality or health of waterresources (8) and in the case of waterworks. 9)
§ 4
Individual components of the water and aggregate water registers
(1) The evidence sheet is a form for recording data on measures subject to water registration pursuant to Article 3, with the exception of measures of local importance. Measures following previous measures on the same case shall be recorded on the record sheet of the previous measure.
(2) The list of registers shall be a set of bound notebooks, broken down by group of measures for the chronological recording of registers based on the water register or the summary water register of the district or river basin. It is used to check the completeness of the records and to clearly determine the numbers of the registers.
(3) The list of authorised applicants (s) is bound by a booklet for a clear indication of all authorised applicants (s) and the measures granted to them by the water authorities.
(4) The collection of documents and documentation is a set of files on registered measures. It shall contain copies of the measures registered and other documents, drawings and other supporting documents required for the issue of the measure.
(5) A clear map is a set of 1: 50 000 scale sheets of a water-based water-management map, possibly even more detailed maps of a larger scale showing the territories of the relevant district or river basin in which the measures subject to registration are drawn up using symbols.
§ 5
The applicant for a measure subject to a water management register shall submit to the water authority, together with the application, the documents and on the required form the information required for its processing, as verified and, where appropriate, supplemented by the competent undertaking in the water catchment area, and an appropriate situation basis for drawing up the required measure into a clear map.
§ 6
(1) Water and aggregate water registers are stored in a safe place so as to be protected against any damage, loss or theft.
(2) The rules on the protection of national, economic and professional secrecy must be complied with when handling classified documents.
§ 7
Registration of measures issued before the Decree is effective
(1) The water authorities will examine the existing records of water works and equipment and water permits and approvals and their amendments, if necessary, shall supplement and, where appropriate, specify the data registered and transfer them to new records no later than five years after the date of application of the Decree, in cooperation with the companies of the Water Council, to the extent specified by the Ministry. In this context, they shall carry out a one-off check of the recorded facts.
(2) Water authorities may require the necessary addition of data from organisations to which a measure has been granted.
§ 8
Water records shall be kept on the forms prescribed by the Ministry.
§ 9
The following shall be deleted:
Ordinance No 96 / 1957 of the Central Water Administration of the Ú. l., on the registration of water works and equipment, and of water permits and endorsements, as well as their amendments.
§ 10
This Decree shall take effect on 1 January 1978.
