of 14 November 1975
on the adjustment of working time and transfer of leave in 1976
The Government of the Czechoslovak Socialist Republic, after consulting the Central Council of the Trade Unions, established by order of 16 October 1975 pursuant to § 94 of the Labour Code:
Transfer of leave and working time
(1) In 1976, the working day of Sunday is 4 January and the day of work is Friday 2 January.
(2) The transfer of leave and working time does not apply to permanent workers.
(3) The working hours of business and service workers with contact with customers, workers supplying business premises, service workers and public transport workers shall be determined by the organisation in accordance with the general guidelines for adjusting the operating arrangements which, in the context of the movement of working time referred to in paragraph 1, shall be issued by the competent central authorities with regard to the needs of the population and socialist organisations.
Remuneration
(4) A worker who, as a result of the transfer of working hours, will work on Sunday, 4 January does not benefit from a wage advantage for working on Saturdays and Sundays on that day; 1) also for the remuneration of overtime is not considered to be a working day.
A worker who, according to the wage rules, is entitled to pay benefits for work on Saturdays and Sundays is entitled to such benefits for work on Friday, 2 January 1976.
Adjustment of working time on 24 and 31 December 1976
(5) Organisations may adjust the working hours for the 24th and 31 December 1976 with the agreement of the race committee of the Revolutionary Trade Union Movement, after consultation with the State authorities, as follows:
(a) in intermittent workplaces, the afternoon and night shift may be moved to another day;
(b) in production organisations, work in administrative departments may end at the same time as the end of the morning shift of production units,
(c) in non-production organisations, the shift may end at 14 o'clock.
The adjustment shall not apply to workers in continuous-operation workplaces.
(6) Measures in which, pursuant to the previous paragraph, the full shift or part of it is being moved, may be carried out by the organisation for workers remunerated by hourly wages only in agreement with them. in such cases, workers are not entitled to compensation for their wages for their work expenses. If no agreement is reached, the organisation shall allow workers to work full hours as possible on 24 or 31 December or other days.
(7) If the working hours referred to in the preceding paragraph are moved to Saturday or Sunday, workers shall not benefit from the wage advantage for work on Saturdays and Sundays.
(8) The length of working time on 24 and 31 December for business and service workers with contact with customers, workers supplying business premises, connection workers and public transport workers shall be determined by the organisation in accordance with the instructions of the competent central authorities.
Final provision
(9) This decree shall take effect on the day of its publication.
