on contacts between national and tugside routes and relations between participating organisations (trawl conditions)
In agreement with the participating central authorities, the Ministry of Transport provides in accordance with Sections 4 and 29 of Act No. 51 / 1964 Coll., on Railways:
Preliminary provisions
(1) When constructing the train, the builder is obliged to submit the preparatory documentation for assessment to the railway administration. Prior to the start of the project work, the possibilities, manner and conditions of connecting the train to the national rail (hereinafter referred to as the "railway ') and all other important issues of future contact between the railway and the train must be agreed.
(2) The tow is established, maintained and operated by an organisation which manages it (hereinafter referred to as the "tractor"). The skipper is obliged to keep the provisions of the Regulations on technical operation of lifts. *)
(3) The insertion, maintenance and renewal of the diverter switch, situated in the railway track, are carried out on the load of the railway tractor of the Czechoslovak State Railway (hereinafter referred to as "CSD"). Trucks in the railway district shall be maintained and operated by the CSDs on a tractor load; outside this circuit only if the safety of rail traffic so requires.
(4) Trawl operations may be initiated (implemented) if a trawl contract is concluded between the CSD and the tractor.
(5) The trawl contract shall specify the fare stations and the train connection stations. The fare station shall be the station of dispatch and destination for consignments of the tractor carried by rail. The train connection station shall be the train tariff station; the derogations are determined by the Ministry of Transport by a tariff.
Trailer and connection traffic
(1) Trawl operations are divided into connection and tractor operations. On the tractor where the trailer is connected to the tractor operation, the place of mutual transmission between the CSD and the tractor (hereinafter referred to as "the point of surrender ') shall be determined. Instead of surrender, the train should be as close as possible to where the train diverges from the railway track. Instead of surrender, the trawl contract is determined.
(2) The connection operation means the placing of wagons at the point of surrender and moving them from that point to the rail. The connection operation is carried out continuously (day and night, Sundays and holidays and other days of work) by the service provided by the connection station after consultation with the tractor.
(3) CSDs may temporarily interrupt or restrict connection operation for operational reasons. They shall inform the tractor of this at least 7 days in advance in order to take the necessary measures. In doing so, the CSD shall establish a place for the surrender or acceptance of consignments of the tractor.
(4) Trailer traffic means the transport of wagons by tractor from the point of submission to the train and vice versa, as well as other operations on that part of the train.
(5) The connection operation is carried out by CSD on the freight of the tractor. Trawl operations are carried out by a tractor; the trawl contract may provide otherwise.
Vehicle transition
(1) Wagons intended for unloading or loading of consignments carried by rail may pass from the rail and vice versa. A special CSD permit is required for the carriage of wagons intended for unloading or loading of packages and for the carriage of goods between the tariff station and the train or between two trains with the same tariff station ("local transport ').
(2) If the structure and equipment of the towed vehicle complies with the conditions for the carriage of passengers, the railway administration may exceptionally authorise the carriage of passengers from rail to train and vice versa.
(3) CSDs may exclude wagons whose transition would require special measures or cause difficulties in the operation of the railway.
(4) The tractor's locomotive may go to railway tracks if operating conditions so permit, if it complies with the ČSD regulations, if it is in good running condition and is visibly marked with its capability to move to the railway. The conditions for trailing a tractor's locomotive to railway tracks shall be laid down in a trawl contract; On a case-by-case basis, the station chief.
Mutual surrender of wagons
(1) Wagons shall be placed at the point of surrender unsorted, properly attached to each other and with brake couplings either attached to each other or suspended, properly cleaned, closed and with all separable components, vehicle fittings and means of transport with which they are presented according to documents. Against the drift, the submitting party shall provide the wagons at the point of arrival; otherwise the tractor is responsible for securing the wagons against the whole train.
(2) If operating conditions permit, the CSD will bring the wagons to the place of the submission arranged according to the wishes of the tractor. If the tractor has a suitable device (locomotive, spliced hill, etc.) or the possibility, for example, to create complete trains or groups by gluing the wagons and allowing its operational conditions, the tractor shall prepare the wagons on the spot in order of ČSD requirements (e.g. the assembly of trains according to the provisions of the ČSD transport regulations, especially the group of loaded and empty vehicles, the grouping of wagons for carriage by rail according to directions, lines or even stations). At the request of the CSD, the tractor also hits returned wagons according to the CSD regulations. The tractor shall be responsible for the accuracy of the implementation of these operations.
(3) If the drop point is overloaded, so that the introduction of other wagons is not possible, or if the wagons cannot move for their condition, construction, load defects or obstacles in the construction or condition of the train, move to the train, they shall be detained at the station of destination or another station. The CSD will inform the tractor with a call to decide what is to happen to them. The arrest goes to whoever's responsible for the delay.
(4) If the transfer point is overfilled more often and thus more frequently by wagon retention and if the tractor station has called for a remedy, the retained wagons may be prepared for unloading and loading on general unloading and loading tracks at the destination station (dispatch). If the tractor requests to be detained at the station of destination or to be prepared for general unloading and loading tracks, the ČSD shall comply with the application if this does not result in overloading of the station; The arrest goes to the boatman.
(5) The surrender of wagons shall be carried out by technical and commercial inspection of the wagons. The tractor shall be responsible for the completeness and integrity of the wagons and consignments from the moment the wagons and consignments were taken over until the moment the wagons and consignments were transferred to the CSD. The tractor shall not be responsible for the completeness and integrity of the wagons and consignments if it proves that the loss or damage to the vehicle parts or consignments has not been caused on the tractor.
Vehicle damage
(1) If the railway wagon is damaged on a tractor and the tractor is responsible for the damage, it is obliged to pay the CSD, in addition to compensation (or flat-rate compensation) of the damage caused on the railway vehicle, an amount equal to three times the damage caused or a flat-rate compensation. In addition, the tractor shall pay the amount of the import fee, including, where appropriate, the repair fee. If the train is damaged by the CSD locomotive and the tractor is responsible for the damage, it shall pay a compensation of the amount fixed by the CSD and twice the compensation for the repair. In addition, the tractor shall pay compensation for the downtime of the locomotives in repair for each day for the period determined by the CSD.
(2) The boarder repairs the CSD vehicles if the train has suitable equipment. The type and scope of the individual repair of the wagons and their components to be carried out by the tractor shall be determined by a trawl agreement or a special agreement. In the case of wagons that have been repaired by the tractor, no compensation or amount shall be paid for damage to the train.
(3) In order to investigate an accident on a tractor caused in the operation of the CSD, the CSD will invite a tractor to investigate an accident caused in the operation of the tractor if compensation could affect the other side.
Safety of operation and use of railway wagons
(1) In the interests of railway safety, the tractor shall in particular:
(a) to notify the trailer station of any accident and any damage to the wagon on the train, in particular the derailment of the vehicle and the defects detected on the wagon;
(b) notify the trailer station of a detected failure on the tractor which could jeopardise the safety of the tractor;
(c) maintain a cross-section and prescribed free areas along the tracks;
(d) properly provide wagons against drift;
(e) the brake couplings shall be clamped or suspended,
(f) ensure, in the prescribed manner, all removable components on wagons;
(g) to use only equipment approved by CSDs for the handling of wagons, in a specified manner.
(2) Without the prior approval of the trailer station, the tractor shall not:
(a) use the railway wagon after unloading or before loading the consignment for local transport;
(b) use a container or refrigerated vehicle for the loading of goods other than authorised goods;
(c) send an empty CSD tank or cooling wagon to a destination station other than that specified by the trailer station.
(3) A tractor shall pay for failure to comply with one of those provisions:

(4) The tractor will pay CSD Kčs 1200 for each car, Kčs 1800 for each car of foreign rail administrations, Kčs 1500 for each car of railway socialist countries included in the joint park of railway carriage2) loaded without prior agreement of the CSD. In addition, the CSD can refuse to take over the wagon without prior consent and the tractor is obliged to unload the wagon immediately.
(5) The tractor will pay CZK 1200 for each wagon which prepares to be moved from the train, not placed in the prescribed condition (e.g. uncleaned, unclosed or without all separable parts of the carriage equipment or means of transport).
Eligibility of tractor workers
(1) Trailer workers involved in the handling of wagons and shipments, wheelchair workers, construction maintenance, communication and safety maintenance must be fit for the performance of the service and must have the expertise prescribed for such categories of CSDs personnel.
(2) The tractor shall be obliged to designate a worker responsible for the proper technical condition of the tractor and its equipment, for the proper and safe running of the tractor and for the proper management of railway wagons (hereinafter referred to as the "train traffic manager"). Only a staff member who has been recognised as eligible by the CSD may be appointed manager of the train operation. In the absence of a train manager, a representative shall be appointed. On a train with simple operational conditions, it shall assume the duties of the train manager leading the tractor plant, and if it moves with the wagons, a responsible shift manager shall be established and its name shall be notified to the trailer station.
(3) CSDs are required to monitor compliance with the regulations in the operation of the train, whether it is properly handled and managed by wagons moving from rail to train and to ensure the competence of the tractor staff used in the operation of the tractor. The skipper is obliged to follow the instructions of the CSD and to exclude all workers who are declared unfit by the CSD.
Tracking
(1) If the operational conditions of the railway station and trawls so require, the ČSD, in cooperation with the tractor, shall draw up and issue on its load uniform technological procedures for the work of the station and the train.
(2) Both the tractor and the CSD must create conditions for continuous, continuous unloading and uniform loading.
(3) During the duration of the carriage on the train, CSDs collect the fee according to the Tarif of the Trail Performance (TR 62).
(4) The time-limits for the carriage on the train are determined by the CSD according to the schedule of regular train operators and taking into account the operating conditions in the connection (tariff) station and on the train, but not generally longer than 8 hours. If the tractor does not prepare the wagon at the delivery point within the prescribed time limit, the ČSD will pay for each and only starting hour of overshoot in working days delayed by the Kčs 75, on working and rest days delayed by the Kčs 150. The delay is charged up to an hour of regular service, to which the car was ready to be moved. If entitlement to a delay of CZK 150 is established, this amount shall be charged up to an hour of regular service, to which the vehicle has been ready to be moved.
(5) The retention shall not be charged in cases where the tractor does not prepare the wagons to be moved within the prescribed time limit, but is prepared for the nearest regular service following the expiry of that period. If the specified time limit expires at the time of regular service, the wagons shall be ready to be moved to that service.
(6) For each carriage of foreign railway administrations excluding railway wagons of socialist countries included in the joint park of railway carriage2) and for each and only begun hour of the exceeding of the prescribed period of stay, the tractor shall be paid twice as long.
(7) The stay of loaded and empty wagons intended for landing on a tractor and detained at the station of destination or at another station due to reasons on the part of the tractor is subject to the burden of the tractor. The period of stay at the station of destination shall begin to run from the nearest regular service that the wagons may have landed on the train and shall end with the time of their embarkation on the train closest to the regular service after notification by the tractor that the arrival of the wagons is possible; in another station, by the time they are detained until they are moved, but no later than 6 hours after the announcement, when the trailer has been approved by the tractor to land the wagons. It shall be charged late for that period.
(8) CSDs may, after prior notification for a transitional period, increase delays up to three times in the case of wagons of certain series or ownership marks in the case of difficult operating conditions in a trailer (tariff) station or area, or in cases where the tractor repeatedly exceeds the specified duration of the carriage on the train.
(9) CSDs may allow the calculation of the delay over the whole month. In the case where in a specific month the average residence of the wagons on the train has not exceeded the prescribed time limit, the delay shall not be charged for the wagons included in the calculation.
(10) CSDs may, at the request of a tractor, reduce the amount of delays charged by up to 50% if the overrun of the stated time limit of residence of the vehicle is due to emergency disturbances in loading and unloading equipment which the tractor could not prevent even if all efforts were made. CSDs may reduce or forgive the delays charged if the time limit for the carriage has been exceeded as a result of inevitable events of a natural nature.
(11) The connection station shall report the wagons fitted by the train and vice versa and shall monitor their handling on the train.
Conditions of transport
The provisions of the Railway Regulations shall apply to the carriage of goods by road loaded or unloaded and transported by rail, to the carriage of goods by car in international transport, to the Agreement on the International Carriage of Goods by Rail (SMGS), to the International Convention on the Carriage of Goods by Rail (CIM) and to the Directive on the Carriage of Goods by Rail in International Carriage, unless otherwise provided for in Decree No 126 / 1964 Coll. The conditions for the transport of consignments by local transport and for the transport of consignments by tractor shall be laid down in a tariff.
Receipt and delivery. Delivery periods
(1) The place of take-over of the loaded vehicle for transport is the designated place of departure, even if the transport contract has not yet been negotiated. The drop-off point for the tractor is the drop-off point.
(2) The accompanying documents of consignments moving from the railway to the train and vice versa shall be processed at the connection station unless the CSD, in agreement with the tractor, has established a branch of the freight register on the train.
(3) CSDs shall be handed over by the trawlers according to the possibilities and local conditions at the same time as the consignment and the consignment notes. If the information provided on the vehicle stickers is sufficient to safely unload the consignment, the tractor shall be obliged to take over the consignment without accompanying documents.
(4) Trailers do not report on the setting of cars at the place of the CSD submission. During regular service times, the skipper is obliged to expect the arrival of the wagons (consignments) and be ready for immediate deployment to the handling points and to perform loading handling.
(5) In the case of consignments intended for tugs, the delivery period shall be deemed to be maintained if the consignment reaches the station of destination before the end of the delivery period and if it is ready to be taken at the point of departure at the nearest regular service of the tug, it is possible, according to the technological procedure of the station and the train.
Tractor weight detection
The weight of consignments loaded on a tractor shall be determined by the consignor. The CSDs are entitled to carry out control weighing on the tractor scales.
Compensation for work done
(1) The acts resulting from this decree shall be levied or paid in accordance with the Tarif of Trawl Performance (TR 62).
(2) The general provisions on payment and settlement arrangements shall apply to the way in which compensation is to be settled with the tractor, except as otherwise provided in specific provisions. Reimbursements, delays and other charges are paid in an uncash manner (by debit order).
Changes in contractual relations
(1) If the use of the tug is left to another organisation, this organisation does not enter into a legal relationship based on a trawl agreement negotiated by the ČSD with the tractor. CSDs are not obliged to continue to land wagons on a train unless a new trawl contract is negotiated with the successor of a former tractor.
(2) If the assumptions and conditions for the duration or operation of the tractor change, each party may terminate the contract at any time. The period of notice shall be three months.
(3) When cancelling the train, the tractor is obliged to remove from the ČSD land everything that it has set up on it unless otherwise specified by the ČSD. If the tractor does not restore the original condition, the ČSD will carry out the necessary measures (work) on the tractor's cargo.
Couse of the train
(1) A tractor (investor) may: *)
(a) agree to connect another train and allow the carriage of wagons from the railway to that other train on its tractor and vice versa;
(b) agree to co-use of its tractor to other organisations for the loading and unloading of wagons carried by rail, provided that the conditions and conditions for the timely loading and unloading of wagons are met and that the circulation of railway wagons is not significantly delayed against loading handling at the CSD station;
(c) to carry between different locations their wagons (consignments) and their personnel.
(2) The Ministry of Transport may, in agreement with its superior authority, require a national development plan for the national economy or interest in the defence of the State to be implemented in order to allow another organisation to co-use the train.
(3) The relationship and the amount of compensation for the actions carried out between the tractor and the co-user of the tractor shall be adjusted in a similar manner to that between the tractor and the CSD. The co-use contract shall be concluded before the co-user carriages are introduced.
(4) The CSDs may, in agreement with the tractor, co-use free of charge of the train for moving operations, for the weaning of wagons and for the transport of their consignments, but in such a way that co-use does not restrict the operation of the tractor.
Use of special purpose trawl
In the event of a state's security alert, both the CSD and the military administration are entitled to stop or restrict the operation of the tractor and use it, including material and technical equipment, for any purpose. This does not entitle the boarder to pay for the damage caused. However, the CSD or military administration of the tractor must notify the stopping operation and use of the train. All wagons, eligible for military carriage and standing on a tractor, shall be obliged to unload at the request of the tractor immediately; If they do not do so, they shall be unloaded at its expense and risk.
Supervision
(1) In order to ensure the safety of train operations, the technical authorities of the construction, communication and safety maintenance of the tractor shall exercise continuous supervision. On the parts of the train situated in the railway circuit, the permanent supervision of the CSD is carried out by the tractor. The provisions on national rail surveillance are not affected by this provision.
(2) The boarder allows CSD personnel to access the train perimeter in connection with the supervision, supervision or operational tasks in connection with the connection. The CSD allows the tractor staff to access the circuit of the trailer station while providing connection.
Transitional and final provisions
(1) The trawl agreements negotiated before the entry into force of this decree remain unaffected if they do not conflict with that decree.
(2) This Decree shall take effect on 1 July 1964.
